Reading the FAQ at qwest, they refer to an Operating System Input form. You need to be a qwest subscriber to see it, of course.
I'm not.
They do mention Mac's in the FAQ, but no other OS's (there are other OS's?). What choices are provided in the form? Could you prevent the change from occuring if you choose something like Linux?
(2) the term "protected computer" means a computer
(A) exclusively for the use of a financial institution or the United States Government, or, in the case of a computer not exclusively for such use, used by or for a financial institution or the United States Government and the conduct constituting the offense affects that use by or for the financial institution or the Government; or
(B) which is used in interstate or foreign commerce or communications;
Part (A) looks ok from a terrorist definition point of view. But part (B) means that cracking Amazon is terrorism. Or could be. I haven't found anything in this that limits prosecutorial discretion. Yet.
And for the record, not all of the sections defined as computer crimes are defined as terrorist acts. Just 1030(a)(1), (a)(4), (a)(5)(A), or (a)(7)
above.net is not firewalling. They are deliberately misrepresenting to other routers what traffic they will route. They claim, via BGP, to have the best route to sites they want to blackhole. Packets they find undesireable are then sucked into the blackhole. Hence the name.
Fraud comes to mind as a possible charge.
Under these, no one is being denied reasonable access to the SBCCI codes that have been adopted in globo by local governments; neither did Veeck's specific actions make a sufficiently strong case for fair use. Even slightly different facts under different circumstances might produce a different result.
It would seem that if you can not get access to the law at all, and remember Veeck did, the situation would be substantially different.
