I believe the issue is Lik Sang selling the mod chip. I don't believe that microsoft can do a thing to you for moding your XBox. They can go after you for moding your XBox and then doing something illegal with it.
This is no different than the decoder chips used in the early days of subscription TV. It was/is illegal to sell the chip. You could/can mod your box for the reception. You couldn't/can't use the illegal mod to recieve the broadcast.
