I would contend that Americans, in general, probably have an overexagerated idea of what the government can / can't do thanks to Hollywood and rumor. The "man" isn't quite as "fascist" as you think. Try living with real fascism, as my parents did in Cuba for 40 years...
I believe most problems of this type can be self correcting with market forces. If I don't like having my ISP spying on me, I'll choose another ISP. If enough people literally don't care, (like me), then this ISP will stay in business.
Of course, the point is moot... All ISPs cache data to a certain extent. And all governments can strong-arm or bribe companies... It's just that this particular ISP is being honest and saying, "Yea, we'll hand your stats over."
It would be pretty cool if someone wrote a program that makes your keyboard randomly blink a la The Original Star Trek (or many other 60's sci-fi shows). Am I the only one that's still impressed by random flashing lights on a computer? I know... I'm easily ammused...
It's also about money. Yager states that he believes Apple will open the OS back up again (eventually), and I'd have to agree. A running theme in economics is that investment (in technology) leads to increased capital. I believe the main reason that the Linux community enjoys so much capital right now is because of the years of investment. That investment was at the cost of human labor and hard work by the OSS community!
When Apple realizes that free (as in beer) investment into their business (by the OSS community) actually has a bottom dollar impact on capital, the lock on the kernel will fly open pretty quickly.
OK, maybe I am being a tad cynical. I know there are people out there who treat their kids like this (not to the same extent that you just described, but letting the tv entertain their kids during the holidays), and I feel the need to speak up against this sort of thing. (Because I like being a pain in the ass)

My wife and I limit the time allowed on the Nintendo to an hour a day. Maybe that's still too much, I don't know. But it seems good to me. Because my kids are used to these limits, it's not really a big deal for them. In fact, we rarely have to actually turn it off. They know how easy it is to save the game and shut it down, and know it's waiting for them tomorrow. Anyway, I'm an avid fisherman, and my boys and I get to the lake every Saturday. (Or at least 3 out of 4). They're fortunate enough to have a stay at home Mom, so they get plenty of time at the park, mall, community pool when summer break rolls around. So yes, we went out and bought them 6 new video games for the summer. But I guess we did it in part because of good grades, and so they could have a variety of games to play. (And not necessarily A LOT of games to play).
Take your kids outside you bastard... Hate to have you as a dad.
LOL, have some unresolved issues with your parents? Your reply honestly made me laugh out loud, I'm not just saying LOL. And yes, we have locked them in their rooms with bags of candy, soda, and video games. They're not allowed to come out until they've mastered all the games. Also, I've covered the windows with tin foil as to not let any natural light into their rooms. And they're not allowed to bathe either. If I'm particularly impressed with their gaming skills, I'll throw them some beef jerky every once in a while.

Assuming the consumer's time is worth more than $1.35/hour, they are better off with a faster hard drive.

You may have learned SF theory when determining how many decimals to keep or drop in chemistry or physics.
If you're REALLY going to say that you can measure WITH PRECISION how many man-hours are lost while waiting for a fucking program to load, then you damn well better be taking into account every time the programmer has to scratch his ass, pick his nose, and jerk off in the employee kitchen when nobody is looking.
Simply put: the man-hours lost while waiting for your hard drive is INSIGNIFICANT next to the thousands of man-hours we waste every year on other piddly shit. BOOYA!

I'm saying that the media's hype is inappropriate for these cases. If the media spent half as much time reporting on drunk driving cases, domestic abuse, etc., you'd think that thousands and thousands of people were dying in America every day...

I somehow think that a search for "Adobe", "Photoshop", etc. will still give you adobe.com as the #1 result, despite its accessibility problems.
