  1. Re:Before anyone says anything about free speech on EU Bans Sock-Puppet Blogs · · Score: 1

You shouldn't have been modded down. You are absolutely correct. The 1st amendment does not say Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of reasonable speech, or non-commercial speech. It simply states, "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech..." No law means NO law. But, in a land where a pre-nup can be broken so easily, why should I expect any more respect for the constitution? It sad that such a direct statement as the 1st amendment can be interpreted so loosely. It's even sadder that most people think it goes too far in protecting freedom and believe it should be heavily modified(if not completely repealed) to grant freedom only to those who agree with them. However, modifying it is preferable to the outright violations that are widely practiced now.

First, commercial speech is censored. Next, it will be political speech under the guise that it is "fraudulent". The original statement is correct. Either speech is free or it isn't, no matter what convenient label you want to put it under. It is the listener's responsibility to investigate whether it's fraudulent.

My point is that if Microsoft thinks piracy is so bad, then every copy of their software will come with a hardware dongle. And that right there will put them into a niche market. But they want the whole market. That requires allowing a few leaks in the pipe. Same goes for Adobe and Symantec. And of course they understand this perfectly well, which leads us to the current situation. To put it quite simply, these people cannot survive in a mass market without the bootleggers. This includes the entire entertainment industry, also. The big boys play both sides of the fence, while we wallow on about "morality" and "stealing", blah, blah, blah. And they exploit our indignation very successfully...to the point of creating the richest person in the whole wide world. Only through piracy(and other violations of the law) could something like this ever happen. In fact if you want to see them really suffer, call for an end to all illegal use of content. You can bet there will be a lot of bankrupcy going around. When you consider the power, one could bring down a significant portion of the entire law enforcement infrastructure to its knees simply by obeying every law. So many sources of revenue would completely dry up. It would indeed bring on an economic crisis.

That statement alone should show you why they won't attempt such a thing. You just have to look at Apple's market share to see the results of "perfect" DRM. DRM would not be a shot in the arm for Microsoft's business. It would be shooting themselves in the foot. It would cripple them.

It's worth repeating that the law is not designed to reflect right or wrong. And the evidence that bears that out speaks quite loudly. To find a solution, you need to be aware of the more basic motivations(more like instincts) behind these things. I can assure you that "protecting the children" is not one of them. It may have been at one time or another, but it was horribly perverted by profiteers. The very same kind that are getting rich from prohibition and war.

I'll cut you some slack and just say it's very symbiotic, or mutually parasitic. Either way, the profit motive is what drives it now. Most of our laws are intended to generate revenue(speed traps, prohibition,RICO, even the patriot act) and protect company profits(DMCA, IP law in general). You don't have to believe it, but I just follow the money. Yes, we have all these "nice" laws to protect the children, but it's real intent is to put a significant part of the population at a disadvantage, unable to achieve truly gainful employment, all for getting caught pissing in the alley. Real predators roam free while pot smokers languish. This would not happen if the intentions were authentic. The numbers show that they are not. You can focus on stated intent(spin). I will focus on the results.

Nowadays most people are demanding revenge, and they pay lots of money into the system to get it. And much of the time they get the wrong guy!
