Windows Refund Day II

pbody writes "Sorry if this is rehashing an old topic, but I was looking for advice on how to try to get a refund for the copy of XP that is coming with the laptop I just bought when I came across this on LinuxJournal about windowsrefund.net. They are organizing "Windows Refund Day II" on January 23, 2003 -- which coincides with the LinuxWorld Expo in NYC. Knowing how the first refund day turned out, how many out there are going to the Expo and are thinking about participating? For that matter, has anybody had any luck at all getting a refund from a vendor lately?"

    No. You would just need a nice rainbow scarf and a pink vw beetle to go with it. Flamebait aside, last I checked every Mac came with an Apple OS tax also. Have you tried getting a refund from Apple when you installed Yellow Dog instead of OS (I wish I was Windows) X.

    I agree with you, except for this one itsy bitsy problem: Microsoft is a monopoly.

    If their "Package" included Mandrake, Redhat, BSD, or some other alternate operating system then no one here would be demanding a refund i imagine.

    Bull, I didn't accept the EULA at time of purchase! Its the EULA that says they can surf my personal files thats the problem, you MUST agree to it to use the evil empires software...if you do NOT agree, you may get a refund.

    Ever heard of UCITA?

    The UCITA does not say that you need to agree to an EULA in order to use the software. You are guaranteed the right to use software which you legally purchase by federal law.

    If you don't like it, don't buy, it's really that simple.

    He could read slashdot once in a while.

    He should be able to get anything the seller or state law allows him to get. If the seller doesn't grant refunds, and state law only guarantees refunds of complete products, then no.

    Why? You are automatically assuming he's a troublemaker, and like I said, it makes you sound pretty prejudiced.

    Because most slashdot readers, especially militant ones like the poster, already know about the Microsoft EULA.

    Microsoft is dictating terms after the sale with the EULA.

    Maybe they're trying to, but EULAs are noneffective.

    I think you'll find that everywhere advertises it as Windows, not "A CD that contains Windows, which you may license if you accept the terms inside the box that you only get after you pay us".

    But none of that is applicable for most users, because most users don't need to agree to the EULA in the first place.

    If that's true, then why does it exist in the first place?

    To scare people.
