The problem is that any non-technical user is going ask what buttons they need to press to get the website to work, and will then press them blindly no matter what.

I think this is a problem with the ARM architecture rather than with Android. To update the OS, you need to flash the ROM, and you need to flash the entire ROM in one go, not just replace a few files on the hard drive like you do on intel based machines.

It certainly isn't mainstream in the desktop market, that is for sure, but in the embedded market, such as TVs, wifi routers, network hard drives and so on, linux has quite a high market share. Also in the server market, apart from the niche sectors occupied by Small Business Server, Exchange and Sharepoint, linux is pretty strong. In the high performance computing market, there is very little else apart from linux.
The problem is firstly that the app probably wasn't advertised as being a "pirated" copy, and secondly, if it was placed there by the copyright owner, the legal fact of the matter is that it is not "pirated".
