No the case IS dismissed, but the judge is allowing SCO 30 days to amend the complaint and refile. This is the meaning of the phrase "without prejuduce".
But they can't just walk away from this, either, because the motion to remand was denied because the case involves federal copyright laws, which basically means that the ownership of the copyrights are in question. With the excpetion of the DC case, ownership of the copyrights is the threshold issue, or at least the first threshold issue. If Novell holds the copyrights, SCO loses the AZ case, most of the IBM case, and probbably the Red Hat case.
If SCO is able to prove that they own the copyrights*, it doesn't mean they automatically win the other cases. They still have to prove that Linux infringes on their copyright. They've signaled that they plan to use a unique interpretation of derivative works to prove this, rather than actually indicating the SysV code in Linux (because it's not there).
The upshot of this is that it's pretty safe to predict that SCO will lose. Just don't expect a quick victory. This is the legal system, after all.
Keep in mind that a lot hinges on SCO v. Novell. If Novel is able to prove that they hold the copyrights in question, the case against AZ crumbles, Red Hat's case is strengthened, and much of the case against IBM evaporates.
I played with it for a week quite a while ago, and it does work, albeit crudely. It could be useful for the "I don't have fingers, you insensitive clod" crowd.
Yes, exactly. Why give SCO additional excuses to ask for delays? Why do something that is basically immature and retaliatory? Why sink to the level of your opponent, when your opponent has already tried such tactics, and didn't get away with it? Why make yourself look bad to the judge, when up to now you've been impeccably professional?
IBM really doesn't need to resort to this sort of thing. All indications are that they have a strong case while Caldera does not.
Except when there's weather. Let's see how well you take the corners when it's raining. Your chances of crashing are much greater, even if you are very skilled. It's not all about raw speed. Ever hear of traction?
How much of a load can you carry on your Kawa? One passenger? Lunch? A bedroll? At what point does the load severely affect the balance of the bike, making it more likely you'll crash in extreme situations?
Still, for pure pleasure, take the bike.

I just love it when our Canadian cousins "winge" at their mistreatment at the hands of brutal Americans. Canada would be a lot better off if Quebec were granted independence, and we put the rest of the Canucks into concentration camps. Then we could get at those natural resources that are rightfully ours.
To the South we've got the Mexicans. I heartily support the idea of giving them back Texas. Let the Bushes go to D.F. when they want to rape a nation. On the othe rhand, the Mexicans probably won't want the Tejanos, so we can ship them up to the now vacant lands of Canada, where they'll be happy shooting game and playing their damned polka music.
In a few hundred years, the Tejanos will have multiplied, and with legends of their southern homeland in their hearts, will sweep South, until they control everything from Elesmere Island to Tierra del Fuego. No doubt they'll allow Montreal to remain a free city; Prussians love a good French whorehouse.
There is nothing wrong with homosexuality, but I'll be damned if I take it up the ass from GB & Co. for another 4 years. You might like it that way, but for many of us, it's rape.
The Sonnet Crescendo/PCI G4/700MHz with 1MB 3.5:1 L3 Cache goes for around $260. Maybe you could buy a new PC for that amount of money, but the sad fact is that it would still be a PC.
Apple certianly is a company that can claim many innovations but the MOTHERBOARD isn't one of them. They don't even build them (Foxconn does) and have very little to say in their design. Most of it is simply dictated by what they want on it. You want 8 memory slots and 64-bit PCI slots? Ok, that is going to take a certian amount of traces and a certian amount of space to do.
You forgot that the layout of the board has to be pretty, because Steve says so. PC Board Esthetics
Although much light is made of the plethora of 12 step groups, the story you relate is a good illustration of just how bad undaignosed mental illness can be. Your friend has/had obsessive-compulsive disorder, which I believe is a major component of alcoholism and drug addiction.
Therapy, medications, and the aforementioned 12 step groups can all help. The important thing is getting help. And to get help, one needs to admit they have a problem.
No, you still don't get it. Even if she is second place, you don't want to make her feel like she is second place. You don't want to ruin your relationship with honesty and communication.
This is the tip of the iceberg. Think about all the IP theft that has occured in the days before computers. All those so called "authors", stealing intellectual property from the paper companies and the pencil industry. We need congressional hearings to investigate this abuse, which continues unabated to this day.
Last time I checked, Linus was wetware, not software. Although that's another metaphysical discussion.
I'm merely pointing out that you cannot escape political acts. You use Free Software, and you are acting politically, whatever your intention. You choose to use proprietary software, you are acting politically, whatever your intention.
Even eschewing politics, choosing to be apolitical, is political.
The toothfairy and the Easter Bunny were writing the papers, and Shoen was plagarizing.

You're forgetting something. IBM has counterclaims against SCO involving GPL.
Besides, the case at hand is SCO v. Novell. The ruling does impact the IBM case.
The rats have been shorting SCOX for months now.
Dude, you smell like Ken Brown climbed up your ass and died.
Why were you screaming? Was someone giving you a blumpkin?
And, seriously, what is a "strawberry shortcake"? or a "Nasty Sanchez"?

They can be kept secret through a protective order by the judge and these records sealed after the trial.

See you in July.
Leave the stickers on. They're not going to hurt anything, and may help down the line if you need to return the memory to the vendor.
So in other words, you don't know dick.
Sorry. I have poor impulse control.

When they do, and you compile it, distribute a little my way, ok?
