I don't think ordinary users notice. When I talk to my non-tech-savvy friends, they usually ask me if this or that price is right for a given computer, mostly without taking into cosideration its characteristics (Once a girl I know asked me if a 300 price tag for a laptop could be right, and when I asked for specs, she only replied "Acer"). Besides, we've got big PC stores here (like PC City) whose prices can be 50% more expensive than those you find in smaller, franchised, specialized shops, and they still sell the most.
So no, ordinary users will judge the price based on how awesome the salesman tells them it is (and, of course, if it doesn't come with Windows, don't bother calling it a PC, please, it just confuses them).
Of course, anyone can sue anyone for anything any time in our legal system
Which side of the Pond's legal system are you talking about? Here in the EU (at least in Spain), we have good laughs at the frivolous lawsuits going on day after day in the US.
OVH offers dedicated servers with a dedicated 5 Mbps line, but you can upload some MB (I can't really remember if it was 5 or 10 MB) using full 100 Mbps capacity. After that, you let your upload privilege "refill" (i.e. using less than 5 Mbps "recharges the line"), so you can get another burst.
Nothing new under the sun. If anything, it's kind of a cool feature. If you need to measure real bandwidth, bursty downloads won't do.

What about DirectX 10? If they can't get enough gamers to upgrate to Vista, how can they justify to game developers that DX10 is the way to go? They will ask themselves "well, what will our sales will look like if we use DX9?", and if it's significantly higher than with DX10, no Vista-only for you.
However, if there are enough Vista copies out there (either pirated or legit), they can safely release using DX10 which, in turn, will make Vista more appealing for end users (more xclusiv gamez!).
The way I see it, they can choose between positive or negative feedback.
