Courts are supposed to follow the law. At least as of now, there is no law that allows this. Not to say there won't be one in the future. Luckily we have a do nothing Congress at the moment so keep your fingers crossed.
Not really. Most federal taxes are withheld. The IRS just decides if you paid too much or owe. Most people manage their withholding so they get a refund. If the IRS shuts down the refunds aren't processed and the Fed getst plenty of money.

You are hard pressed to find a legal consumer good which is more regulated than firearms with regards to it's manufacture, sale, transport and use.
You are also hard pressed to find other consumer goods which are potentially that harmful to other people.
