I don't think you can compare the two. Microsoft maintains its leadership by anti-competitive methods (ok, their lawyers' opinion notwithstanding) whereas Dell just does a good job at marketing.
There is that nothing Dell that anyone can not do. They've just figured out the process so damn well!

Yahoo was all about inter-operability a couple of years ago, when they were trying to convince AOL to do it, but now I guess they won't accept their own arguments.
You are right in the sense it is a threat and it is ridiculous, however - I will repeat the point made by others - this piece of information will definitely allow them to more effectively argue one knew what his/she was doing..
Another thing makes me curious about this, personally. If RIAA or somebody like them were to investigate Freenets or "Darknets", how would this change the subpoena process itself? Wouldn't it be much harder to get one?
