    Ask them for the Search Warrant. They should at least have to have a reasonable belief that you have software on your computer that is not licensed. Arbitrary demands to search your computer are unreasonable, they cost you both time and money, no court should uphold a part of a license that subjects anyone or any institution to unreasonable searches or demands, no matter what the licensing. Notice in all EULAs they put that little clause in there that says, "If any part of this license should be found unenforceable, then the rest of the license shall remain in full effect..." That's because the EULAs have not been thoroughly tested in a court of law, and they know they are going to lose on some parts. Without some kind of evidence they're going to have a pretty weak case.

  2. Fair Use??? on Sony Intentionally Crashes Customers' Computers · · Score: 1

    I understand that this won't play in a PC or Mac CDRom drive because they use the Key2Audio protection software. While most of us may consider that unreasonable, they claim to clearly state it on the outside of the packaging, so the buyer can make an informed choice. So it is reasonable to assume that the informed buyer has chosen to agree to these terms. However, under the Fair Use act, it is also reasonable for the informed buyer to assume that they should be able to make a back-up copy, and most of us aren't rich enough to purchase our PCs (equipped with CD back-up technology) and run out and buy a Phillips CD copier to make our back-ups, not that it would necessarily be any more successful in making back-up copies. So, if we are totally locked out of making back-up copies, which is legal under the Fair Use act, hasn't Sony violated the law by denying us this ability? I wonder if the EFF would be willing to put together a class-action lawsuit for the violation of the Fair Use act by Sony?

    Without the basis of his case, the RIAA threat to sue him, Mr. Felten unfortunately has no legal ground to stand on. I'm sure the RIAA lawyers knew that when they made their pathetic gesture, which was probably motivated by their desire to protect the DMCA from a legal challenge.

  4. Short Concise DEAD Trees.. on What Kind of Books do You Want? · · Score: 1

    Lump me in with the rest of the dead tree people. I definitely prefer being able to take my book with me without having to lug along a power generator for my PC (since some of us can't afford a laptop on top of our PC). And I like being able to make notes in the margin that I can look at when a thought hits me, without having to startup my machine.

    Also, I want short and concise material with complete examples.

    Something with chapters that end with a completed iteration of a new feature, or an independent and complete example. There's plenty of Dummies crap out there, give me something that starts at intermediate, and finishes with Advanced.

    A function reference in the back with the function name, required/optional parameters and what they do, short explanation of what the function does, and a short, complete, no frills example.

    Also, humor is good, but I don't need the author's life story, or his ancedotal experiences with all his friends.

    Last, one where the author is not paid by the page, but rather one where they are paid a little more royalties, so they are forced to write a good book that people will recommend. If the author knows his income is going to be based on people's recommendations, he's going to be damned sure he makes it not only interesting, but useful.

  5. Privacy Violations and Other Bad Ideas... Hello? on Whistler "Anti-Piracy" Tools Tie OS To Machine · · Score: 1

    Can anyone say "Right to Privacy" violation? Last time I checked there was a problem with privacy rights violation when someone wanted to use their (well known) little hidden hardware id (cough... I..n..t..e..l cough... cough...) that they transmitted via the Internet for secure transactions. What gives M$ the right to gather any information about my PC. I thought they, among others, were told by our courts that they couldn't do that when they tried to sneak info off our systems whenever we went to websites. Also many people have pointed out that this screams of DivX (DVD with X-tra Bill-ing type crap), and I tend to agree. However, M$ may have the money to force the i$$ue where Circuit $hitty lost. Then as someone else pointed out, how long is it really going to be before script kiddies run a few of their Denial Of Service scripts? That ought to really piss people off, not to mention M$ I'm pretty sure that Billy-boy is just lining up the market for his next brilliant marketing scheme of always having to authenticate a program prior to running it (M$Office 10). Many people have said there will most likely be a crack out either before Whistler hits the shelves, or shortly after it arrives. I have two views to this: 1) If nobody bothers to waste the time on a crack, then many people won't be able to install/copy it and further M$'s grasp. Instead they will have to look for alternative OS's or bite the bullet. I don't believe most people will buy two or three copies before the light goes on that there has to be a better/cheaper solution. By cracking it, and getting more people using it, you just help M$ proliferate their crap, and help increase the demand for products on the M$ OS. 2) If anyone had bothered to pay attention to the articles, they claim that the "'Royalty OEM initial install images' provided to PC makers " will not include this protection. So, it appears that M$ has already provided the crack for everyone. Thanks Bill, you've really got a lot of people screaming about a lot of nothing... What are you really trying to slide under the bridge before the DOJ notices this time? BTW how's that anti-trust suit going? AWWWW, still dragging on? To bad. I sure hope Justice prevails >) (she may be blind but she's not stupid). I just hope she can't be bought. So what's the plan if yer split? Really, Balmy-boy gets M$-West, while you step up to take control of M$-East and further the empire. Gee I wouldn't think there would be any collusion between two old school-yard buddies, never. What's the move when you get caught with your pants down on that one?
