I agree. Apparently the author of the FA has no understanding of the purpose of this service. It is similar to AmazonS3 or EMC Atmos online with a similar interface.
Maybe Apple actually cares about their customers(the ones who will actually use the device). Kind of hard to get word of mouth if no one is actually able to by one to use..
It is also a little rough on Developers. There is no upside to unauthorized resellers from Apples perspective or the perspective of people living in the market where the device was released.
Did you read the articles you linked? Clearly state the apps only targeted jailbroken iPhones. This means they were not distributed through the app store and not in any way relevant.
I can't believe anyone could read the entire affidavit and not believe Hogan and Chen knowingly committed a crime. Combine the information in the affidavit with Chen's and Hogan's public statements and you have a clear picture of crooks who knew they were committing a crime.

Why would someone who is making money on an App give it away as a flash app?
If they wanted to give it away they would give it away now..I read both your comments. The only way they make any sense is if you meant it would be easier for others to copy the apps developers are selling in the app store and give them away on flash.
I suppose that may be true (but not really), I am not sure if Adobe wants your "Flash makes it easier to steal other people's ideas" on their side.
