From the article, ". There he will remain until Beaver County Attorney Leo Kanell decides whether to bring criminal libel charges.." The reason I posted this information is to dispel any chance of them nailing the kid for libel. In fact, if the school administrators in question had not raised the issue at all, very few would have seen the supposed libelous website. What could be really amusing though is if the teachers in question have to defend themselved in court against students who would testift about their verbal comments that those teachers sucked. The slut thing would be a fun one too.

  4. Not Libel -Libel checklist on Criminal Libel, Free Speech And The Net · · Score: 5
Here is a libel checklist from here:

Look for material that identifies a person or an entity. Keep in mind that it is possible to identify people or entities like corporations without actually using a name. If the material contains identifiable voices, likenesses, or descriptions of or concerning a person or a company, it could be a problem.

The material identifies a person or entity. STOP HERE if the material does not identify a person, business or other entity. You can't have a libel without someone to complain about it!

Is any identified person dead? There is little reason to be concerned with statements or other material reflecting badly on dead persons because the law only protects "the memory of the dead," giving no cause of action to decedents. So long as the material concerns only the dead person, you need not answer the rest of the questions on this form.STOP HERE if the person identified is dead.

If material identifies a living person, is it:
    A private individual.
    A public person.
    A political person.

Would the material negatively influence a reasonable reader's opinion of the person or entity identified?
    a. It would reflect badly on the character of the person or entity.
    b. It could harm the reputation, diminish the esteem, respect or good will in which the person or entity's relevant community holds him, her or it.

If the material might reflect badly on character and/or harm reputation, would the harm be the result of:
    An explicit statement.
    An insinuation.
    A sarcastic statement.
    A parody or cartoon.
An opinion that implies that there are unstated defamatory facts underlying it.
    Other.

There are several possible defenses to a claim of defamation, although none may apply in a particular case. Check one of the following defenses only if you are fairly certain it would apply.
The statement or other material is true.
The statement or other material is a fair report of an official or public record or proceeding.
The statement or other material is purely an expression of opinion and not an assertion of fact.

The statement or other material constitutes a fair comment - that is, a comment or opinion on a matter of public concern, for example, the use of public money, disbarment of attorneys, management of public institutions and charities, management of private companies whose activities widely affect the public (pollution, delivery of medical services, common carriage, employment practices, discrimination, etc.) or the review of books, public entertainment, sports events or scientific discoveries.

No one could reasonably interpret the statement or image to be an assertion of actual fact about the person or entity.

The statement or image can be characterized as mere words of abuse, indicating dislike for the person or entity, but does not suggest any specific charge.

The subject of the statement or image has given consent to or approved the material.

The fact that material has already been printed somewhere else is not a defense except in the narrow fair report circumstance. Republication of a libel creates another libel.

The Gibson trilogy was pretty good. I never understood why he has gotten so much attention as a writer. Maybe because he wrote books about the internet when the internet was just being born. What I really love about Wingrove is the level of detail and character development. Short books often leave me wanting more and if I just coughed up $7-9 I feel a little ripped. A good writer leaves you wanting more so I usually pick up the shorter books second-hand.

the problem with some multi-volume books is if the auther intended for that to happen. I think you are correct that often, the author writes a good book and the publisher wants more of the same for quick-easy sales.

I think the basic idea of any system is to make it difficult for an "honest" person to steal. Even though ebook was cracked, once this sort of thing will be less commonplace when it widely used. The few ebook hackers will get busted and people will weigh getting a well formatted document for $2.00 against getting busted for copying difficult to read text.

The PHP method is nice because writing the program would be simple (PDF,XML and encryption support built in) and implementing it on a shared server very simple since its just another PHP script.

Ebooks in general aren't going to kill real paperbooks anyhow IMHO because they have yet to solve the problem of reading in the bathtub.

  9. Hack a PHP/PDF solution on Publishing-Online or "Dead Tree" Format? · · Score: 2

PDF files are pretty much platform indedendent. A possible solution would be to use PHP to output the document in PDF format with the user's information encrypted into the file. That way illegal copies/redistributions could be tracked to their source. The licencing terms for the book could provide liability against abusers and you could warn then before they download about the possibility of being busted this way.

OpenEbook is trying to set a standard for publishing documents across multiple platforms. Though it wong prevent copying/redistribution it may allow the document to be read actoss multiple platforms.

PGP may be a security method. Once you decide on a easily distributible format you need a method of having an unlock key for only people who pay.

I stumbled across Wingrove's Chung Kuo serveal years ago and have found this series (up to book 8 I think) to be one of the best I have ever read (Bio of a Space Tyrant and Mission Earth being a few others).

Each book has a myriad of characters who each have unique personalities. The concept behind the books is entirely plausable. In the near future China becomes the dominant power in the world and in an effort to save humanity from overpopulation two strategies are devised. The first is populating nearby planets and the other, China's solution, is to build huge continent size cities with mant levels to each city. The space program is shot down by China so humanity if forced to live in these huge cities where there is a caste system roughly coresponding to what floor of the city you live on. From royalty living on the upper levels down to "clay" people living in the dark beneath the city off the refuse that works its way down. The plot is so intriguing with so many twists that even after eight novels I'm chomping at the bit for the next one.

David Wingrove has also written several book adaptations based on the Myst game. Not bad books, but they seem to suffer a little from the constraints of the writer having to follow what has/is happening in the Myst/Riven saga.
