Where do you get that I'm an American hater? I know of a lot of decent Americans but you are not one of them.
"I will not develop any code with this license. Period. I stated exactly why, and some specific objections as to why this would not hold up in U.S. courts. I didn't say about what other countries might do with this license, but I would suspect that the net result is pretty much the same."
I don't think you understand. This license is for developers in france to protect them from liability laws in France while maintaining GPL compatibility. This license is only applicable within the borders of France, any software released with it will be under GPL. Any users of software released under this license will be bound by the GPL if they are reside outside of France. Comprende?
Did you fail reading comprehension? English is my second language but I seem to have a better grasp of comprehension of the english language for some reason.
I don't hate all Americans, only those who lack proper reading comprehension skills and come across as arrogant.
If you still don't get it. Let me spell it out for you. This license is not applicable to you or me since we are both not citizens or residence of France. The GPL would apply to us for any software licensed under this license by a french individual or organization. Go back to school.
I have never seen a more arrogant US centric and ill-informed post on./ in my life.
RMS has stated publicly that this license in compatible with GPL. The changes you see are there to protect developers from liability as there is no way to provide immunity from liabilty under french law through a disclaimer. Therefore, reasonable conditions for limiting liability must be provided in the licence wording.
If the licence states that it may be superceded by the GPL, this provision is to cover distribution of the product outside of french jursidiction where the GPL may be applicable and enforceable.
"Well, I gave an argument why I believe that the licenses are incompatible -- the GPL says no further restrictions and this license makes a further restriction. I would still be interested in understanding why you think this argument is wrong?"
It is not making any further restrictions because this license is not an extension of GPL but rather a licence that corresponds to the GPL under french law. The restrictions are in place to protect the developer due to differences on the limit of liability under french law as opposed to US law.
I still feel you are making a value judgement based on a US bias. This is a replacement for the GPL under french law and GPL is not a valid licence in that country.
GPL is based on US law. The current GPL is incompatible with french law.
The inconsistencies you are seeing are the result of each licence complying with the norms of copyright law in their respective jurisdictions. You cannot expect GPL to impose US copyright law on other jurisdictions.
I believe that these two licences are still compatible.
In case you have not noticed, this planet is still composed of separate soveriegn nations which have not as of yet been assimilated into the US.
Sorry but how are you increasing your value as a person but stealing jobs away from other people? You already have a job.
If you have a lot of "free" time on your hands why not:
-volunteer at a local charity
-become a big brother.
-volunteer with an international agency
All of the above are altruistic pursuits. While open source development only serves to inflate your ego.
You may think you are doing a good thing but companies which can afford to buy application software would buy software as a matter of regular business and treat it as a business expense.
If you create Application software which replaces software produced by smaller companies as closed source, you eliminate the following jobs: programmer, various support staff at the company, executives, advertising jobs, sales clerks, delivery/shipping jobs as well as all of the trickle down jobs in the community.
Oh and that non-software company that saves money with open source will most likely will not buy support from you and the principles will pocket the money instead of creating even Mc Jobs to support it.
Remember that charity idea? Most single parent families cannot afford any kind of computer so the most vulnerable in society will not gain any benefit from your largess but only the rich. Then there are the street people.
Why not contribute to society instead of contributing to its problems by putting more people on the street?
Go ahead and mod me down but you will only serve to reenforce the view that america is heartless when it comes to the poor.
*Whoosh* - the sound of what I said going over your head.
I happen to be an inhouse developer. Please don't talk down to me. Many open source projects may claim to be meritocracies but there is a lot of ego driven decision making and brown nosing going around.
I was not talking about Open source projects involving infrastructure such as Apache or mysql but rather application and utility development which I feel should remain in the hands of closed source developers who bother to hire usability experts to make user friendly interfaces and help to de-scope unneeded features which clutter up the interface. Most open source application software is a pain to use and quite uninspired as they try to emulate MS Office to closely.
Open source has it's place in fighting entrenchment of proprietary infrastructure and closed standards but fighting against Microsoft's competitors on the application front only solidifies the position of MS on the desktop.
You want to use Gimp or Open Office? Fine but don't discourage closed source developers from writing software for linux.
PS. I'm quite proud of the fact that I work for a private company that receives no hand outs from other companies.
Did you play for that set top dvd player you are using in your living room? Did you pay for your computer or did you get it for free because you bought some software?
DVD set top player manufacturers play fees to licence holders for things like DVD decryption, Dolby and DTS decoding, Mpeg2 decoding etc...
You are not going to pay twice over, you only pay once per device that you want to watch DVDs on. Paying that license is like buying a virtual DVD set top box player for your computer. Get it yet? Your "DVD-ROM" drive does not entitle you to play DVD "VIDEO".
For crying out loud. Not every programmer out there has another job or in-house development to pay the bills with. How do you expect people to earn a living to put food on the table? Donations? ROFLMAO!
Waah, I want free software. Waah, I want the source code. Waah, Apple hardware is too and I want to build my own from substandard parts someone threw away.
If you don't have money, get a real job son.
Don't get me wrong, Open Source is good is a good thing but you should pay for your codecs like everyone else does. Reverse engineering codecs/encryption methods without paying royalties is just as bad as software piracy. Commercial software will be key to the success of linux on the desktop and those that stand in the way of it are only helping MS keep their hold on the market.
I don't know if these people complaining are rich kids with trust funds who have never worked a day in their life or pizza delivery guys who are bitter because they could not afford college. I grew up poor and I had to work hard to get where I am today.
U was not suggestung that it was. Unix (tm) certification means a lot less these days anyways. Besides, OSX follows the BSD (unix) standard which will not officially a Unix (tm) it offers source compatibilty.
Responders are free to include either a commercially supported unix/linux or Windows XP Pro with cygwin pre-installed.
How much does a 3.6 P4 cost? Does is do SMP? No. If you want to compare low end, fine, compare against the eMac at 799 for a combodrive or 999 for a 8X DVD-R/RW model with 80GB Ultra ATA drive. Make sure to include two firewire 400 ports and atleast two USB 2.0 ports + a high quality 17" CRT.
If you want to compare high end, atleast use an SMP aware 64bit CPU. capable. None of this P4 or Celeron crap.
Be sure to include a similar DVD burner, similar ram, a motherboard capable of PCI-X and 8X AGP, One FireWire 800 port, two FireWire 400 ports (one on front); three USB 2.0 ports (one on front), a keyboard with USB 1.1 hub, Optical mouse, 10/100/1000BASE-T Ethernet and 56K V.92 modem, Audio card with Optical in and out, 80GB or 160GB Serial ATA; 7200 rpm
and software equivalent to the following:
iLife (includes iTunes, iPhoto, iMovie, iDVD and GarageBand), Art Directors Toolkit, EarthLink TotalAccess 2004, GraphicConverter, OmniGraffle, OmniOutliner, QuickBooks for Mac New User Edition, Zinio Reader, Mail, iChat AV, Safari, Sherlock, Address Book, QuickTime, iSync, iCal, DVD Player, Xcode Developer Tools
Also be sure to include a commercial unix with your hardware like Solaris.
People named smith are probably in your family? Do you know how common "Smith" is? So you want all the spam from John Smith to go into your family folder?
The parent has a point with regard to USB 2.0. You did not say if you were using it or not but based on you symptoms, it sounds likely. USB 2 is a piece of crap. It is host based as opposed to host-less firewire and it eats up your CPU like nothing else.
Those speeds often touted are burst rather than sustained and it has been proven time and time again that firewire has a faster sustained transfer rate and it won't mess with your CPU either.
Umm.. what does the DC stand for in WWDC? Did you miss the guitar amp software demo which relies on low latency audio services provided by Core Audio? Did you miss the release of Core Image and Core Video which are built on tech from the soon to be released Motion? Those two knew Core services are really exciting to developers.
Damn ungrateful end users always expecting flashy crap to get them excited. Why do you have a copy of the developer preview anyway? You don't sound like a developer to me.
Cool, so where is Core image, Core Video and Core Audio (low latency audio support) in Longhorn?
If you are looking for flashy garish gfx, go with longhorn. If you are looking for an OS that provides easy to program against power API's look at Tiger. Did you see the guitar amp demo in the keynote? That is done with Core Audio. Now try to imagine what will be possible with Core Image and Core Video.
Cheaper hardware? Let's see, Tiger will work on today's machines whereas Longhorn is targeting nonexistent hardware. There will be no 4-6 Ghz chips coming out of Intel any time soon.
That's nice but I already got "free as in beer" MP3/ACC/Apple Lossless (based on LPAC) encoders with my mac in Quicktime and now I have the "freedom" to encode any CD I own or any song I create in those formats to my heart's content.
I've got a hint for you, freedom is never "free as in beer". Someone either had to pay or die for it.
Um.. If it can survive a ride on a paint mixer, I think it will do just fine on a ski hill. If they were not appropriate for snow boarding, why is there a snow boarder jacket with an iPod pocket and built in controller on the sleave for sale on apple's site?

No, I'm not some rich college boy born with a silver spoon up my ass. Did you go to college Richy Rich?

FYI. Distributing Mplayer with codecs that violate patents/copyright violates the GPL in the US and many other countries.
You may have had some moral ground to stand on because there were no licensed players on linux before but not now.
Waah, I want free software. Waah, I want the source code. Waah, Apple hardware is too and I want to build my own from substandard parts someone threw away.
