Re:Recourse
Either way it doesn't matter if it affects your credit or not, the big issue is what to do once it's happened to you. Kroll has the best IDTheft solution out there, they monitor your credit for you, AND when (not if, because it's just happening to everyone these days) you are compromised they will fix it for you, rather then leaving you to your own resources to fix it. I thought it was cool enough I became a reseller, go read about it at the cheesey stock website they gave me where they have all the good info

ID Theft w/o a SSN
Hi There, after reading some of the replies, I'm not sure if you got your question answered. Organized crime has created a multi-billion dollar industry in theft of ones identity. Most people are consumed by the notion of credit card fraud/theft, yet according to the FTC (2004), credit card fraud represents less than 29 percent of the global problem. Keep in mind that someone can assume your identity and commit crimes in your name. They can get a job in your name, they make the money... guess who the IRS comes after for the taxes? There was a case of an Illinois man arrested for drug trafficking in California. He spent ten days in jail before they realized he'd never been to California. Try calling Citi-Bank to fix that problem. Feel free to watch the short movie at: http://www.prepaidlegal.com/idt/m_browne Hope you find value in the information provided.

Re:a more pressing question.....
Sorry to hear about your friend's lost ID. The reality is that even without his SSN, criminals can assume his identity and commit crimes in his name or get a job while pretending to be him. They'll make the money... guess who the IRS comes after for the taxes. Or use his medical identifyers to seek treatment for an ongoing illness. Your friend now becomes the owner of that disease. In our industry, we've seen these and countless other crimes committed where a social security number didn't come into play for some time. In reading many of the responses on this website, many consumers are misled and have a false sense of security. In 2002 there were 9.9 million known victims. 2004 the stats were 1 in 4 people were ID theft victims. In in the first quarter of 2005, there were over 49 million identity compromises. The problem has reach epidemic proportions. The Identity Theft Shield is designed to not only monitor activity, but also provide RESTORATION from Licensed Forensic Investigators. Invite your friend to visit: http://www.prepaidlegal.com/idt/m_browne Good Luck.

Pre-Paid Legal
this is the reason developes might be interested in pre-paid legal. Its around 30 bucks a month, and any time you need a lawyer, you get the first consultation/letter/contract review/etc done for free by a reputable firm in your area. If this guy had pre-paid service, he could get the official certified lawyer letter he needs at no cost. If he then needed to sue the infringing company, he can choose to hire the firm that drafted the letter, and they will already be familiar with the case. Not to mention, you can use it for any legal dispute, not just code, so its a good all around thing. Also, people sell pre-paid legal for a living, but I dont, otherwise youd see some kinda of referrer tag in this URL: Pre-Paid Legal. Im just offering a suggestion.

desperationthese types of things reel in desperate individuals who don't want to work for their money, or do the research to learn how to invest it well. In general, if someone tells you that you can make lots of money by doing no work, they're trying to scam you.
It's not all black and white. There are even some companies in the US that have a sort of queezy feel to them in regards to their offers. Pre-Paid Legal has an iffy feel to it (see News on Pre-Paid Legal. It's a MLM company which sells
That was a grey-area example, But offers which promise to make you rich while requiring no work from you are almost invariably scams. There's an easy way to detect a scam: listen to your gut. If something doesn't feel right, you shouldn't go with it. -
Re:Litigation insurance! What a great idea!
I should point out that there are already several services that are the equivalent of "legal insurance" that anyone may purchase. By way of example, see Pre-Paid Legal Services (NOTE: also a MLM company), but there are several others. Prices tend to range from $8 per month to $30 per month depending on the "coverage" provided.

Pre-Paid LegalCheck out Pre-Paid Legal -- I'm pretty sure that this is a "pre-existing condition" so you wouldn't be eligible for benefits for this case, but they provide legal defense if you're named in a civil suit, or job-related criminal suit.
I've been using their service for half a year now and am very pleased with it; you can ask an unlimited number of questions, and they'll also write letters and make phone calls at your behalf to resolve issues for you. They also provide traffic defense (parking/speeding tickets, or lawsuits based on injury) and cover you if the IRS decides to audit you.
It's somewhat like "legal insurance" -- just as you pay a couple hundred a month for health insurance, or car insurance, this provides for your legal needs on a pre-paid, monthly basis (generally about $27 a month) and it covers your entire family.
In this litigious society we live in, it's great to have coverage for when (not if) you end up on the wrong end of a lawsuit.
Again, I'm pretty sure this won't help your specific case but hopefully it can help other readers. (And yes, I sell the plan if anyone's interested.)

Re:Legal insuranceBeen there, done that - and for much less than $100 a day. In fact, Pre-Paid Legal Services has their top-of-the-notch plan for $25/mo. and a lesser plan for even less.
More such companies can be found with a simple google search.

Re:Now would be a good time to hire a lawyerI know I'm going to take a beating for doing some marketing here, but a) we've all gotta eat and b) this service could really help you out.
I'm an associate for Pre-Paid Legal, a service giving access to attorneys. It generally costs $26/month (some states are less), and gives you a number of benefits including unlimited phone consultation, document review (up to 10 pages, which the work contract should be under), a free will, traffic defense, civil defense, and any services which aren't covered are offered at a 25% discount to the attorney's hourly rates (so anything not covered would basically pay for the membership after the first couple hours).
For more information, click here .
Again I apologize for the commercial nature of my post but I hope that the service can be of value to you.

Re:Free consultationIn addition to these suggestions about an initial consultation, also be aware that there are "legal insurance" plans available in the USA (and possibly other countries). One that I am familiar with is Pre-Paid Legal Services, Inc.. [ObDisclaimer: My wife and I are Marketing Affiliates of theirs.] I'm sure there are many other fine ones.
For a monthly fee of around $25 US, you are given representation by top-flight legal firms in your state, and all the telephone consultation you need.
ObAnecdote: When some legal firm representing our regional power utility sent us a letter claiming that our dog bit a utility worker, I just faxed it to our PPLSI representative, along with my explanation ("The dog hasn't bitten anybody. It's a load of bunk!"), and the problem went away. Could I have afforded to be sued? Nope. Was I sued, or even served with any official paperwork? Nope.

Pre-Paid Legal anyone?
I didn't see this mentioned anywhere : Pre-Paid Legal Services, Inc.
I pay about $20 a month and accrue hours that can be used toward a trial, in the event I'm sued or need to sue. I also get (as far as I can tell) unlimited phone access to attorneys for questions and concerns. Everytime I call, all of my issues are addressed and the lawyer on the other line gives advice on my options is the advice doesn't pan out.
You buy car insurance before your car is whacked in an accident. You get renter's/homeowner's insurance before your dwelling is burglarized. Why not get "legal insurance" before your sued. Check out Pre-Paid Legal -- I haven't regretted my purchase thus far. Besides, if you're querying non-legal websites for advice on what to do when you're legally harassed, you are way past the point of needing legal counsel. -
back to the store
Well, if I ever end up with one of these, it's back to the store with it.
If they won't take it back because "it's been opened", a phone call from one of my lawyers should do the trick.
