    Its petty Palm is in trouble but at least some good is emerging from the MS antitrust case. If it hadn't been for that MS would be able to buy Palm for $3B+- and get rid of this nasty competitor. IBM is selling a fair amount of Palm under their own brand name, maybe they would be interested in aquiring Palm?

    The theoretical problem is that Fairness is seen from the buyers perspective however rationel the pricing looks to the seller. Humans have an inate sense of fairness. As social beings we have been selected for that as a mean to better survive in a group setting. Dynamic pricing goes against this fairness sense and we consequently finds this appaling. Professor Rabin recently won the MacArthur price (same as Stallman won earlier) for incorporating this Fairness sense into modern economic theory.

    I think this boils down to Mundie stating that you can't get rich selling GPL'ed Software. That might be true but the flip side is that you can save a lot of money using it. Isn't that what RH's Bob Young has been saying all along. He has staed that Redhat will reduce the OS market by 80% in dollar terms.

    FYI, The ragging you are refering to was at one point called "The Cola War". Whole books were written on the subjects. Make a Google search and you will be surprised at retoric used at the time mid 80's if I remember.

People like to fiddle with this stuff once they know how to do the basics. In the old day while you waited to board an airplane you looked at your ticket 10 times just to kill the few minutes. Now you can fiddle with your cell phone instead, provided there is enough configurable stuff to fiddle with.

    Its wrong to rely on lawsuits and legal remedies that possible infringes on free speech to fight spam. Technology is the spam enabler and should be the spam disabler as well. At least I think so.

    It doesn't matter if you are guilty or innocent. You request the code as part of the discoveries. The court would probably order the code being kept confidential, but this is easely circumvented by leaking to the press that publish the stuff. The press is pretty well covered even if flaunting the courts rulings. Just ask President Clinton or rather Paula Jones.

    Innovations do not need to be earth shattering and the little neat things is probably what makes technology pleasant and interesting. Look at the list over at Sv.com. This is what Eazel have done in a year that neither Mac nor Windows has. This was problably put together as arguments against MicroSoft latest OpenSource hinders innovation but quite interesting in its own right.

    Hey You are wrong here. If you overclock by upping the bus speed the Graphics card, and mem bandwidth will increase as well. The network is almost always a bottleneck regardless of CPU. You can saturate a T1 with a 100mhz CPU. So that is not really an argument for OC or not.

    I am willing to bet at least a dollar that if MicroSoft stole GLP'ed code and used it it would end in court somehow. You only need one lawyer that decides to sue. Look at the silly Class action suits floating around against any company whos shares drops for whatever reason. They get sued because the lawyers gets a share of the awards. Same with GPL. The little companies can maybe get away with it but the big guys No Way.

    Interesting thought but it wouldn't work as you outline. 1. The software could be hosted on servers outside US and any download subject to the licensing of the hosting country. 2. Unless there is a clear intent to defraud. The damages awared has to relate to the money earned. Zero in this case.

Not to diminish the problem but we will find a technological solution to this technological problem. Ie a solution not dependent on direct human labour. Its like the phone companies in the early days projecting a limit to the numbers of phones as we would run out of "telephone operators". They were banting around projecting millions of people manning switchboards.

    The effort your are talking about was in Australia with different law covering licenses. The issue here is that German law specifically allow transfer of licenses regardless of the "text" under which it is granted. In this case MS.
