Re:blogs
The New York Times first opened up their archives to the bloggers over a year ago. At the time, I really wondered why the Grey Lady would give it away like that. Kowtowing to the blogosphere (barf), while ruthlessly nickel-and-diming all the poor schlubs who just wanted to do some research or get their work done.
But now it makes perfect sense! They were in it for the PageRank(TM)! (At least they didn't resort to a lawsuit, unlike these guys!)
However, in view of the upcoming IPO and Google's increasing attempts to work their grubby little fingers into every facet of your life, you have to wonder if Google is gaining more power than any publicly traded mega-corporation should have. -
Even SearchKing
Even SearchKing is better known than Gigablast... and SearchKing pretty much faded into obscurity after the Google/SearchKing problems a while back.
-
Re:Bayes Wars
Perhaps somebody smart enough could start a business defeating Googles filters...
There are plenty of businesses which try and do this. I recall SearchKing getting into a bit of a flap with Google, when a bunch of their customers' sites were downgraded. There are probably thousands of little piss-pot companies that will link to your page a million times for a hundred bucks or some such garbage. People should recognize this for what it is: web-spam. Millions of fake, garbage sites set up for the sole purpose of vastly decreasing the signal to noise ratio, until you can't help but see at least a bit of their trash, at which point they make a dollar. -
Re:Lesson
...And I found a document at SearchKing itself where they have commented it.
Here.

Clueless, a Complete Asshole, or Both? From the article (and the letter published by SearchKing):
SearchKing never broke a law, yet was accused, judged and executed without so much as a notice of intent. This affected thousands of innocent people without just cause.
Hello? He filed a lawsuit against Google, alleging that it committed improprieties. He called Google a monopoly and said that its actions were intended to squash competition. He's wrongfully accused Google of breaking a variety of laws and then has the audicity to claim that he's the victim?
A wake-up call: SearchKing was never accused of anything. Bob Massa publically stated that SearchKing was selling links in an attempt to boost his customers' PageRanks; a practice explicitly forbidden by Google (as described here):
However, certain actions such as cloaking, writing text that can be seen by search engines but not by users, or setting up pages/links with the sole purpose of fooling search engines may result in permanent removal from our index. If you think your site may fall into this category, you might try 'cleaning up' the page and sending a re-inclusion request to help@google.com. We do not make any guarantees about if or when we will re-include your site.
This is obviously Google's prerogative and, moreover, what's best for Google's users (and the Internet) as a whole. So while SearchKing CEO Bob Massa is whining about Google attempting "to restrict the legal business of another without due process" and the "thousands of innocent people" that have suffered because of this decision, the truth of it is that he's the one trying to restrict the legal business of another and reduce the usability of Google, thereby negatively affecting the vast majority of Internet users.
That cements the asshole part. The cluelessness is even easier to prove. The lawsuit obviously never had a leg to stand on and everyone knew it. And while some might attribute it to a shrewd marketing move by Massa, it's garnered only niche coverage and a lot of negative publicity; the inevitable loss has effectively ended his business of attempting to sell PageRank and cost him legal fees besides. He releases a settlement offer, too, which means he either expects us to believe that this suit was ever about a noble endeavor to better the Internet or he honestly believed that there exists some legal standard by which he might've won the case. Yet more evidence: his settlement offer demands that Google put sites who have broken Google's terms of service on notice -- but Google's policy concerning people trying to artificially inflate PageRank is both obvious and public. His whole settlement offer would be laughable if it weren't so tragically stupid.
My vote, then, is that Bob Massa is both clueless and a complete asshole. This ought to be a poll, really.

Re:LessonDid you read the article? This had nothing to do with patents or copyrights...
Actually, that's not true. If you read the actual judgement here , you'll find that the strongest argument centered around patents, in the following vein:
(1) Google claimed its rankings were opinion and thus protected by the First Amendment.
(2) Search King claimed that they couldn't be opinions precisely because Google holds a patent on the process used to make them.
(3) The judge found Search King's argument "not wholly without merit" (p. 6), but that Google could still alter the result of that patented process in a subjective manner and thus it was protected as free speech.
The critical argument by Search King (p. 5):
First, Search King notes that Lawrence Page ("Page"), the founder of Google and the inventor of the PageRank system, holds a U.S. patent on the system. Search King argues that... because patented products or processes must be replicable... the PageRank system must be objective in nature, and therefore capable of being proven true or false.

Re:googles been going downhill
Perhaps googles time has passed and its time for a NEW king of search engines anyhow??
Perhaps..... SearchKing!!! -
Tax-deductible?!?I couldn't believe what you said about SearchKing claiming to be a 501(c)(3), but a cursory mousing revealed this rider at the bottom of their donation form:
NOTICE.
THIS IS NOT A SALE. YOU ARE MAKING A $20 DONATION TO SEARCHKING, INC. WITH THE UNDERSTANDING THAT THE MONEY IS TO BE USED TO PAY LEGAL EXPENSES IN A LAWSUIT WITH GOOGLE TECHNOLOGIES, INC.
IN EXCHANGE FOR YOUR $20 DONATION, WE WILL SEND YOU A PASSWORD THAT WILL ALLOW YOU ACCESS TO ALL AREAS OF THIS WEBSITE.
THIS IS NOT A SALE. THERE IS NO REFUND OR CHARGEBACKS. BY FILLING OUT THIS FORM AND TYPING IN YOUR NAME AS IT APPEARS ON YOUR CHECK OR CREDIT CARD, YOU ARE AGREEING THAT YOU UNDERSTAND THAT THIS NOT A SALE BUT RATHER A DONATION THAT IS TAX DEDUCTIBLE.
(emphasis mine)
-
Enough is ENOUGH!
I find this lawsuit to be more than ridiculous. I find it disgusting.
To sue Google for acting in its best interest and with a view to retain its effectiveness and credibility is nothing short of despicable. Whether SearchKing did it because it truly believes it is right or because it seeks publicity is irrelevant. Its actions are illogical:
a) SearchKing has come to depend on Google (as it stated) because Google can be trusted.
b) Google can be trusted because its algorithms are pretty accurate.
c) SearchKing tried to interfere with those algorithms, seeking INACCURATE results from Google.
d) Google modified said algorithms to counterbalance the interference, seeking its much-valued accuracy.
e) SearchKing sues Google.
I've read the LawMeme analysis and SearchKing's opinions and all I see is another unscrupulous dotcom trying to discredit a very respectable service to serve its own needs, regardless of the damage it may cause. So, fellow /.'ers, I propose we take an active role in this wretched little saga: I propose we write to EVERY SINGLE CLIENT displayed on SearchKing's site and tell them that we despise the SearchKing lawsuit against Google and that we will NOT visit, support, recommend or in any way help them until they have moved to another hosting service or convinced SearchKing to desist in their legal efforts. The same treatment should be directed at SearchKing's advertisers, even if one of them is, sadly, Penguin Computing.
Last time I checked, /. had over half a million subscribers. I think that should get their attention. Don't you?
Cheers,
Morel

SearchKing sucks anyway...
Their entire sit is built on gimmicks, and looks like it was designed with a very old version of frontpage.
FUCK THEM ALL.
Google, put down your foot, don't let them make you out to be a little bitch.
Questions from their site and my answers:
DID GOOGLE DO IT INTENTIONALLY? Who cares besides you!
CAN GOOGLE DO IT TO YOU? You bet, and it shouldn't be possible to file a lawsuit because of it!
WHAT CAN YOU DO IF THEY DO? Not a damned thing you fucking tools.
ARE THEY WORRIED ABOUT OTHER LAWSUITS? I hope they are not, if they do worry, it could harm the great results they provide.
What in the hell is wrong with the world? Why has their case made it this far?
I hope SearchKing realizes that they look like fools for doing this. What a bunch of babies.
And for google's search results later on... I suggest we all add this to our comments for the next couple days...
FUCK SearchKing

Google bomb?
Let's Google bomb them. Everyone add a link to their website/blog extolling the virtues of this internet moron whose actions are big fucking waste of time and money.
Heck, add an entire page of our favorite google bombs for our favorite sites like Scientology and the evil empire. -

They're made of brass, and the size of an elephantIf you go to http://www.searchking.com, there is a link at the top titled "Google Confesses". He makes a handful of references to the contents within the site, including legal documents, and of course, his own "personal conclusions" about the situation.
The paragraph that got me rolling was:
"In these documents, you will find answers, (according to google), to questions like:
DID GOOGLE DO IT INTENTIONALLY?
CAN GOOGLE DO IT TO YOU?
WHAT CAN YOU DO IF THEY DO?
HOW IMPORTANT IS PAGE RANK TO PLACEMENT?
ARE THEY WORRIED ABOUT OTHER LAWSUITS?
You can learn answers to these questions and more ---- but not for free. It's going to cost you $20 to see the documents. The $20 for the password to view these papers is not a sale. It is a donation to the SearchKing legal fund. "
W * O * W
That's so stupid it's just simply impressive. I have this morbid curiosity to find out just how many people would spend $20 to read this moron's "insights." Me thinks I've learned more from my cats.
I don't know whether to laugh or cry!
Google is a site designed to be a resource for US. That is their mission. They don't give a flying fsck about providing a profit center to some other company--nor should it be considered their responsibility to support.
Gads.
The apocalypse must certainly be arriving Monday. Or, at least, I hope it is.

Re:Searchking's Web Site Isn't Slashdotted.I don't know if they log searches, but going to Searchking: Google rocks should be a simple way of letting them know what you think if they do.
And if it doesn't, well, it uses up precious bandwidth, so it's a win-win case either way.

Searching for SearchKingIt's interesting to search for "SearchKing" on Google. Back when this story first hit Slashdot in October, SearchKing's website came up somewhere on the fourth page of listings on Google. Now it comes up as number one, but their PageRank still remains at 4. It shows that there is some behind-the-scenes results manipulation going on at Google... which of course is their perogative.
Another example was the Microsoft and "go to hell" incident which dissappeared from Google rather quickly once it became public.
Incidentally, searching for "SearchKing" on SearchKing doesn't even come up with SearchKing's front page, and the first result that is even close is number 7.
-
Searchking's Web Site Isn't Slashdotted.
Searchking's Web Site has a page of News about their lawsuit and Searchking's Comments on Google's Response to the Court and their attempt to get the public to pay $20 for more details. I wasn't that impressed with it, but maybe you'd have a different opinion....

SearchKing's Response to Google's Response
SearchKing has a posting of Google's response, presumably with commentary. The link can be found here but you have to pay $20 to the "Legal Defense Fund" to view the entire documentation.
Fortunately, my curiousity is outweighed by me desire to NOT give SearchKing money. -
SearchKing legal defense fund?SearchKing is offering the same legal summary documents for a fee!
From SearchKing's Google case site:
In these documents, you will find answers, (according to google), to questions like:
DID GOOGLE DO IT INTENTIONALLY?
CAN GOOGLE DO IT TO YOU?
WHAT CAN YOU DO IF THEY DO?

Re:Too Easy
Compare the searches made by Google and SearchKing:
SearchKing: Chess
Google: Chess
You'll see that Google even includes freechess (FICS) at the bottom, while SearchKing just turns up all the stores that pays him the most money and some other irrelevant sites AND then fills the rest of the page with ads!
SearchKing is nothing but a money-generating scam that defiles everything the Internet should be(come). If a judical system is any good, it should take this into consideration. If not, the lawyers and judges should be put to jail for wasting society resources. -
Re:The banned site is Searchking.com
Why not try searchking.com, for example? Bwahahahahahah.
because they don't even show up on their own search results
now THAT'S funny. -
Re:Hey look!
Non-disclosure agreements are a very, very common thing in business, ranging from not giving out annual financial statistic, to not giving away information and details about a source code. But why in Eris' name would a NDA be required to team up with a linkspammer? Something reeks of tunafish around here...

Sad to think that companies like ALTAVISTA, HOTBOT, NORTHERN LIGHT, YAHOO, and others were pretty much ruined in an all out assault on their search techinques by this Bob Massa goon. They should be SUING HIM for his actions. -
Re:Too EasyTrue, but Google is rapidly becoming the de facto standard for a lot of people, to the point that "google" is frequently used as a generic verb. If this keeps up, at some point they will achieve monopoly power even though numerous competitors exist, just like Microsoft with desktop operating systems.
In fact, the preliminary injunction pretty much argues that Google already has this monopoly power. For example, look at these quotes:
"...page ranking
... has become the identifiable measure of credibility""Google, as the provider of a ranking system upon which the internet community relies, must apply the system in a manner that is not arbitrary, nor aimed at restraint of trade"
My feeling is that SearchKing is a little early to the party. Give it a couple of years and they might have a case though. -
hah
Search for SearchKing on SearchKing, SearchKing.com not found in the top 10 results...
Can you sue yourself for devaluating your own company's ranking on your own ranking site?

The banned site is Searchking.com
Searchking.de is not the banned site. The banned site is Searchking.com [www.searchking].
It is not alegally an algorithm problem. It's about one big company banning and smashing a number of smaller companys who dare to sell what Google may only Google has the right to do: put you on top of the result search, paying for Google Adwords ads.
The guys at SK think Google has manualy degraded them, and hundreds of innocent parners sites, as a penalty for seling tex based ads, as a way to improve its Google PageRank(TM).
I personally belive SK may has done a lot of stupid things, one of them suing Google.
But I also think we should be more aware of who the Google Guys realy are: agressive advertising dealers, who may think are the only guys arround entitle to put a price to who important our sites are, with the power to ban your site. -

The first result is ... er, interesting
here are the results -

There could be something here below the surface...
He clearly thinks that he is not doing anything wrong and claims to have tried to raise the issue of page rankings and his business model with Google...
From his own forums section.
Your search engine is very good at detecting things like link farms and hidden tricks. I'm certainly not asking for any special treatment. If I, or anyone in my network, tries to take advantage by lying, cheating or stealing, I would expect them to have to suffer the consequences the same as anyone else. I'm only asking that you look beyond the webmaster world posts and see that these niche sites need the respect and the income that a high PR deserves. They work hard and the reason they have those high PR's is that they don't spam. Please don't penalize them for trying to capitalize on the fact that Google rewarded their efforts.
He is certainly trying to imply by this post and others, that Google is unfairly targeting him because he has chosen to use their page ranking system to help set the prices he charges for ad space on the web sites that he hosts for his customers.
His most recent post tries to explain some of the reasons for his suit.
He claims to not be inflating rankings at all and just using the rankings to set his ad fees. If that is the case, he may have a claim but I guess that is for the lawyers to decide.
If he is manipulating rankings, he deserves to go down in flames. If Google is 'picking' on him cause he is trying to earn more from Google's rankings but he is not 'cooking' the numbers, he may have a case. Read the posts. The web site operators appear to benefit from the higher rankings by getting more for the hosted ads. Just compensation for good work building good sites. Hard to say this is clear-cut without seeing Google's response. -

Pot, kettle, etc, etc... Its funny that the top link here
is my site, and I sure don't recall giving permission to him to use it. I guess its all a matter of perspective.
/me fires off a message to the searchking himself.
Thanks for the heads up.

Don't visit SearchKing.com
Unless you want to help them sue Google. And/Or help them line their pockets just before they go out of business... SearchKing.com has anticipated getting a lot of press from sueing Google.
Either they have a true(in their eyes) grievence with Google. Or they have planned for a lot of press to come from the lawsuit. From what they have listed on the page have linked, it would seem that they just wanted the press. -

"Devalued"? *snort*According to their PR release, SearchKing's been around since 1997 and is located in Oklahoma City.
I've been yahooing/altavista-ing/metacrawling/googling (in that order, chronologically) since 1997, and lived in Oklahoma City since then, and I've never heard of these people before now.
I suspect they've got a lot of work ahead of them to prove devaluation.

Doesn't seem like a search engine to me...
I did a search on SearchKing to find out why it sucks, but none of the hits were relevant. I guess that's why SearchKing sucks!
But wait, there's more! I searched for the same thing in Google and found this site, which is part of SearchKing. It may not explain why SearchKing sucks, but I think it might answer the question, "What are these guys smoking?"
