Obscene ( and other ) materials don't get grandfathered in when the laws are changed.
If they 'move the bar' then existing materials may just become illegal. ( not saying that is the case here, but just because it was distributed in the past doesn't mean it can now )
Not saying some weren't 'regular IP infringement' ( i wont use the marketing term 'piracy' ) i personally know a lot of people that own a copy did it due to the DRM

The real issue here is the free gift, bribery. Not the choice between zune and ipod.

Perhaps he doesn't have direct control, but slow steering of the ship via blackmail ( WTO ) has to start somewhere.
