    Oh I missed that - that he hadn't opted in... But if cruise.com can provide information about a list where he DID opt in, and where he agreed his information would be sold (truth is they probably just bought the list). I suppose this case will come down to how annoyed the judge is with the spam he/she receives ;)

    Yeah, but there's some holes that the courts will probably consider. Seems like the only way to get on their mailing list from their web site is to request a quote and opt-in.

    He opted in using their opt-in method.

    He should equally opt out using their opt-out method. The courts would (IMO) consider that a resonable request. He didn't attept to opt out, and instead provided them a list of everyone who'd like to opt out.

    Look, cruise.com isn't a V1agra or Pen1s size company. They sell a legitimate travel service. I don't think they deserve this.

    IMO he's bing a pain in the ass, and seeking personal gain from the CAN-SPAM act.

    IMO it's not that strong of a case for a countersuit. Mumma didn't act in good faith, and refused to provide his email address, but rather provide a list from www.optoutbydomain.com and said his email address was on that list.

    I actually think Mumma is in the wrong here, and that single fact will break him. I think the request that Mumma made was in fact unreasonable.

    cruise.com should walk away unscathed.

    I just read the transcript of the first phone conversation. There's a bit of a seedy part in there that he requested everyone from the list on www.optoutbydomain.com be removed from the mailing list.

    I kinda think his tactics are a bit questionable though. It was a reasonable request by the platif to request his email address in the first phone conversation, and Mumma refused to supply it, but rather provided a huge list off another web site.

    It's like putting a sign on your lawn requesting no soliciting for you or anyone else in your neighbourhood.

    I actually think you're right. cruise.com should come out of this unscathed.

    Take a look at how he communicated with them

    I think he made a reasonable effort (phoning them) to get himself removed off their mailing list.

    Well I know some places that still run MS-Dos. Does that mean we should support them too? Where do the vendors draw the line on the legacy support? They have to draw that line somewhere. It keeps us employed.

    Bitch all you like. These businesses will hire someone to update the document management app, or purchase one from Hummingbird or something.

    Or they won't, and will have to endure the cost of calling in folks like me and you to maintain PII's. Sooner or later they'll relize the cost to maintain is higher than the cost to upgrade. Soon enough they won't find any sysadmin who even remembers how to work with Win98.

    It's a good thing, and keeps us employed. I'd rather be employed upgrading systems, than be employed maintaining PII Win 98 machines. That's JMO though. There's some Fortran and COBOL developers out there worth a lot of money because they know it well and no one else does.

    Sorry, but hydro is not "infinitely renewable" as it is really just an expression of solar energy.

    No energy source is infinite, but as long as there's evaporation, condensation, and gravity, I don't think we'll run out of Hydro power.

    Me, I'd rather have a nuke plant without the waste.

    From what I've heard (I might be taking out my ass here), it doesn't take a lot of wind to keep these turbines spinning. They rely on centrifugal force to help them along. It takes a bit of energey to spin them up, but the centrifugal force keeps them going...

    I also recall reading tha today's turbines spin slow.

    Fascinating article. Not that I definitely buy into all of it. AFAIK, here, we probably try to log out the region before we flood it. No sense in leting trees die needlessly. Maybe Brazil never did that?

    Thing is, we can make better use of our resources. There is no reason why a farm shouldn't have wind turbines on it. It would supplement the farmer's income and maybe it would remove the farmer's reliance on marketing boards.

    Anything you can do to reduce your dependance on oil and gas is a positive move.

    If it was then the US govt wouldn't be investing so heavily in alternative energy research.

    No matter what we do there is an environmental impact. The key is to minimize it. It's sad, but we cannot eliminiate your environmental impact. We are a part of our enviornment after all.

    Given the alternatives, I'd take hydro and wind over coal and gas any day.

    Good? Here in BC we get 90% of our power from Hydro; a clean, infinitely renewable resouce.

    What makes Linux better is often they store config files as .application.config in your personal directory, meaning each user usually has their own configs for user-accessible programs. It's less "efficient" due to more clutter but more "efficient" due to increased customizability and less risk of one person screwing up the settings for the whole system.

    I call bullshit. Windows has "Documents and Settings"\\Application Settings\*

    That's where Firefox stores its user information.

    Remember, every time you see "hydrogen", it's a code word for "nuclear". ...being no good alternatives to nuclear.

    Truth is, there's many energy sources in this world that are infinite. Solar, Wind, Hydro and Tidal are not going to run out any time soon. True, we can't dam ever river up, and yes, some places aren't conducive to wind or solar energy, and only coastal communities work okay with tidal energy, but truth is, there are alternative electricity sources other than Nuclear, and to suggest otherwise is a straw man.
