Google Seeks To Limit 'Right To Be Forgotten' By Claiming It's Journalistic (cjr.org)
"In the first 'right to be forgotten' case to reach England's High Court, two men are fighting to keep their past crimes out of Google's search results, and the tech giant is fighting back by claiming it's 'journalistic.'" Chava Gourarie reports via Columbia Journalism Review: The case, which is actually two nearly identical cases, involves two businessmen who were both convicted of white-collar crimes in the '90s, and requested that Google delist several URLs referencing their convictions, including news articles. When Google denied their requests, they sued under a 2014 European Union ruling which established the right of individuals to have information delisted from search indexes under certain conditions. In its defense, Google has argued that it should be protected under an exception for journalism because it provides access to journalistic content. Even as a legal sleight of hand, the argument is quite a departure from Google's customary efforts to present itself as a disinterested arbiter of information, a position that has become more untenable with time.
Gareth Corfield, a reporter for The Register who covered the cases from the courtroom, said it's disingenuous of Google to put on the mantle of journalism only when it suits them. "They've gone through great lengths to say they don't make any editorial judgement in processing results," Corfield said, but "it now wants you to believe it is on a par with journalism." As the first case to test the "right to be forgotten" in England's High Court, its outcome will likely set some ground rules in the roiling debate between personal privacy and freedom of expression on the internet. Google's sudden identification with journalism may be a legal gambit, but it could have far-reaching effects across the landscape of data protection laws. -
Governments Turn Tables By Suing Public Records Requesters (apnews.com)
schwit1 quotes the AP: Government bodies are increasingly turning the tables on citizens who seek public records that might be embarrassing or legally sensitive. Instead of granting or denying their requests, a growing number of school districts, municipalities and state agencies have filed lawsuits against people making the requests -- taxpayers, government watchdogs and journalists who must then pursue the records in court at their own expense.
The lawsuits generally ask judges to rule that the records being sought do not have to be divulged. They name the requesters as defendants but do not seek damage awards. Still, the recent trend has alarmed freedom-of-information advocates, who say it's becoming a new way for governments to hide information, delay disclosure and intimidate critics. "This practice essentially says to a records requester, 'File a request at your peril,'" said University of Kansas journalism professor Jonathan Peters, who wrote about the issue for the Columbia Journalism Review in 2015, before several more cases were filed. "These lawsuits are an absurd practice and noxious to open government." -
Stylebooks Finally Embrace the Single 'They' (cjr.org)
Two major style manuals are now allowing the singular use of "they" in certain circumstances. While this is a victory for common sense, the paths taken are unusual in the evolution of usage. From a report on Columbia Journal Review: Both manuals, the Associated Press Stylebook and the Chicago Manual of Style, emphasize that "they" cannot be used with abandon. Even so, it's the middle of the end for the insistence that "they" can be only a plural pronoun. To recap: In English, there is no gender-neutral pronoun for a single person. In French, for example, the pronoun on can stand in for "he" or "she." English has no such equivalent; "it" is our singular pronoun, so devoid of gender that calling a person "it" is often considered insulting. We could use "one," but that is a very impersonal pronoun. Consider this sentence, for instance. "Everyone needs to be sure to tighten ____ safety belt before approaching the cliff." The article adds: For hundreds of years, anyone writing formally would default to "he." Advances in women's rights led to the clumsy "he or she." Many writers alternate "he" or "she." This twisting and turning is because what's known as "the epicene they" has been considered incorrect. [...] But that's not the "they" the style guides have let loose. Simply, the singular "they" will be allowed if someone prefers that pronoun. -
Reuters Built An Algorithm That Can Identify Real News On Twitter (popsci.com)
Reuters has built an algorithm called News Tracer that flags and verifies breaking news on Twitter. The algorithm weeds through all 500 million tweets that are posted on a daily basis to "sort real news from spam, nonsense, ads, and noise," writes Corinne Iozzio via Popular Science: In development since 2014, reports the Columbia Journalism Review, News Tracer's work starts by identifying clusters of tweets that are topically similar. Politics goes with politics; sports with sports; and so on. The system then uses language-processing to produce a coherent summary of each cluster. What differentiates News Tracer from other popular monitoring tools, is that it was built to think like a reporter. That virtual mindset takes 40 factors into account, according to Harvard's NiemanLab. It uses information like the location and status of the original poster (e.g. is she verified?) and how the news is spreading to establish a "credibility" rating for the news item in question. The system also does a kind of cross-check against sources that reporters have identified as reliable, and uses that initial network to identify other potentially reliable sources. News Tracer can also tell the difference between a trending hashtag and real news. The mix of data points News Tracer takes into account means it works best with actual, physical events -- crashes, protests, bombings -- as opposed to the he-said-she-said that can dominate news cycles. -
Secret Text In Senate Bill Would Give FBI Warrantless Access To Email Records (theintercept.com)
mi quotes a report from The Intercept: A provision snuck into the still-secret text of the Senate's annual intelligence authorization would give the FBI the ability to demand individuals' email data and possibly web-surfing history from their service providers using those beloved 'National Security Letters' -- without a warrant and in complete secrecy. [The spy bill passed the Senate Intelligence Committee on Tuesday, with the provision in it. The lone no vote came from Sen. Ron Wyden, D-Ore., who wrote in a statement that one of the bill's provisions "would allow any FBI field office to demand email records without a court order, a major expansion of federal surveillance powers." If passed, the change would expand the reach of the FBI's already highly controversial national security letters. The FBI is currently allowed to get certain types of information with NSLs -- most commonly, information about the name, address, and call data associated with a phone number or details about a bank account. The FBI's power to issue NSLs is actually derived from the Electronic Communications Privacy Act -- a 1986 law that Congress is currently working to update to incorporate more protections for electronic communications -- not fewer. The House unanimously passed the Email Privacy Act in late April, while the Senate is due to vote on its version this week. "NSLs have a sordid history. They've been abused in a number of ways, including targeting of journalists and use to collect an essentially unbounded amount of information," Andrew Crocker, staff attorney for the Electronic Frontier Foundation, wrote. One thing that makes them particularly easy to abuse is that recipients of NSLs are subject to a gag order that forbids them from revealing the letters' existence to anyone, much less the public.] -
California Attack Has US Rethinking Strategy On Homegrown Terror (nytimes.com)
JoeyRox writes: The recent terror attack in California reflects "an evolution of the terrorist threat that Mr. Obama and federal officials have long dreaded: homegrown, self-radicalized individuals operating undetected before striking one of many soft targets that can never be fully protected in a country as sprawling as the United States." With this new type of terror risk, authorities may begin relying more heavily on citizens reporting suspicious behavior of others. The attack is also expected to renew the debate over privacy versus security for software encryption. President Obama will be addressing the nation tonight to discuss the attack. -
(Over-)Measuring the Working Man
HughPickens.com writes: Tyler Cowen writes in MIT Technology Review that the improved measurement of worker performance through information technology is beginning to allow employers to measure value fairly precisely and as we get better at measuring who produces what, the pay gap between those who make more and those who make less grows. Insofar as workers type at a computer, everything they do is logged, recorded, and measured. Surveillance of workers continues to increase, and statistical analysis of large data sets makes it increasingly easy to evaluate individual productivity, even if the employer has a fairly noisy data set about what is going on in the workplace. Consider journalism. In the "good old days," no one knew how many people were reading an article, or an individual columnist. Today a digital media company knows exactly how many people are reading which articles for how long, and also whether they click through to other links. The result is that many journalists turn out to be not so valuable at all. Their wages fall or they lose their jobs, while the superstar journalists attract more Web traffic and become their own global brands.
According to Cowen, the upside is that measuring value tends to boost productivity, as has been the case since the very beginning of management science. We're simply able to do it much better now, and so employers can assign the most productive workers to the most suitable tasks. The downsides are several. Individuals don't in fact enjoy being evaluated all the time, especially when the results are not always stellar: for most people, one piece of negative feedback outweighs five pieces of positive feedback. -
Will Ad Blockers Kill the Digital Media Industry?
HughPickens.com writes: Michael Rosenwald writes at the Columbia Journalism Review that global online ad revenue continues to rise, reaching nearly $180 billion last year. But analysts say the rise of ad blocking threatens the entire industry—the free sites that rely exclusively on ads, as well as the paywalled outlets that rely on ads to compensate for the vast majority of internet users who refuse to pay for news. A new report from Adobe and one of several startups helping publishers fight ad blocking shows that 198 million people globally are now blocking ads, up 41 percent from 2014. In the US, ad blocking grew 48 percent from last year, to 45 million users. "Taken together, ad blockers are hitting publishers in their digital guts," writes Rosenwald. "Adobe says that $21.8 billion in global ad revenue will be blocked this year."
Publishers have been banking on the growth of mobile, where the ad blocking plugins either don't work or are cumbersome to install. A Wells Fargo analyst wrote in a report on ad blocking that "the mobile migration should thwart some of the growth" of ad blockers. But Apple recently revealed that its new operating system scheduled for release this fall will allow ad blocking on Safari. Apple is trying to pull iPhone and iPad users off the web. It wants you to read, watch, search, and listen in its Apple-certified walled gardens known as apps. It makes apps, it approves apps, and it profits from apps. But, for its plan to work, the company will need those entertainers and publishers to funnel their content to where Apple wants it to be. As the company makes strategic moves to devalue the web in favor of apps, those content creators dependent on ads to stay afloat may be forced to play along with Apple. Adblock Plus has released a browser for mobile Android devices that blocks ads, and it's planning to release a similar product for Apple devices. "The desire to figure out how to bring ad blocking to mobile consumers is a worldwide phenomenon," says Roi Carthy Ad blocking, he says, "is an inalienable right." -

But SnapStream makes a line of 30+ channel DVRs that can record dozens of TV shows simultaneously. Its products are the monster trucks of the DVR world, used by popular shows like The Colbert Report, The Daily Show, and The Soup. A SnapStream cluster can repackage, transcode, and distribute content for re-use — functionality you won't find on a consumer-grade DVR. 'Being able to record, say, all of the news channels was something companies were interested in,' says Aaron Thompson, SnapStream's president. 'The Daily Show, Colbert Report, and so on all use it to record a bunch of stuff, find what they want to make fun of, and quickly get it into their editing bays to get it on air.' Prior to SnapStream, the big media companies were using isolated DVRs to record all the different television channels and shows like The Colbert Report had armies of interns to watch and catalog all the recorded TV, but SnapStream can search the entire recorded library for video based on keywords in the closed captions. 'We bring some of the power of 'new media,' the ability to search, copy and paste, and e-mail clips, to the old media of television for organizations,' says Rakesh Agrawal . 'You weren't able to search television before, but now you can. Now you can pinpoint stuff and you can hold people accountable and move at the same speed at which media works in the online world.'" -
San Onofre's Closure: What Was Missed
Lasrick writes "John Mecklin explores the context that was missed when the LA Times and the San Diego Union Tribune reported on the closing of the remaining two San Onofre nuclear reactors: 'U-T San Diego published a similar flurry of well-reported stories that covered the basics of the reasons for the closure, as well as the impact on consumers, workers, and the electricity supply. At both papers, coverage included infographics that effectively explained the problem that forced the plant to close—vibration that caused wear in tubes for the plant's steam generators. (The Times's tick-tock takeout on the history of the steam generator snafu, published in July, is especially comprehensive.) The specifics of the San Onofre closing were covered well and thoroughly. The context within which those basics reside, however, was far less well-examined, and the two major newspapers closest to the San Onofre plant both therefore missed a real opportunity to inform readers about the major energy choices California and the country will need to make in the coming decade.' Bloomberg Reporters Caught Spying On Terminal Users

CNN reports that was the unsettling realization Goldman Sachs execs came to a few weeks ago when a Bloomberg reporter inadvertently revealed that reporters from the news and financial data provider had surveillance capabilities over users of Bloomberg terminals. 'Limited customer relationship data has long been available to our journalists,' acknowledged a Bloomberg spokesman. 'In light of [Goldman's] concern as well as a general heightened sensitivity to data access, we decided to disable journalist access to this customer relationship information for all clients.' Business Insider is now reporting on allegations that Bloomberg reporters used terminals to spy on JPMorgan during the 'London Whale' disaster; Bloomberg bragged about its leadership on this story." -
A Proposal For Unionizing Bloggers
mikesd81 writes "Coloumbia Journal Review writes about the possibility of unionizing bloggers. Chris Mooney writes 'Yes, dear reader: the Bloggers Guild of America may be on its way. The dispute between screen and television writers and media conglomerates has its roots, after all, in the Web.' He says, then, they get zero compensation for their products being distributed over the Internet. 'Bloggers often earn that same salary. There are exceptions, of course, those fortunate few who have become quasi-celebrities in their own right and found themselves, and their sites, snatched up by major media companies,' he goes on to say. He also adds that a bloggers guild could protect a blogger's intellectual property and help ensure they're compensated for it." -

Review of T3: Rise of the Machines
The Terminator movie series offers explosions and cyborgs galore, but you knew that already. Guns too, and cool special effects involving R-rated nude people in electrified spheres, but you probably guessed that too. So you've seen the trailer and are wondering whether "T3: Rise of the Machines" is worth seeing. Short answer: eh, whatever, it's big and dumb. For the long answer, keep reading. (No real spoilers.)Let me first draw your attention to CNN's review. The CNN reviewer tells you this "darker and slicker" sequel is "worth the wait," gives you the long-form plot setup, shows you the sexy look of the "babe-a-licious" babe, and promises you "emotional weight" with "wit" and a "stunning and thought-provoking" climax. What he doesn't mention is that CNN and the movie's producer/distributor are both owned by AOL Time Warner.
It's been ten years since I watched the first Terminator and maybe I'm remembering it better than it was. But it had an emotional depth, a heart that neither of its sequels matched. T3 is slicker, yes, but darker!? It's light fluff. The nightmare of nuclear destruction in the original was rendered without CG effects, but I'll remember the skeleton clutching the chain-link fence long after I've forgotten this week's pixel-perfect explosions. And the "storm is coming" ending of the original was genuinely thought-provoking, with a chilling resolve that just embarrasses this week's Hollywood ending. Claire Danes is no Linda Hamilton.
The effects are what you'd expect from a modern zillion-dollar action movie, but not groundbreaking the way that T2's were at the time.
I found nothing about it witty. I chuckled through the chase scenes -- it's mostly chase scenes -- because they were so over-the-top and the plot holes were so glaring. Apart from that, there was only one funny line. (I assume everyone else is as bored as I am with the "dry cool wit like that" dialogue.)
Best unintentionally funny line: "I've got enough C-4 to blow up ten supercomputers!"
Best unintentionally funny visual: tie between fumble for the car keys, and offscreen killing sprays blood across photo.
Dumbest joke: gratuitous mocking of effeminate guy.
Best absurd effect: missile blows apart the wall in a small office ten feet from our heroes, they avoid injury by diving to floor. Duck and cover!
Best plot hole: Terminatrix's chronic failure to remember that she can run fast.
Heavy on the exposition, light on brains and heart, forgettable. See it if you really jones for big trucks smashing stuff. If you just have to see a movie, see "28 Days Later" instead. Rated R, not recommended for anyone whose mental age matches their valid ID.

Pop-up Ads Coming to A TV Near You
Muddie writes "The Atlanta Journal-Constitution is reporting that television execs and advertising agencies think product placement and the 30 second commercial spot are not getting the respect they deserves from us consumers, so in order to combat us ignoring them, there will be pop-up ads taking up the lower quarter of your screen during normal programming. Not only that, but the ads will run during relevant portions of the programming (see a guy shaving in the mirror, get a pop-up ad from a razor company). Do "They" think we just don't see enough advertising in a day? If you aren't busy throwing things through your television yet, you can read the article over here (with no pop-up ads)."
