I also agree that on murder it is not the same, death penalty and lifetime sentences have probably few effect in murder statistics since only a fraction of the murderers would think about the "fine/penalty" for it.
However look at this link experiment. It shows how people replaced an incentive by another one.
The difference is only moral, if you replace murder by illegal parking and prison by fine, you can admit that the amount of the fine is what will mostly determine the number of offenders.

Though, I would be totally fine with a prison sentence... and of course, I would be also totally fine with this decision if the army can bring proofs that he misused this information.
