Canadian Man Pleads Guilty In Celebrity Hacking and Harrassment Case
FuzzNugget writes "A 25-year-old man from Abbotsford, British Columbia has plead guilty to several charges involving the unauthorized access to a computer and phone belonging to singer Carly Rae Jepsen, who also hails from BC. It's alleged that after obtaining nude photos from the singer's computer and phone, he attempted to sell them to media outlets. The allegations also include releasing a fake sex tape claming to be of the celebrity. As a result, he was charged with a number of offenses, from unauthorized use of computer to (oddly) fraudulently obtaining telecommunications services, mischief to data, identity fraud, and possession of stolen property. It will be interesting to watch this unfold and see how Canada's laws on computer-based crimes compare to those of the U.S., particularly the notorious Computer Fraud and Abuse Act."

When it comes to the supposed criminal justice farce America leads the way. Not since the Salem witch trials has more sick or perverted use of law been used to punish minor offenses. We can make the ancient Roman circus look like a mild and gentle event. Hacking into email is surely worse than murder in our system.

I don't see what's odd about the charge for fraudulently obtaining telecommunications services.
If she pays for her voicemail and internet and he accesses that voicemail as her, eg. using her pin, or remote controls her computer and uses it to send data to him (again on her dime), then he's fraudulently using her services.
Back in the early days of prosecuting crackers/hackers they used the 'theft of electricity' laws to nail them because there weren't any laws to cover their actions. So if you penetrated a computer at location A they would nail you for the electricity used while that machine was under your control, as the victim would be paying for the power used by you.
Celebrity? Never heard of them.
The one regarding " fraudulently obtaining telecommunications services" is pretty straight forward.
326. (1) Every one commits theft who fraudulently, maliciously, or without colour of right,
(a) abstracts, consumes or uses electricity or gas or causes it to be wasted or diverted; or
(b) uses any telecommunication facility or obtains any telecommunication service.
Noting:
(2) In this section and section 327, "telecommunication" means any transmission, emission or reception of signs, signals, writing, images or sounds or intelligence of any nature by wire, radio, visual or other electromagnetic system.
That charge can be laid against someone who illegally uses access to a telecommunication service--meaning phones, illegal wiretaps, and so on. Also including breaking into wifi networks and so on.

As far as this clothist is concerned, anyone who loads nude photos of themself onto a telecom- or Internet-connected device should expect it to turn up elsewhere.

I am at a loss as to why people and in particular, celebrities (regardless of how minor) continue to take nude pictures on their cell phones. They have to or should know by now that phones go missing, computers get hacked and all of those pictures can and will wind up on the internet. This has happened so many times in the past with the releases being quite publicly discussed and yet there seems to be no end to people shooting pictures of themselves which they do not want the public to see.
The worst issue is with teens sending pictures to their girlfriend / boyfriend, trusting them and believing that they will always be together as these pictures can be quite damaging to the individual if / when released to their peers. I guess we still need to educate the masses about the risks inherent to these types of media devices.

That's a perfect phrase to describe the future dystopian vision I have been anticipating for years:
The police snooping any and all data at will (with the full approval of the courts), under the guise of investigating possible "mischief to data".
It's the perfect phrase to use by the authorities for a massive power grab.
