  1. Re:Foriegn Laws For US Companies? on ITMS Faces Complaint From Norwegian Ombudsman · · Score: 1

But this kind of raises an interesting question. When a company operates accross many countries, which country's law do they uphold?
The thing here is that it depends on the customer's country laws ! Some country laws will tell you that you're subject to the laws of the country of the company you're buying to; some other country laws will force you to comply to their regulation to be able to sell your products.
As an example I would take the case of a web contest that would be held on a UK web site might be forbidden in France because they do not have the same laws. I saw it with one of my client who had web sites all over Europe: the contest was ok for all countries except for France ... and modifying the rules would have allowed the contest to enter France but would have blocked it in other countries.

That's where the nightmare is: every state will tell you "Obey the Law !" but if you obey to the law in a country you will violate the law in another, or violate the laws of equality of the market in Europe.

This said, I don't think that the main motivation for Apple to keep "their" songs secure is the reduction of iPod sales. I would consider the ITMS as an addition to the iPod accessories and certainly not the opposite. iPod was there long before the ITMS and the success was already huge.

Absolutely, there is a point that most people are missing here: Apple has no monopoly in MP3 market, you can buy your MP3 elsewhere or buy the CD and rip them to put them on your MP3 player.
It's not like you don't have any other choice, there are other choices by opposition to the Microsoft problem with Internet Explorer where you don't have any other choice but to use it as it is a part of Windows.

Apple has a file format compatible between their software and their hardware who can blame them for that ? You can play other file format on the iPod so you're not forced to buy songs at Apple to use it and if you don't like the file format don't buy at ITMS.

Beside of that you always have it with you, it's mandatory since the age of 16 and you just don't ask yourself if it's good or bad.
Seriously, I was amazed when I realized some countries were not having ID cards when I discovered it some years ago.

I think it has some real good points: first of all we don't need passport to travel in a lot of countries that just accept our ID card. There is no question to know if we have anything with us to act as ID card as we always have one. Id cards are used to retrieve packages at post office, make changes at your bank account etc ... : it is far less easier to pretend you're someone else.
I know it might sound weird to people like US citizen (I already discussed this with US folks) but ID cards are more a protection of your identity than a way to trace you.
We're now getting some new cards more like a credit card with a chip where can be stored some health information like your blood type, etc the idea being to use it more and more as a "universal card" for lots of services.

And just for the joke, teenagers love to take it out in bars to prove they're 16 and are therefore allowed to drink beer ;)

This is not a question of "Real" or "Not real" IT department. That statement in itself is already saying that if you use Apple you're not really doing IT and is already, excuse me ... wrong.

"IT" does not mean "Windows" nor "Beautiful is not useful" nor "bad user experience makes high profits", as I said to a customer some times ago "It's because it's look like MS 2000 that it is more professional".

Of course, a lot of IT workers still think that way and those ideas are hard to remove from their head but this is not about a kid argue about "My OS is better than yours" ... it's about money.
Choice 1: 2 machines for my employees or one ? Well one will cost less than 2.
Choice 2: what machine ? Which one can operate both OS ? Well only one can do it.

I think you got the answer. As usual the need for a Mac or another machine will only depends on the business you're in but now more businesses can use Macs, that's as simple as that.

Still on my experience, I could do everything on my mac except a few applications: MS projects, Tridion (CMS), Emagic (CMS) and that's about it; but I need a Mac to be able to work on some graphical issues and to do my testing ... bootcamps gives me the solution.

This isn't about Apple "switching to Windows" or becoming yet another Windows PC manufacturer. In fact, it's the furthest thing from it.

Indeed, in my experience this is a big move inside the office market. In my company, what has been said is this: "Once it is possible to dual boot OS X and Windows on a Mac, you'll have the choice to have one or the other".
I'm Project Manager and I'm a Mac fan but I had to admit I could not do my job fully on a Mac, now for the rare occasion I need an MS specific software I will just have to reboot.

So no it's not switching to Windows, it's bringing more people on Apple hardware ... to bring them on Apple hardware AND software.

Let's take a simple example, in US if you say you're a socialist people will look at you like you have some strange disease while in Europe half od the countries are actualy lead by goverments where the Socialists have the majority.
With that in mind, you are probably more prepared to understand that Microsoft is seen as "The Devil" by lots of the EU citizens and therefore by a lot of the guys they've elected to represent them at the European parliament.

Combine this with the actual image that people in Europe have in mind when you're talking about the US administration and you'll probably have a clearer picture of how people will react to this in Europe. And by people I mean the peoples and their deputies ...

EU will just see this as one more attempt from the US administration to influence the EU domestical affairs; and seriously, peolple are just fed up with this attitude.

But seriously, this all debate is once more about having to pay for music, since the Napster, people feel that they don't have to pay for music anymore and it's a shame.
What do you people think, that those artist are there just to divert you and that you can use whatever they make as you wish ? Oh right it's the "open source" state of mind, it's digital so it enters the open source field and we don't have to pay for it ...
Just a reminder, the open source is based on the fact that people are sharing their knowledge to build software (or OS, ...) and because everyone can work on it, everyone can use it. But music is not an open-source projects, it's the hard work of some one and you just don't have to right to claim it's free just because it is easy to get it for for free.

ITMS is has brought the music prices to the lowest level ever so far, it has helped us music fans to get rid of all the taxes that was put on the cd's and other support. In my country a CD was more than 20 to 25 $, that was not normal because it was overpriced. But with the ITMS, the price is fair and we should not forget that as we should not forget that the artist has the right to get paid for his work.
You claim for your liberty when you talk about the format, well it's a protection for the artist (please skip the the "no it's the bad big industry, not the artists" it's so 16 years old) ... As we said here: "your liberty ends where my liberty begins" -> your liberty with the songs stops where the artists liberty begins.

And just as a remark: "the format will be obsolete in 5 years", well maybe, maybe not, but maybe just as all format in music become obsolete at a time (LP, ... CD) and they did not offered you more possibility to change format without loss of quality.

So who has changed : the Irish or the American culture ? The Itlaian or the American's culture ?
