I'm in particular thinking of the wonderful cooperative organisations in Italy that eventaully became the Mafia, and of the wonderful cooperative organisations in Ireland that eventually became the IRA (though the evolution was a longer one in that case).

There's a more obvious answer - just rewrite the bits that are IP violating. Believe it or not there are loads of linux hackers who could probably rewrite the contentious bits in a matter of days.
When that happens, Linux suddenly becomes legal again. You can't taint new linux with the (alleged) faults of old linux. Then again, I beleive the SCO suit has no teeth anyway.

I think Cringely is just going for the attention, and we've given it too him. Look at the prediction "it will either get bigger or smaller". What kind of prediction is that?

That's surely just plain common sense, they have utterly failed to provide the service for which he paid - that is in part to maintain his (virtual) property. By their own admission (D'Oh!) his virtual property had absolutely no value to them, and was nothing more than fields in a database. For them to want to fight over /that/ was pathetic.

    Absolutely the right decision.

Alas it won't send any message anywhere. China has a completely different legal system (mostly without precedent), and the US/UK will almost certainly pay no attention to results like this, which is no precendent in their respective systems.

Nowadays, those who think that they own the language insist that if you try to put copyright material into the public domain then you're contradicting yourself. Everyone unquestioningly seems to believe them by rote. However, if you take 'public' to mean 'public', and 'domain' to mean 'domain', and thus 'public domain' to mean the 'domain of the public', then there's no contradiction.
