    To prove fair use there are several factors that have to be taken into account, this is just one of them. Also, you can only reproduce a portion of a copyrighted work if it doesn't contain "the essence" of the work. If the entire song is transmitted then somebody would have to transmit "the essence."

    How do you feel about the anti-circumvention provisions in the DMCA, specifically how they apply to non-copyrighted or public domain materials. It seems to me that this clause has granted corporations an unlimited copyright on any material they publish. This is not only unfair to the consumer, but unconstitutional. IANAL, but you are, so what is your opinion?

    Followup to that question... In general what does the pulic gain by the current state of "Intellectual Property" rights? IP rights are supposed to balance protection of authors with certain advantages gained by the consumer. i.e. the ideas from a book are public domain, patented ideas are pubished for everyone to see. The trend in IP, especially when it comes to music, seems to be headed towards a pay-per-view kind of system. From my point of view I see no advantage to the consumer here and feel that rights are being unfairly distributed to corporations.

    Did you read my paper? During the time that record sales have declined CD prices have gone up and the number of new releases have gone down. There are references to these statistics in the bibliography (some of which are off the RIAA's website).

    True... Partly... the problem is the record companies see that they are no longer needed. Their main function was to act as a source of loans and to distribute music. Recording music is no longer expensive, and distribution can be done over the internet. Who needs record companies anymore?

    I thought a big part of the RIAA's argument is that the labels have to underwrite the promotion and some of the costs for the tours...

    From what I have read this is not true. Most record contracts state that all/most costs related to marketing and distribution will be recouped from the artists cut of the CD sales, not the record companie's. Of course this means if the record doesn't sell well the record company doesn't get all that money back through the artist's cut... But it also means the artist will get nearly nothing.

    I wrote a paper for school on how I morally justify downloading mp3s which outlines the way most record contracts work.

    looks to me like the "FreeBSD Project" admitted it.

    It's a bit different. FreeBSD is stating outright that this is not *AS* stable as 4.8-STABLE. I'm sure it is a much more stable OS than anything MS has to offer. They are merely stating that they are still working out kinks in the software and are warning people before hand not to be surprised if an issue arises. When was the last time MS released an OS upgrade and said "well, this OS isn't as stable as the last one, but we will release some service packs in a few month and those who are running mission critical applications should wait until these are released before upgrading."

    The U.S. maybe... Japan, no way. In the U.S. I believe the way it works is the government essentially has to allow you to sue it. You can sue the government if they break a policy (i.e. a sign for road construction is supposed to be 500 feet away, it was only 400 feet, you got in an accident). But you can't sue them if they abide by policy and you still get fucked (i.e. policy says 400 feet, it was 400 feet, you think it should be 500 feet).

    Probably not nearly as much because the MS SQL servers are nearly as expensive to license as Oracle, and they would still have to get relatively large mainframe computers to run them. They wouldnt be able to get away with desktops IMHO.

    It doesn't say in the article that they have been running windows in the past. Just that Microsoft wanted them to use it. Maybe they are already running some *nix variation and already have a knowledgable staff, mass layoffs and new hires would probably cost as much the added expense of nix admins... at least for the short term.

    If you define it like this of course people won't understand it! If one of the options was "the measure of the speed of a computers CPU" I bet results would have been very different. If you tell someone that a computer is 800Mhz they might understand but might not be able to define the term, just as if you tell someone your car is 500HP they might understand that is powerful, but would not be able to define horsepower as a physics professor would.

    Yes, but I lived in a college dorm all last year. There isn't much privacy. Ocassionally I would see my friend who lived across the hall load up CS or MOHAA and play for an hour or so, then he'd come over, have a beer, and talk about the girl he screwed at the party the night before, etc. :P (or ocassionally study). My point is just the obvious one that MOST people who play these games DON'T play them constantly. They play them to relax/have fun/enjoy themselves after a long day or on a boreing rainy sunday.

    Actually a lot of people I know are occasional gamers. They arent obsessed with them and associate with "normal" people... The problem is when you become addicted and sit in front of your computer all day.

    Microsoft says they are "betting the company" every time they come out with a new technology. The last article I read on longhorn they said they were betting the company on the new filesystem (which, IMHO is just an attempt at integrating MS SQL to squash some more competition).
