AFAIK MS doesn't like GPL not Open Source. They use BSD code and it is Open Source (If I remember correctly). It's the legalities of GPL that mess them up.

This only applies if you are using it in public areas for business purposed. This is the same if a bar has a satellite subscription. The fees are different for private viewing and for public display or business purposes.

DirecPc in Canada is not 2 way yet. I just asked about it last week for a client that has no other alternatives and they told me that it's in the works but not abailable yet.
AFAIK the high speed here is with the download and it still requires AFAIK the high speed here is with the download and it still requires a dialup account but the download requests get routed through the satellite. Much like Direct PC does. Uploads are still dial-up speeds. I think this is news because it is 2 way. (Although I didn't see it mentioned anywhere.)

Honestly, I've used 2003 on similar configurations without any problems. Not to say that a bad update can't happen, I just haven't some across one recently. You can go to recovery console to troubleshoot the problem. I'm almost certain that some other 3rd party product is causing the problem, either hardware or software. You can also use SUS to approve software updates to the server (if you want it automated).

There needs to be a movement of some sorts.

May be difficult to install but users still find a way. The real difficult part is removing one.
