Their intentions and goals are good, but it's a long way from ready for inclusion. It's a step along the road, but they need to submit a final and fully debugged version that doesn't bork anything, and with less marketdroid spin and more comprehensive testing and performance metrics.

There's always a delay in reacting to an input, and it's always buffered in some way. Even a lightbulb and switch buffers the signal along the length of the wire from the switch to the bulb. More complex systems, like a phone PBX that has to respond to signals coming down the wire buffers them in a DSP before actually responding to them. If the operating system (in the sense of the executable running on the CPU as we're discussing here) had to respond in 'real time' to every signal on the line or even from the DSP, then you'd be dropping calls or missing other scheduled tasks.
All OSes involve a compromise. An 'RTOS' is only more interruptable by degree than an already fairly low latency OS like Linux. Linux has some way to go yet, but it's already good enough for a lot of systems. And - gasp - even an 'RTOS' can and does miss inputs.
That Groklaw will do that, within the bounds of fair use. Not that you actually had any intention of doing it, of course, but it's always fun to come up with great ideas for less lazy people to implement.

Would it really fuck up an editor's day to actually do some, you know, editing? What the hell do these guys do all day, and can I get paid to do the same?
Remember that their reaction to this will be to screech about how it demonstrates that need even more laws to protect the level of profits that they demand. In the mid term, it may just be a case of them needing to bribe^H^H^H^H^H donate more in order to purchase DMCA v2.0 that gets around these pesky 'due process' loopholes.
If we need tissue samples to get a full analysis, then why not just kill one of them? Note: one, not go into a buffalo slaughter frenzy. If the population is so small that it can't lose one individual, then they're boned anyway.
I'm rather minded to believe that the whole mystery serves as a useful way to keep your funding rolling in.
