Lessig quoted Rosen as saying her goalis to guarantee that no venture capitalist invests money in new modes of distribution unless Hollywood signs off. But I can't find that in the interview that was linked.

Just ask Arthur C. Clarke if he's owed any money by ComSat. But Comsat didn't patent geo-synchronous satellites. IIRC the waterbed was ruled to be non-patentable because RAH had described it in one of his books.

We do not need wireless access Unless, of course, you live in an area without wired access. If you live on the wrong side of the freeway in some areas it can cost thousands of dollars to get a phone line strung just 1/2 mile (1 kilometer). If cell phones are available there they are a much less costly solution. I know, different type of wireless, but it needs to be discussed, maybe I'll post it to K5.
These are 'live' concerns. Here in NoVa there are quite a few execs, and newspaper reporters, who read slashdot. This concern is one that many people in the industry have. Good post and good responses. These security concerns are ones we need to address. Many suits think that open source is less secure. Or, at least, that there is less opportunity to sue a vendor if a security flaw exposes vital data. Of course, the effects of UCITA needs to be explained to the suits. But WITHOUT flames. For the effect of flames on suits, and reporters, ask Jerry Pournelle why he (and many others) gave up on reporting on Apple.

That other $5 is for recouping the costs of dealing with pirates. In The Hacker Crackdown Bruce Sterling mentions the costs of credit card fraud in higher credit card fees. Certainly the people who figure out how to crack the DirecTV system are hackers. The rest of the people using those hacks, probably the 98% who lost their cards, are just script kiddies. I respect the hackers, have only disdain for the kiddies.
Even if DoJ withdraws from the suit, there are still 20+ states in it. Just because the feds withdraw doesn't mean they will. And I doubt they will. Not without being hugely bought off by the fed govt.
Is that the mice that were infected had a 100% mortality rate. Even the ones that were vaccinated had a 50% mortality rate. Wish I could remember where I saw the article that gave those figures. It also had quotes from the researchers. They were not intending to create what they did, and were leery about releasing the results, for fear that it would give terrorists ideas. Imagine a disease that is 100% lethal and spread via airborne infection.
