If eToys indeed withdraw its complaint against etoy, I'll shut my protest site down. I won't until it's duly confirmed. So go visit it while supply last!
I understand that there are agreements on such issues between countries, however, I can imagine that they must include provisions for fairness of trials. And how can it be fair when the suing party files the suit in California, for example, and the defending party is in Austria? Besides, in criminal cases, I know that most countries won't extrade (sp?) the convict if he's a national.
It's odd you should comment thusly, as I had exactly this in mind when I wrote "the boston globe titled". I've worked for newspapers, and actually used to manage a student magazine, so I'm aware of the editorial process... I was actually responsible myself for that kind of eye catching bullshit.
If you read the information provided on BlackLight Power's website you'd see that the tests were carried out for validation at several other sites. It looks like the larger scale "water-bath" calorimetry tests weren't all that succesful.

eToys bought the trademark from Etna Toys, which had filed for it in 1990. HOWEVER the trademark office had originally DENIED etoys the transfer, for reasons nobody know. They then applied for the trademark later, in 1999 i think.
Amazon is sueing B&N, the largest company of its type in the US; it's not like they're going after the little guy.
B&N has plenty of means to defend themselves... trust them on this one.
There are much more important things WRT corporate bullying... namely, eToys vs. etoy.com.
