Careful. It's not as cut and dry as that. Out of 4 rulings, the appeals court threw one out, sent two back to be entirely reconsidered, and upheld one. The one that was upheld had to with monopoly maintenance. For example, Microsoft gave OEMs large price incentives to sign their contract, which determined what the OEMs could and could not add to / remove from the desktop.

You are correct, and this is my point exactly. This case has not been completely decided yet. But Microsoft is allowed to continue on without restriction or scrutiny while the new judges try to figured out what exactly happed here.

If I am a notorious cat burgler, (A Digital Big Pussy if you will), I have been hunted and chased for many years and finally the authorities gets enough clues to prosecute me. Let's say they found forenesic traces of a material at the crime scene that points to me as the perpetrator. If you combine this other trace evidence they found, it makes me look pretty guilty. I'm probably the culprit but a few more forensic details have to be worked out before the prosecution can continue foward.
While the details are being hash out by the legal beagles. Imagine now that I am left by the authroties to continue freely without being followed on scrutizeded at all any further. Well, my first motivation would be to clean up my trail as quietly as possible. Frame other burglers, put forenisc evidence in other un robbed museums. I then learn from my past mistakes when I got caught and improve my skills in the art of thievery dramtically. Now I leave fake art behind when I steal . My victoms don't even know they are being robbed. I used new tools and steal differnet types of art. By the time the lawyers figiure out what happened, I will have covered my tracks and implemented new methods of covering my tracks.

If my activities were restrained and watched during these procedings I won't have much of a chance to do any of this. Unless the authorties didn't understand the nature of my tactics in the first place. It looks greek to me! press on! nothing to see here!

Microsoft is guilty. Why should they be allowed to morph thier guilty product during an appeal?
It's like the justic department is saying'I know your are guilty of making a product to enhance your monopoly but it's okay to keep selling it and improving your monopoly position while we decice how punish you." HELLO! "Yes, are a mass murderer and are guilty. You may still practice and improving your murdering skills while we decide what to do with you." Am I off base here?

E has been into fule cell technology for a while now. I bought stock in PlugPower's IPO Almost 2 years ago. GE has holdings in both Ballard and PlugPower Ivestors. PlugPower is Focusing on Residential Power whereas Ballard is focusing on Automobile applications. Plugs are supposed to be powered from Methane/Propane conversion. Here is a quick explantion of it's workings from Plug Power's Site.; Warning; This is all currently vaporware. There is no commercial product yet and the company is skiddish on releasing dates. I heard the home unit version supposed sold for around $5000 and it will power your entire home. This will be a boon for Urban areas and California residences.; It's anyones guess when this technolgy will be ready for prime time.

If this is true than Gold should be pretty common within the solar system. Why just have it on earth only? Those mars probes should be able to pay for them selves when one lands on the Mother Load. I hereby delcare that all future planatary probes must have a new list of standard gear installed. 1 Rock Hammer 1 Core Driller 1 Portable Strip Mining conveyor belt. 1 Portable Smelter 1 Gold detector (can be modeled after Ivanna Trumps scent glands.) We should start manufacturing mining equipment now on the International Space Station. And add a few Gold Dust collectors to help pay for expenses. Damn this is so easy. The world is gonna be rich!

One of the bigest advanatages of HTS Transmission is a not only less resistance but lower power operating temperatures. This is not a direct affect of the Nitrogen cooling. When the Material is operating at superconducting temperatures the lack of resistance creates absoluty no heat in transmission. Once the temperature is reached it is easy to maintain. The transmission of power through the cable has no affect on core temperature. Very little energy is needed to keep it in a supercontuctive state once it is reached. burying the cable will assist in prviding a natural and cost effective way of assisting in ambient temperature degridation. Here is a company that was the first to have an operational prototype. picture included. Intermagnetics

We as humans believe we have come a long way in science and technology. Yet our own SETI program is simply looking for any simple artificial signal that has a clue intelligent life. Since that is what we are looking for shouln't we be sending that type of signal. A very simple short and repetative signal. Instead many seem set on sending math equations and DNA sequences that may otherwise be missed by other worlds simply looking for a just simple sign of life. Instead they keep trying to send the Libray of Congress. It would thing It would be more effective to send a simple straight forward repeating signal such as a rising and falling tone followed by a short beep. Kind of like a FAX carrir signal. Just let them know we are listening.
