Company A buys software. Company A later goes bankrupt and sells off assets. The software and license can be considered assets, and should be transferred to Company B regardless of what Software Company X has to say about it. Company B is assuming all assets of Company A, and therefore should retain the licensing.
This situation isn't exactly as you've described above. Here we have Company A buying the licences from Company X. Down the road they run into a little trouble (Chapter 11). They need to come up with some cash, so the propose splitting into Company A-prime, and A-minor; selling A-minor to Company B. Company A-prime still exists (and still owns the non-transferrable licences).
I hate to say it, but I can see Microsoft's beef with this arrangement. After all, Company A was dumbe enough to sign the licence agreement.
What ever happed to the likely to cause confusion part of the trademark laws.
I see the problem if Davezilla or Mozilla were making cheesy monster movies, but in a totally unrelated industry, what's the complaint?
...not somthing you can drive down to and pick up from your local walmart. have you ever seen a PC for sale in a retail walmart store? i sure haven't.
You must not be looking. I was there yesterday, and they had an entire row in their electrinics Dept. Didn't look at the specs, so I don't know about the OS. If you really want to se a lot of PCs at Wal-Mart, thst wait 'till next month. They'll have them stacked to the celing when the start hyping "Back to School."
Ebay isn't necessarilly fronting any money for the seller's health insurance. In fact I see this as more of a marketing agreement.
Ebay to Insurance company: "We have the names and addresses of 80,000+ people that spend so much time on our site, they probably don't have a real job or benefits."
Insurance Company to Ebay: "Cool. We'll call them a group and give you 5% of the premiums that they pay for the first 5 years"
is there any actual use for this? Id rather buy a drive that burns faster than one that prints images on my CDs.
Actually, Capacity is my biggest concern. How much data space does one of these images consume. I'd rather have 650 MB of my MP3s on a disk than have 300 MB and a cool picture.
600 MB and a cool picture...That might get me interested.
I think so. Online EA sports titles are my killer app. You won't find me buying a console that won't let me play Madden Football Online.
I'm sure there are others like me. Maybe even enough to knock MS out of the lead (if they were there to begin with).
Most cable systems don't do much with a la carte pricing. Most likely this channel will be part of the Cable operator's "Digital Package." It remains to be seen if they will use the new channel as an excuse for raising the price of the package.
This is true, but my problem is that Verisign't main product is supposed to be Trust. This isn't something that a company that I trust would do. Of course, I don't think that I really trust any company.
There have been a large number of Spam stories in the media this week. What's the deal? Mayby the politicians will start to see that this is something that matters to John Q. Public.
Of course, mayby pigs will fly someday.
Before reading this, I had considerd Virtumundo a "Responsible Spammer" (I know probably an oxymoron). The only place I've ever recived email from them is an address specifficaly set up for them, and each of the emails that I got indicated it was sent because I was on the irtumundo mailing list. The fact that they admit that they would buy a mailing list just made me loose all respect for them.
This whole situation sousds a lot like Morpheus escaping a burning building. Kaazaa has got to be on their last leg. All of the back-office wheeling and dealing can mean only one thing. They're desperate. Either the courst are about to shut them down, or thay are running out of money. Either way. the FastTrack software is about to collapse. Morpheus did the right thing by seperating themselves from that whole mess. If they didn't pay thier bills...It jsut tells me that they saw this coming for a while.
Why woud I by something on eBay, whe I can get it at Wal-Mart for a few bucks? Even if they're five bucks, I'm going for the instant gratification of the store; not send sombody five bucks, and hope I get my movie in a couple of weeks.
Not that I think that the Patent is anything but rediculous.

It's obvious, the one with the best lawyers (or most money, but I think that will usually be the same company).
If the AV vendors are going to be able to keep any credibility that they have left, they are going to have to detect and block this type of software.
This of course begs the question: Should ISP be considered common carriers?

There goes my idea for Godzilla Demolition, Inc.
Yeah, but the way I remember it, the gum might have been more expensive.

Next Step. Big announcement.

M$ is already trying that, and losing.

A copy of your own comments on your own webpage. Fine.
The individuals that comment are giving OSDN a license to publish the comments on /. .
It's just one more reason to remind everybody: Make sure your software is Patched, and up-to-date
That goes for all sides of the fence.

This product sounds like it could be fun, but does anybody really want to use their wall/window/desk to produce sound on a full-time basis?
Umm... doesn't
170^2 = 170*170
???
Apple isn't going to be too happy about this after they've spent millions developing the iWalk. Look for the DMCA Police to come knocking.

How do you mark a sound wave as copyrighted?
