I was going to reply to the journal entry in your sig but it's been archived and posting disabled.

I was going to buy one a while back. I forget what it was now. Anyhow the domains was registered to a guy with a disconnected telephone and the address was that of AMD's. I had no way to contact him (neither did the registrar) and the domain was paid through 2010. IMHO one should be able to start some sort of process with ICANN that would work with the controlling registrar to contact the original owner. If the owner could not be contacted after X days (90?) and the domain had no valid NS records (that would give you a provider to contact) then the domain should be disabled in the registry. Keep it disabled for another 30 days (to get the owner's attention if they are paying attention at all) and then release it back into the wild. I could understand the new owner having to pay $X amount per year on the remaining time already paid for on the domain. That could be returned to the original owner if they ask for it within X days of the domain being resold. After than return the amount to the new owner or a portion of it. Basically it annoys me that someone can buy a domain, provide fake WHOIS info, and be able to sit on the domain without using it indefinitely as long as their bill is paid. There should be some requirement that says the domain has to be used (and a registrar's generic new site page shouldn't count). That would be nice. I wonder if a domain ICANN's Uniform Domain Name Dispute Policy could be used here...

That's one place we never should have gotten involved in to begin with. To say that anyone in favor of pulling out of Vietnam and letting it be is in favor of Communism is absurd. That's like Bush saying that anyone not supporting him invading Iraq is unpatriotic and in support of terrorism. Kerry may not be perfect but he's not a fan of communism. Bush sure as hell isn't perfect and he may very well be in favor of communism if his little family is at the top of the food chain. Unfortunately we'll probably never know Bush's true thoughts on that topic because quite frankly Junior can't possibly form logical sentences that spins^H^H^H^Hums up his family's^H^H^H^H^H^H^H^Hpersonal thoughts on the matter.

While I agree that it's pretty shitty of the RIAA to give out the misc crap it can't pay people to take, I do think it's definitely censorship to keep libraries from archiving it. If they want to either a) verify a person's age before listening to said material or b) have the child's parents sign a consent form to permit their child to listen to said material then I'd approve of that tactic. I do not however think that an adult should be kept from listening to something a library archives no matter what Phill thinks is profane. What is it about state's in the damned bible belt. First our state's Board of Education elects to omit evolution from our state's curriculum Then Kline gets off on a censorship rant. What's next? No Sunday liquor sales? Oh wait... We don't honor the separation of church and state in Kansas. No uniform Sunday liquor sale laws in Kansas. Oh, and our lovely governess also vetoed our most recent attempt at getting concealed carry legalized in Kansas. Kansas is one of 4 states (out of 50 in case you didn't already know) that doesn't permit concealed carry. 46 states do permit concealed carry. I swear, this state has issues. There is no way that a car, travelling so fast that an obstruction in a part of the road that is not yet visible cannot be avoided, can be considered to be travelling at a safe speed.

That's absurd. It sounds logical but it's not. Are you a city slicker? Is the smallest road you've ever driven on outside of a city a 4 or 6 lane behemoth? Have you ever driven on a narrow 2-lane county road? Have you ever driven through rural America? I can think of at least 2 dozen spots in the road in the 20 miles to the west of here that create the exact circumstances you seem to think are the driver's fault. The speed limit on that stretch of road is 55 for the first 4 miles and 60 for the next 16. If there was an obstruction in the road just beyond your eye-sight in any one of those spots you could not get your vehicle shutdown in time to avoid the collision. Blaming that on the driver certainly isn't reasonable.

Will Apple ever allow the Mac line to be made outside the company again, as it was in the Jean Louis Gassée days?

No, they never will. At least they won't if they value their company, their products, their income, and the people who support all that. The Apple clone market was a resounding fuckup. That idiot CEO should be flogged for what he did. He caused an absolute nightmare for support. People didn't call Epson or Umax for tech support. Oh no. They saw the Apple logo and called Apple for support. The Umax and Epson clones were the worst of the lot. At an Apple Service Center I worked at we had racks of dead Epson and Umax clones. They couldn't be fixed. The companies refused to honor the warranties. They were POSs. DayStar and Power Computing did a pretty damned good job of making clones (especially the SMP DayStar boxes) but that still didn't fix the support issue. The Radius machines were also junk. The clone "experiment" was far and away a horrible fuckup that we all should hope never happens again.

And it wasn't Jean that licensed the OS and CHRP platform to the cloners. It was Spindler.

My standard response when given any sort of contract is that I'll get back with them in a week after my attorney and I have had time to review the contract further. If they ask you why simply tell them that you are an IT professional, not a legal professional and want to cover your bases. You would be surprised how often that small assertion of your rights will benefit you in the long run. Don't bother signing a contract with any company that insists you sign it then and there or tries to dissuade you from having a lawyer refer the contract before signing it. Odds are they have something to hide. Also ask for copies of all paperwork that you need to sign for the employment in advance and take it with your contract to your lawyer. Companies tend to keep contractual clauses and restrictive policies separate from employment contracts. On average having an lawyer spend a hour with me to review my contract over lunch costs me about $50 plus lunch. I wouldn't consider doing it any other way.

I've been investing for a short time now and have done pretty well. I tend to stick with companies I know and have an understanding of their products. One thing I've had great luck with and have found to be highly recommended is buying when stock prices plummet for one reason or another. Take for example a couple weeks ago when Redhat announced they were restate their audited financial statements for 02-04. They really weren't changing anything but investors freaked nonetheless. RHAT stock dropped 25% from 21 to 15 per share overnight. I bought the next day at $15.51. Or take for example Apple at the end of June announcing a slight delay in the debute of the new iMac. The investors freaked again and the price dropped from 33.5 to 29 in a week or so. I bought shares too early at $30.50, again a few days later at $30.25 and a week later at $29.50. With the exception of today Apple stock has been doing good. Come September I expect to be sitting pretty. :-) I'm a strong believer in buying stock in good companies when the other investors freak and drive the price down. It's worked well for me. Pick a 4 or 5 dozen companies you know well and watch their stock. Keep cash at the ready to invest if the price drops to something too good to pass up.

If you want a safe investment the no-load index funds that are based on the S&P 500 like the Vanguard 500 and the USAA S&P 500 are a good choice. Another good choice are index funds based on the S&P 400 MidCap Index like the . The funds based on the Russell 2000 Index are also a good buy ( Vanguard SmallCap Index).

Even among index funds you should have some diversity such as 50% SmallCap and 50% S&P 500. You can see the average returns for youself in this handy table. Make sure you pick a fund with a low expense ratio. Definitely diversify though. And don't plan on striking it rich. Plan on investing for the long-term. After your feet are thoroughly wet you might find an opportunity for a small purchase of Company X that you feel will do well. Beyond that though invest safely.

I can't disagree more. Athletics and ALL other extra curricular activities are critical to child's education. Extra curicular activities can give a child a sense of confidence and achievement rarely found in a classroom. This new found confidence will serve them well both in the classroom and in their future activities/life. Most everyone would benefit from Debate, Scholar's Bowl, or math competitions (like I did). Ssome sports might not be for everyone but there is always something you can do. My HS was small enough we could play any sport we wanted. No try-outs. No politics. If you wanted to play just show up. I had a full year of sports and other extra curicular activities like band and math competitions. I encountered dozens of people that were home schooled through HS. Those people had no opportunity to build team work skills, achieve goals, or perform for others. Those people were certainly the worse for it. The vast majority lacked basic social skills. I don't believe one school's extra curicular activity should dwarf the others but I do believe they are a critical part of every student's life.

User B buys a copy of said software from Company A. The Xbox folks release an update that breaks Company A's software. The Xbox folks can't sue Company A because they presumably haven't broken any laws. User B can sue however if Company A doesn't fulfill their end of the implied contract for working software.
