I'm not sure what you are talking about - I work for Cingular Tier II tech support in Ashland, and we do indeed unlock phones if 2 conditions are met:
1.The phone was bought from Cingular and is on a Cingular account.
and either one of the following 2 conditions-
2a: The phone was purchased at full price (and you have the receipt to prove it)
2b: You have had the service for 3 months and have international roaming provisioned on your account.
That's it - call customer service and they will submit an unlock request for your IMEI. If the CSR you talk to doesn't know what you are talking about, tell them to check CSP (our help file database, basically). The unlock code will be emailed to you within 5-7 business days.
Here's the most outrageous quote in the whole mess:
"It seems like the only difference between Nintendo and the other consoles is that Nintendo is apt to lie about their intentions, whereas Sony and Microsoft give you what you want and lots of it."
3. The "surprise" of a new console this quickly will be hype enough. Think about it. How blown away would people be if this were true? It will generate its own hype. Especially if the tech is good.
Actually, Sega tried this with their saturn, in order to beat the Playstation to market, and that backfired badly, with not nearly enough release titles to compete.
They sure do. At the Barne and Noble bookstore where I work (Cincinnati), we have probably 300 - 400 volumes in the Graphic Novels section, although only about half of those are Manga. The rest are collected works from Marvel, DC, etc.

If implanting viruses into file-sharing networks was considered a way to protect the digital rights of content owners, would that make anti-virus software illegal circumvention? Or just the relevant updates to that software?

I was recently a manager at Barnes & Nobles, and they do *not* sell any customer information. To anybody.
There are also absolutely no unauthorized mailings, phone calls, or email.
They realize that happy customers are essential in the retail book business, and try their hardest not to piss them off.
