    um, what? my point was, since most downloads are mp3s and not ogg vorbis, the way most people obtain ogg vorbis files is for them to encode their own CDs. since we are talking about, among other things, increasing existence of AAC files on the order of 4 million tracks per week at least via iTMS (and that doesn't include people like me who ripped their own music in AAC via iTunes), i couldn't see how ogg vorbis would be statistically significant in comparison. do you think minority people who even know the existence of ogg vorbis would rip so much of their music that it would collectively come anywhere near million a week?

    i agree. mac os x and linus are on the rise (at least they seem to be to me!), but no one would claim windows is dying.

    well, ok, apple is dying, but... :P

    i doubt ogg vorbis is relevant in these statistics. iTMS is selling 4 million tracks a week. and those are paid for so people won't discard them as easily as illegal downloads.

    can you think of a way music tracks on the order of millions are encoded every week in ogg vorbis?

    you completely missed my point. notice in the sentence regarding rockstar, i said their IP distribution rights were violated. i never said anything about stealing.

    the example about stealing was trying to point out if relative harm done to the person would actually make an illegal activity (in the example, stealing, in the case of rockstar, violation of their copyright) into full blown justifiable, as opposed to less wrong.

    in any case, stop preaching like you are being "insightful" about theft/copyright infringement. like someone else posted very eloquently in another thread, admitting copyright infringement is wrong but being behement about not calling it stealing is just hair splitting, matter of practical semantics. "he stole my idea!" is a perfectly accepted english sentence though you can't steal an idea under the strictest definition of "steal."

    i don't think i'm totally off base. any device, given enough thought, will have some convoluted use where it's legitimate. i am not going to claim there are tools out there that has absolutely no legitimate use whatsoever. (maybe i did, and in such a case, i have to retract that statement since i didn't mean to come off like that.) let's be reasonable here. there are tools out there that are considered illegal - hash? cocaine? - those have legal uses too, i'm sure. while i can see your point of view, i wish my point of view wouldn't be dismissed solely based on a very convoluted hypothetical case.

    what does that have to do with anything? just because they are going to sell a lot of copies makes it ok that their intellectual property distribution rights were violated? if someone's rich, does it make it actually okay to steal from him/her, instead of, perhaps, less morrally wrong?

    i think it may not illegal but you should definitely look at is as wrong. you are knowingly obtaining a copy from a person who has no distribution rights. it's like buying a rolex for $20 on the street - you know it's stolen. (yeah, i understand the blah, blah about theft vs. copyright infingement. but you are helping someone else commit an illegal act, so hope you see my point.)

    i know pre-orders are common. i wasn't sure how common it is to take pre-orders when the available date isn't even determined.

    also, i don't see OS X 10.4 (which is what you meant, i assume) pre-order on amazon, as you claim. can you show me where?

    i assume you are alluding to something about p2p software. the tool *is* the problem here. unlike p2p, this device has no obvious use in which you do not infringe on others.

    lost the remote to your TV? you should just get another remote because this gadget has only one function: to turn off. and if this device is used on any TV you don't own, then you've stepped out of your domain and now infringed on others.

    tools isn't always NOT the problem if it only has one use which is illegal/questionable/infringing.

    the problem is, it's not symmetrical. if you exercise your right to produce "some unregulated IR signals," then it infringes on others right to watch the TV. others watching TV will not infringe on your right to produce such signal. so the burden falls on you to not take such action since you will be affecting others, while the reverse is not true.

    so it's a press announcement for a pre-order... but can you honestly say something is a pre-order when you don't even know when you can order it for real?

    am i missing something or is there a significance to accepting orders when you don't know when you'll finish? aspyr isn't some small, semi-scamish operation... no one doubted that this isn't a vapor. why don't they let people pre-order when they get the release date set?

    you might be annoyed by TVs in restaurants and airports... but who's giving you the right to turn it off on behalf of everyone?

    if you are in a public place, you cannot turn that TV off as it's not solely yours. if you are in a private place not your own, you cannot turn that TV off as the TV is not yours.

    if you can't manage to turn off the TV in your own home, then you got other problems.

    but two weeks.. yeah, he may be out of luck. the unofficial cut off for apple's upgrade matching seems to be 10 business days, so it might be worth a try for him to ask.

    "add" stuff to it? no. replace them? perhaps. "very easily"? highly doubtful, except for the memory. iMac mobo has the graphics card soldered on - can you replace that "easily"?

    you can also open up a laptop and do the same thing by your logic?

    well, for one, you are looking at an iBook. it's apple's consumer machine. you wouldn't expect Dell's budget models to be better than their enterprise/gamer rigs, do you? on the same note, you can ask why Dell's still selling celeron. these aren't top of the line machines for apple.

    you should look at these in the context of other Macs. these are indeed upgrades.

    i'm sure apple is happy either way, as long as you drop that $1500 on them... expandability is something PowerMac offers but iMac doesn't.

    whenever apple updates the iMac, half the complaints are "but in a few years, I will have to throw away a perfectly functional monitor!!" here's apple's answer - if you want to keep the monitor, but this low end G5 PowerMac instead.

    this is a perfect machine for small businesses, wanting to upgrade their older G4 PowerMacs for relatively cheap.

    Price matching is usually for those who made the purchase right before an update like this. If you, for example, bought a stock 12" iBook three days ago for $1099 (now $999), Apple will match and give you $100 back or upgrade your machine to the newer one for free.

    i also wonder how much apple helped themselves by sticking to one "name" for the iPod. they haven't introduced weird model numbering schemes. it hasn't been "apple mp3-4-40" or something like that for 4th gen. 40 GB iPod. people just say, "i want an iPod." even if they want other mp3 players. *that* is brand recognition.

    it's always been "iPod" (albeit, if you go into details, there are scroll wheel model (1st gen), touch wheel model (2nd gen), dock model (3rd gen) and click-wheel model (4th gen).)

    um... iPod was doing quite well before iTMS. i'd guess that the quality, design and the features (including ease of use) is the number one reason iPod sells. the fact it has a nicely integrated music service is secondary. people don't think "ohh, i want an iPod because it works with iTMS' loosely-DRMed AAC." people think "ohh, this is a really slick player" or "ohh, i got to try playing with one of my friend's iPod and it's so much better than the small mp3 player i have! now i want one for christmas."

    that there are cheaper (possible) alternatives doesn't mean it's overpriced. the fact you (personally) don't see the benefits of some of the features (including things like designs) doesn't mean it's overpriced. i think the fact that the masses are buying iPods in bunches cast serious doubt on your (and many others) almost cliche-ish assertion that iPod/Macs are overpriced.

    if apple was once the dominating mp3 player but now on the decline, then your claim that apple is being stupidly stagnant holds water. however, they have been and still are dominating the mp3 player market...

    doesn't olympus use xD card?

    considering how xD hasn't seen the popularity increase as the CF or the SD cards, shouldn't olympus make an conscious effort in trying to include that capability in their products? (sort of like sony putting in memorystick slots in everything they make - laptop, tv, camera, pda...)

    i realize it's not that important to have an xD expansion slot when you got a large HD, but still...
