    That is a load of BS and we all know it....

    Not so long ago http://slashdot.org/article.pl?sid=06/10/02/144520 6 we all agreed that the "Make me a website for free, you will get exposure and clients" myth doesn't work and it is basically a scam to rip off geeks. Now we say the same thing "Give your music for free and people will buy your CDs" will work for musicians....maybe because you are the one benefiting from getting all the music for free and promising that you will buy their CDs if they let you listen to it first?

    They are only protected so far because nobody is benefiting economically from displaying copyrighted material, just like you say, they take down user-submited material when the receive a take-down notice. The problem for them will start when they come with a revenue-generating strategy (ads/comercials before the content... whatever) because then it can be argued that they are profiting from the copyrighted material owned by someone else. In that case the "we didn't know until we received the take-down" defense will not work in court.

    We need to remember that there is another audience that this campaing is trying to reach: Apple users. Sure, you don't get a lot of new customers by insulting their choice of a competing product, but you gain a lot of loyalty from your current customers.

    It is a fact that a lot of ads are targeted to current users of the products to estabish and reinforce brand loyalty. In this case you don't have to limit yourself just to mac users, after all there are a lot more ipod users out there that I am sure Apple would like to convince to buy a mac. After all, aren't you already hip and cool with your ipod? Wouldn't you like to dump that working-stiff-white-collar-forties-guy of a PC and get you a mac to go with your ipod?

    Someone will come up with a way to infect the actual card
    After all, if you can infect and modify the BIOS, why not this ultra-secure card? I am sure it has some type of non-volatile memory with firmware and the ability to burn updates into it, thus making it possible to be attacked.

    I am pretty sure that their licensing fees will more than cover the money they will lose for lack of customers.

    The funny thing is that my very first VCR was a Philips that advertised exactly the opposite: it was capable of receiving a special signal that marked the beg. and end of commercials in order to atomatically pause recording. Of course, not a single broadcaster ever got on track with the idea.... :)

    Your phrased that wrong, it should read: "If somebody else signed and NDA and passed the information to a media outlet THAT KNEW THE INFORMATION IS A TRADE SECRET, both the signer and the media did the infringment". People in the "traditional" media are fired and their careers ruined all the time because of issues like this. If bloggers want to be treated like all other media outlets they need to play by the same game rules and follow the established code of coduct for journalism, and don't forget the most important rule: to obey the law. I feel no pity for somebody that has been doing this stuff for years, knowing that it is illegal and now goes around crying "first amendment!" After all, Apple could have tried to make the case that the blogger released the information with the intention of benefiting economically, and seek economic relief. After all he may have expected to get more advertising revenue from the increased traffic that the release of such trade secret would cause.
