    that's not true, my cousin has a very strong case against a former business partner. He even has quite a bit of documentation to back up his claims along with several witnesses who will testify for him, but due to the financial situation he is left in by his former partner he is unable to afford a lawyer and hasn't been able to find one who will take it on contingency.

    However having a loser pays system in place here would allow people with a strong case who can't afford legal representation to do something other than give up.
    I do like the idea that another judge(or panel of judges) deciding whether or not a suit was frivolous, but even without something like that in place I think that loser pays would benefit our legal system.
    It's not to say that the loser would have to pay anytime, but if the judge hears a case and after testimony finds that the plaintiff had no case, and no reason to believe that they had a case, then they would have to pay court costs and legal bills.
    In the case of someone suing a large corporation it is usually found that the plaintiff did have reason to sue, but the corporation finds some way to absolve themselves of responsibility.

    The very interesting thing about this spam case is that it looks to be the same kind of suit by which a theif who breaks into your house and subsequently breaks his back when he trips on something and falls down the stairs can sue you for not maintaining a safe environment as a homeowner.

    Although I agree that a thief being able to sue you when getting insured at your house is ridiculous, I did want to point out that an unsafe environment includes things such as empty swimming pools without a barrier around them, but not something like toys on the floor.

    Not to sound like an ardent Jobs supporter, but why would he have to say that he was wrong? The idea of a one button mouse still appeals to many less skilled computer users. I know that getting my grandma an Apple all those years ago was a great decision and I still think that she would do better with a one button mouse.
    I don't think that the idea here is to replace the one button mouse, just offer a choice to those who wish to use two buttons and don't want to go third party.

    I hope that you're not serious, anyone who would leave their chosen career field because someone else didn't think that they could cut it is a very weak person indeed. I really hope that you'd give women more credit than this.
    After watching my mom go back to school and work her ass off for what she wanted I'm offended when I hear statements like this.

And besides, you don't see much interest in any other child molestation trials, just because this guy is a celebrity doesn't mean that his trial is any more important.     although the idea that they buy the major labels is far fetched, what if they created their own labels. Just imagine software companies that had music divisions. This would be especially nice for game companies due to the fact that games are needing more and more music and for companies that sell music online. Anytime a content provider could sign a hot act they would be able to draw people to their music download service.

    We only have NPR here, and frankly I get a little tired hearing people with such a liberal slant who are totally unaware of their own political leanings congratulating each other on their recent books and talking about which 3rd world country we should send money to this week.
    And yes I do realize that there is other programming on at different times, but this seems to be the type that I catch most often. I've really just come to the realization that I'll have to supply my own listening content. Maybe the college stations have some solid programming, but I have yet to find any in this area. I do though have to point out that on Sunday night from 10 to 11 a station located about 120 miles south of Tampa has a punk show, but I have to drive at least 60 miles south to hear it.

    I can see your point, but every gym that I've belonged to has had a device on all of the cardio machines that you could just plug headphones into. Anymore though I try to go outside and get exercise, after my two years up north I'm really appreciating this Florida weather.
    I suppose that my comment that an FM radio was not an improvement was a little harsh. It is just something that I find useless, I'm much less likely to tire of the 20 songs on my mp3 player than the 20 songs that the radio station plays over and over again. Maybe if I were in a market larger than the Tampa area some quality programming would exist, but as of now I would rather go without any music than subject myself to the radio. But like I said, my comment may have been a little harsh. It really is just due to my perspective.

    The major improvement in my eyes is that some models have an FM tuner.

    I don't see this as an improvement, if radio had any quality programming we wouldn't need iPods.

    and I can say that it didn't make my computing experience any more comfortable, but it really didn't hurt either.
    It was really easy to get used to using, except for the click feature of the bar(which I kept accidentally using), but with a little practice I'm sure that it would become second nature.
    If anyone really has pains using a mouse I could say that this would be worth a try, but it is definitely not for me.

    just sign up for Vonage service, it's great....it works just like your normal phone. I hear though that Time Warner is offering a service where they just tie their VoIP hardware directly into your home telephone wiring.
    I guess with Vonage you can conceivably just attach the interface into your telephone wiring, but they recommend finding an electrician to help.

    White bread will be converted to sugars much more quickly than brown bread.

    Well really most "brown bread" that you purchase in the US is just that...brown bread. It has the same nutritional content as white bread, but has been given a brown color during processing.
    To really find a bread that doesn't cause such a severe spike in your blood sugar levels you'll want to find something that is high in fiber like whole wheat bread. Sadly, many of the breads that we refer to as wheat breads are just those white breads with color. If you want a quick way to tell if the bread is whole wheat or not give it a squeeze. Whole wheat breads are very hard compared to white breads. You can also look at the nutrition label, whole wheat breads will have about twice the fiber of their more processed counterparts.

    I believe that Apple has a right to know if one of its employees, who would've signed a NDA, is the source of the leak. How would you all feel if in cases such as this the "news source" were required to provide its sources to a third party, at that point the company that wanted to know if a leak was internal would be provided the names of sources only if it matched a list of employees.
    I do love the protections that the press has and feel that those protections should be extended to online media, but I also think that companies should have some protection of their trade secrets.

    I don't think that we disagree as much as you may think, I really feel that Apple should handle this internally, but I'm assuming that they've already tried this(if not they should).
    And although I can see the notion that a dangerous precedent could be set, I'd have to point out that providing a news source with a trade secret is very different than providing a news source with information that is important to the public.
    Having information leaks can be devastating to a company, especially one such as apple that is known for innovation. Almost everything important that Apple has done in the past few years has been copied by the PC industry shortly after(Newton, iMac, iPod, iTunes Music Store, Mac Mini). Apple is able to survive because they have enough time to see their ideas to market before competitors have a chance to even start development. The Mac Mini has created quite a stir since its release, imagine if PC manufacturers were able to hear about this 6 months in advance, they would probably already be offering some type clone.

    I think that if thinksecret were to reveal the source to an impartial 3rd party and that party were to have the job of determining whether or not the source was from inside apple, and if so providing it to apple we would have a fair solution.

    Agreed. However, even though I haven't seen the content, I was under the impression that the site was an apple review site. Was the information really harmful to apple? If not, what's the issue, other than a rogue employee.

    Well it is more of an Apple rumor site. If the site is using a source within Apple, then it would seem that the site is knowingly publishing trade secrets. I can't really agree with Apple's methodology, but due to numerous leaks they have to find a way to close the security hole.

    This seems like the Black Friday information issue. Wal-Mart and Target, et al, all want to keep sale items secret so you choose their store based on reputation. This hurts the consumer slightly, when you find out that a better deal was to be had at the other end of the mall. If that's the real issue, I can see why Apple might be a bit upset, but there again, don't go after the publisher, go after the employee's who are breaking trust with you. The publisher is providing a valuable service to the consumer based on knowledge at hand.

    I can't really see how not knowing what new products Apple is bringing to market hurts the consumer, sure finding out that a G5 is released a week after purchasing a G4 can be upsetting, but things like that always happen. I think that the real issue here is whether or not the publisher acted responsibly in publishing information about an upcoming product.
    I think that Apple should be allowed to know the sources if it was an Apple employee, if not then they have no reason to know. I have to say that I can see both sides of the argument, and that I don't want to see any serious harm come to the owner of thinksecret, but if I were in Apple's position I would want to know who was leaking trade secrets.

    unfortunately Apple is unable to deal with this internally. I doubt that the person who leaked this information is going to stand up and proclaim that they did it.
    And it would be very hard for Apple to control access to data pertaining to products that are being developed if the person leaking the information is part of the development team.
    I do whole-heartedly agree that if thinksecret were publishing nothing but rumors that it should be protected from revealing sources, but the information on the sight was far too complete to have come from speculation alone. If a large magazine where to publish this information, which could have a negative effect on Apple's survival, they would be held liable too. We shouldn't try to make this a David vs Goliath issue.
    And as far as what defines a journalist I would hope that it would be anyone who publishes information for public consumption, but that's just what I'd hope.

    how would you classify darts? What about a dart gun? A blowgun?

    All of these have roots as weapons, but would probably not be considered as such since they now are all typically associated with games of skill.
