RIAA Loses DMCA Subpoena Case Against Charter
BrynM writes "According to an opinion published today (PDF), the RIAA has lost its case against Charter Communications regarding subpoenas for the cable ISP's users to be identified for copyright infringement in the Eastern District of Missouri. You may remember that Charter Communications filed a motion to block the RIAA's subpoena back in late 2003. Now Charter has prevailed. Here's the blurb from the Court 'Civil case - Digital Millennium Copyright Act. District court erred in issuing subpoenas on internet providers to obtain personal information about the providers' subscribers who were alleged to be transmitting copyrighted works via the internet through peer-to-peer programs; the internet providers' function was limited to acting as a conduit for the allegedly copyrighted material, and Section 512(h) of the Act does not authorize subpoenas in such circumstances; case remanded with directions. Since when are judges not corrupt? Since when don't judges use their position of power to shape law through interpretation, sway juries, and the like? Judges who are appointed, and who owe 'favors' to those who did the appointing. Judges who have the will and arrogance to put people in jail without them having any recourse. Judges who instruct the juries on how they should or shouldn't view various evidence and testimony, and thus the corresponding guilt of the defendant. Judges who 'explain' the law to juries, so that they 'can understand the complexity of the law'. Judges who 'interpret' laws, adding their own twists as to the 'intent' behind the law, and finding you guilty despite such readings going far beyond the plain text of the written law (yes, that happened to me).
Judges, corrupted by power, become miniature tyrants who are nearly impossible to remove, and whose damage by wrongly putting people in jail or fining them can only rarely be undone at great expense.
And the great part about all of this is that the people who have first-hand knowledge of this are largely in jail, out of harms way, effectively removing any real chance that this broken system will ever get fixed.
