Let's start with the windowing environment, since that is the first thing users will notice. While both KDE and GNOME are mature, stable, and accepted as IEEE standards, Apple has elected to use neither. In fact, they don't even use X at all! Their display system is a proprietary, closed-source system called Quartz Extreme. In addition to the moral issues involved with closed software, this precludes the user from running X apps. There is an untested and alpha-quality X11 emulation layer available for download, but it is emulation, so programs will be slow. Does this sound like a standards-based system to you?

Looking under the hood, it gets worse. While all other *nixes use standard ELF binaries, Darwin (Apple's name for their proprietary "Unix" kernel) does not. It uses Mach-O, an unproven format that is proprietary to Apple. The moribund FreeBSD, off which OS X is based, uses ELF, so clearly Apple went to the extra effort of "switching" (heh) simply to break compatibility. With ELF, users would be able to run most of their Lunix apps; with Mach-O this is impossible. Additionally, Apple has moved most configuration info fromhuman readable text files into a proprietary database called "NetInfo", which is much like the Windows registry we all loathe. Why? These are only a few of the ways that Apple has deliberately broken compatibility with other systems, presumably in order to lock users in to expensive Mac hardware.

When we factor in the threat to users' civil liberties that is posed by the DRM included to support the iTunes Music Store (do you really think it will end there?) it is obvious that real *nix gurus should give OS X a wide berth. Caveat emptor.

enterprise features for business for OpenLinux 4.0

Thus even if NUMA,RCU,SMP,JFS are derivative works of SysV ( a long
shot) they are now legally GPL'ed. IANAL but their lawyers may have
realized this and that is why they are trying to fight against the GPL.
That is their only chance (no matter how slim) of winning anything in
this saga.

I just went to their piracy reporting form. I thought they would be interested to hear about a company which is distributing GPL code combined with code which said company claim to be proprietry, in violation of the GPL. I hope they take this as seriously as any other 'piracy' that is brought to their attention.

I just thought I'd peek at their site right now, to see what phantasm they were conjuring now.

They had a promising looking link at http://www.sco.com/licensing. The link says REGISTER , which in good fun, I clicked... Getting pages of badly escaped error in SQL connection. A Caldera URL, domain and coding are evident... Enough info in the error to guess that their CGI fields map to names in the table space.

A decent SQL injection could probably drop the DB, who knows? Maybe more. Real amateur job they've done.

Also, here is a list of companies that are supporting SCO by attending SCO's "Forum 2003". It is interesting to note that HP, a company that has extremely close ties to Microsoft, is a major sponsor of SCO's little get together.

I just modded in this topic, so I had to logout to post.

I'm far far away from vegas, but SCO is having a show there in three days. If any slashdotters are in the area I suggest pulling the permits and protesting infront of the SCO show. As someone who has done work on SCO stuff in the recent past, I will now move every customer I can off their product and onto another operating system.
We need to show those that use SCO that the people who do support work on the SCO operating systems will no longer do any further work on SCO based systems (in the past couple of years I did some work on a Xenix system, so it's plural).

Though it's great that somebody is willing to step up and offer legal protection to Linux, the kind that Microsoft are readily willing for the lack thereof. How will this help?

Incidentally, it's also possible that IBM's countersuit is costing SCO money to defend. If Boies is doing that one on a contingency as well, then it has to be more than a little annoying for him because it includes patent infringement claims which will necessarily require additional lawyers to be put on the case because of the specialization in patent law required, and this will at the very least entail a substantial opportunity cost because those lawyers could be working for paying clients.

I say open the floodgates and bring on all the counter suits that can be mustered. Every single kernel contributor should be suing SCO right now for infringing their copyrights through illegal distribution of their code.

If you then check out The Canopy Group website you will see the following as board members

Ralph Yarro - CEO & Presedent
Darcy Motto - Vice President, Treasurer and Chief Financial Officer

This gives the Canopy group at least a 15% stake in SCO, possibly more.
If you look at SCO's board and then have a look at their share trading, you see the following:-

Charles BROUGHTON (VP world ops) sold about 120,000 USD worth of shares in the last two months
Robert BENCH (CFO) sold about 120K USD in last few months
Jeff HUNSAKER (s. VP)sold about 120K USD in last few months
Other than McBride (CEO) most of the board have ofloaded shares in the last month or two. To give you an idea of the "peak" of share selling. According to the Nasdaq the number of "insider" trades (i.e. board members) in the last 12 months was 15, and 12 (all of which were sales) of those were in the last 3 months (or as its know just after the Linux thing).

Yarro and Mott both also sit on the board of SCO.

A post on the Yahoo SCOX board points to this note on the SCO website regarding SCO Forum that says it is postponed until Autumn 2003.

Is this an old note and do they think August is Autumn or is this the first clue that they are postponing it until later?

So, besides all the other, umm, "interesting" claims and other crap going on, they're playing games with their names to obfuscate the origins of their company and how they got the licenses.

If you look at the press release, they're very upfront about how "Old SCO" bought the rights to UNIX from Novell in 1995 (since transferring those rights from company to company is a big deal).

But they don't say anything about how Old SCO transferred the rights to Caldera, which then changed its name from Caldera to SCO. The second transfer is JUST as important as the first, and I wonder why they didn't mention it. And the name change could not have been done in good faith, or if it had been done in good faith, they would have made it clearer in the press release. I think they're trolling for easy money from people who don't want to investigate this closely.

So, that's the way it worked:

1. Novell sold some rights to Old SCO/Tarantella.

2. Old SCO Tarantella sold its rights to Calders/SCO

3. Calders changed its name to SCO.

It's a shell game. :)

And it also means that they were probably planning this shit as far back as when Calders bought the licenses from Old SCO and they changed their name to SCO.

this page gives a phone number to call to discuss the linux license. people should ring up 1-800 726-8649 and hear sco out. and *please* remember to write down the details on all linux systems you have. it would be terribly annoying if you forgot a detail like the version of linux or the details for another machine and had to call back.

While the lawsuits being defended by IBM and filed by Red Hat are likely to put an end to The SCO Group's menace to the Free Software community, I don't think simply putting the company out of business is likely to prevent us from being threatened this way again by other companies who are enemies to our community. I feel we need to send a stronger message.

If we all work together, we can put the executives of the SCO Group in prison where they belong.

If you live in the U.S., please write a letter to your state Attorney General. If you live elsewhere, please write your national or provincial law enforcement authorities. Please ask that the SCO Group be prosecuted for criminal fraud and extortion.

Stockholders in any of the affected companies - either SCO or its competitors - may wish to avail themselves of the Security and Exchange Commission's Investor Complaint Form to ask that something be done about this. You may not even be aware that you have standing to complain: if you invest in any mutual funds that hold shares in SCO, IBM, Red Hat or any other company that offers Linux products or services, then you have a right to ask the SEC to investigate.
