Re:Clueless haters...
It's one of the design patents Apple is claiming.
Apple is also claiming other design patents:

http://www.google.com/patents?id=bRvVAAAAEBAJ&printsec=abstract&zoom=4#v=onepage&q&f=falseIcons are eligible for design patents (OS X's wire trash icon is an example), however the iOS icons are registered as trade dress; I've been unable to find design patents for them and it's unlikely that Apple wouldn't have made claims against them.

Re:This is why!
You can't buy a patent to bury the technology. See, patents work on an exchange: The public gives you a temporary monopoly on your invention and we get to know how it works (full disclosure).
Your uncles patent isn't lost in some archive, it's in a searchable database: http://www.uspto.gov/

Patent maintenance fees
Perhaps quasius was confusing maintenance fees, reissues, and a lot of other obscure aspects of U.S. patent law that aren't discussed very often even on Slashdot. A U.S. patent lasts 3.5 years after issue, with three renewals available at extra cost. The first two renewals are 4 years each, and the third is to 20 years after filing or 17 years after issue.

Re:They're already valid
Yes, I can see you are a US patent attorney but you don't seem knowledgeable of EU law (which has to include laws from all countries as we are not a federal state). The difference between what is patenteable in the US and in the EU is immense. And the interpretation of patents done by courts is also much different.
With all of its problems, the EU has had a much superior stance (in my position) regarding big-corporation as Europe's mentality is much different from US.
For your information, here is article 52 of the European Patent Convention:
(1) European patents shall be granted for any inventions, in all fields of technology, provided that they are new, involve an inventive step and are susceptible of industrial application. (2) The following in particular shall not be regarded as inventions within the meaning of paragraph 1: (a) discoveries, scientific theories and mathematical methods; (b) aesthetic creations; (c) schemes, rules and methods for performing mental acts, playing games or doing business, and programs for computers; (d) presentations of information.
Patents such as this (Microsoft's 'is not' operator) only exist in the US. Sometimes it is hard to understand how can an country with so many intelligent people produce such intellectual atrocities? O, wait...

Bethesda owns "Scrolls" trademark?
I think they (both) might want to check with Steven Mancinelli. Notch's defense would run to "I can't be infringing on Bethesda's trademark, since this other trademark was plainly issued to the pertinent domain AND is more directly infringed if anyone is.

Re:is it just me
You can read the patent and judge for yourself. The abstract is as follows:
Systems and methods for increasing the execution speed of virtual machine instructions for a function are provided. A portion of the virtual machine instructions of the function are compiled into native machine instructions so that the function includes both virtual and native machine instructions. Execution of the native machine instructions may be accomplished by overwriting a virtual machine instruction of the function with a virtual machine instruction that specifies execution of the native machine instructions. Additionally, the original virtual machine instruction may be stored so that the original virtual machine instructions can be regenerated.

Re:good news everyone
So where in the patent application do they mention a new protocol? They do mention an existing protocol....
In the other patent application they mention "a new document-format-preferred key (as a MIME media type), which enables the printer to specify a "preferred" document format out of all of the document formats that are supported by the printer", which is a new IPP key, and also mention "a new "URF-supported key" to a discovery protocol and a transport protocol. More specifically, some embodiments have added a new URF-supported key to the discovery protocol as part of a Bonjour(TM) TXT record, and have also added an analogous URF-supported key to the transport protocol as a new printer description attribute for the IPP protocol", where URF is presumably the Universal Raster Format mentioned in other comments. It also mentions "a new device-independent bitmap container for printer data".
If the patent is granted, I suspect licensing it to put into your printer will be easy and cheap, to encourage lots of printers to support it, but licensing it to put into, for example, your smartphone OS might not be quite so easy or cheap.

Re:What about IPP
http://en.wikipedia.org/wiki/Internet_Printing_Protocol
You mean the Internet Printing Protocol to which both the first patent application and the second application refer?
CUPS is based on it...
You mean the CUPS that the first inventor in the inventor lists for both applications wrote?

Re:good news everyone
So, the printer manufacturer's choice is:
1. License PostScript from Adobe.
2. License this new protocol from Apple. So where in the patent application do they mention a new protocol? They do mention an existing protocol....
-
Re:good news everyone
So, rather than have a "driver" the computer has to know a new means of interrogating the capabilities of the printer
Or an existing means of interrogating the capabilities of the printer (which they call out by name in the patent application).
and then convert files to a format that the printer can handle... Right?
Yup, or ask some server "in the cloud" to do it, as the patent application says.

To Read The Fine Patent Application...
It's Patent Application 20110194140 ; here's the application.
And, yes, that's Michael "Mr. CUPS" Sweet in the Inventors list.

Re:Et tu, Brute?
Google has 754 patents filed by them. They filed the first in 2001. It was for refining the results of a search by relevance. They have not changed a bit. You just believed their PR.
A search engine for searching a corpus improves the relevancy of the results by refining a standard relevancy score based on the interconnectivity of the initially returned set of documents. The search engine obtains an initial set of relevant documents by matching a user's search terms to an index of a corpus. A re-ranking component in the search engine then refines the initially returned document rankings so that documents that are frequently cited in the initial set of relevant documents are preferred over documents that are less frequently cited within the initial set.
I don't think google is evil. They are just very hypocritical.

Re:Prior art?
It was filed in 1999, and apparently there were foreign patents in 1998.
Ridiculous.
The patent is filled with examples referring to Windows 95, AUTOEXEC.BAT and CONFIG.SYS, which is rather hilarious. Basically the implementation is a cache of the memory state at boot, after reading through all the system configuration. If the system configuration hasn't changed (tested a couple of simple ways), the cache gets read in. If it has, then the hardware state and configuration gets evaluated the regular (slow) way. Not only does this patent almost certainly have prior art, not only is it overly broad, but it is FRICKING OBVIOUS.
-
The usual overly broad software patent
Having read the patent (RE40,092 in case anyone is interested), it's claims are so broad and complete that any implementation of any kind of acceleration of the booting process would violate it. In fact, they're so complete, that any hibernate mode would also likely violate them, which suggests that it shouldn't be hard to find prior art since hibernate modes substantially predate this patent. I suspect that Apple will use prior art to get the patent invalidated, but it's tough to say for sure.
The real problem with this patent, though, is the standard one for software patents: it's just a set of general ideas about what you could do to make booting faster (store configuration data, check configuration data, write some or all pages of memory to disk, read some or all pages of memory from disk) with nothing that could actually be described as a specific invention or process. As such, the patent (as is almost always the case with software patents) is so broad that it's ridiculous. They've basically been granted a patent on any feasible idea for speeding up the boot process.

Patents for the "rock-like" material
The longest DVD archival life achievable today is provided with the new MDISC—a revolutionary optical disc technology developed by Dr. Barry Lunt and Dr. Matt Linford of Brigham Young University and manufactured by Utah-based Millenniata, Inc. –

Re:Will PageRank be opensourced
You're a pathetic Google apologist.
Patents are required to be documented in public records. This is the patent file for PageRank
So, while Google is complaining that their competitors are using "evil" patents against them, you're saying that they themselves decided to patent PageRank, even at the cost of reducing the quality of their product?
What a great company with strong moral principles.

coming to you soon: Google Instant Pages(tm).

Re:Sounds like it's the one to buy then
Apple's got the patent: it's patent no. 7,657,849. They could sue if it falls under the claims of the patent - it's clearly worded to be separate to a physical unlock switch.

Word Mark MICROSOFT WINDOWS
Didn't even bother to do the couple of minutes of research instead of making false claims?
-
Re:Yes, trademark is dead, as of July 7, 2011
The applicant explicitly abandoned the trademark "BITCOIN". They formally abandoned it on July 7 via the USPTO's online system, and immediately followed up with express mail. This is quite unusual. They'd only filed the application on June 30, and the USPTO hadn't even replied yet.
It's dead.
Lovely currency you have there. Shame if something should happen to it.

Nope. Sorry boyo:

Re:Patent system is broken!
That's a very good synopsis.
Except for the part where it's not actually true.
By the way, there's already a process for third parties to submit prior art into an application:
http://www.uspto.gov/web/offices/pac/mpep/documents/1100_1134_01.htm
However, this process is rather limited in scope and costs a fee. You could also send copies of pertinent prior art to the applicant and/or his attorney, both of whom have a duty to disclose to the USPTO any prior art references that are pertinent to patentability, but you have no guarantee that they will abide by their duty and actually submit the references.

Where's the method?
All these patents start off with "a method and system for blah".
But where's the method?
All this is, is a bland description of how such a system might work. It's not a system or method itself.
This is so pathetic the lawyer$ didn't even bother to create complete sentences:
[0048] Till date presently available web technologies and other communication media are more or less passive in nature. The concept of blogging providing an effective active medium for knowledge sharing. Still is restrictive and lacks organizer and other management mechanisms to derive most relevant as well as real time knowledge through active dialog.
Is that a sentence?
If this is the state of tech patents today, it's truly pathetic. This is nothing more than a UserLand-esque rant in legalese on current and future possibilities in e-mail.
Also see here.

Re:Patents
The patent is not about phones. The Claim #1 is about "A computer-based system for detecting structures in data and performing actions on detected structures". Apple was not designing phones back in 1996.
