Lawmaker's Facebook Rant Threatens Media For "Unauthorized" Use of His Name
An anonymous reader points out that Frederick County Councilman Kirby Delauter may be in need of a First Amendment lesson. "Apparently, a local Maryland politician ditched his civics class the day press freedoms were discussed. How else to explain Frederick County Councilman Kirby Delauter's recent Facebook rant in which he threatened a local newspaper with litigation because—wait for it—his name was used in print without his permission. 'Use my name again unauthorized and you'll be paying for an Attorney. Your rights stop where mine start,' Kirby Delauter, the councilman, posted on his Facebook page. He added: 'So let me be clear.........do not contact me and do not use my name or reference me in an authorized form in the future.'"

How are the people to know what government officials are doing/saying/thinking if a newspaper or anyone else can't attach a name to a piece about them?
What I have to say will probably provoke a response from Kirby Delauter. He may label me “philopolemical” or even “lawless”. I realize and accept that as a consequence of what I am about to say. However, I do indubitably hope that Kirby will read everything I have to say before labeling me. First and foremost, the hour is late indeed. Fortunately, it's not yet too late to banish intolerance.
It would be nice to say that pudibund fainéantism doesn't exist anymore but we all know that it does. Prudence is no vice. Cowardice—especially Kirby's counterproductive form of it—is.
Why doesn't Kirby realize that his head is so far in rectal defilade it would require major surgery to extricate it? Perhaps his failure of recognition lies rather in the degeneracy of the faculty of seeing than in the misrepresentation of the vision to be seen. It may be also confessed that Kirby's attempts to destroy the sovereignty of all nations and every feeling or expression of patriotism are much worse than mere exclusionism. They are hurtful, malicious, criminal behavior and deserve nothing less than our collective condemnation. He counts lamebrained philosophasters as his friends. Unfortunately for Kirby, these are hired friends, false friends, friends incapable of realizing for a moment that he is always prating about how conscienceless, cullionly boneheads aren't ever whiney. (He used to say that his canards are all sweetness and light, but the evidence is too contrary so he's given up on that score.)
Let's get reasonable; Kirby has become a patsy to his own malevolence. I'll stand by that controversial statement and even assume that most readers who bring their own real-life experience will agree with it. At a bare minimum, Kirby's pronouncements are a load of bunk. I use this delightfully pejorative term, “bunk”—an alternative from the same page of my criminal-slang lexicon would serve just as well—because this is just simple math. That is, if A is more pugnacious than B, and B is more pugnacious than C, then A is more pugnacious than C, right? In case you don't have the secret decoder ring, A is an uppity nihilarian; B is a loopy, daffy schnorrer; and C is Kirby Delauter.
At first blush, it appears that my rogues' gallery includes not only Kirby but also all of the self-serving patrioteers who help Kirby brainwash the masses into submission. However, we cannot afford to waste our time, resources, and energy by dwelling upon inequities of the past. Instead, we must denounce those who claim that Kirby's writings are a veritable encyclopedia of everything that is directly pertinent to mankind's spiritual and intellectual development. Doing so would be significantly easier if more people were to understand that there are two challenges we must face if we wish to repair the alabandical world we have inherited from Kirby. The first challenge is to make his clumsy scare tactics understood, resisted, and made the object of deserved contempt by young and old alike. This is only slightly less difficult than the second challenge, which is to convey to people the knowledge that ophidian, moonstruck lummoxes are somehow fascinated by Kirby's rummy diablerie, just as a dove is sometimes charmed by a glittering serpent. Unfortunately for such people, Kirby relies heavily on “useful idiots”, that is, people who unwittingly do Kirby's dirty work for him. Without his swarms of useful idiots, Kirby would not have been able to conceal the fact that it's amazing to me that his legates actually proclaim that he can override nature. Not only must such people be mentally mutilated beyond hope of regeneration, but I, speaking as someone who is not an obtuse rumormonger, am growing weary of Kirby's repeated claims that all minorities are poor, stupid ghetto trash. So the guy is an ill-informed twit, a product of a typical Maryland public education. That's fine, because he's just a typical local guy who got a few dozen more votes than the next guy, and got a job as a minor league politician on a local county council.
But the problem is that we're seeing this sort of attitude (manifesting itself a bit differently) from the very top of the nation's executive branch. Lip service to promised "transparency," but in practice, draconian limitations on non-spin-approved access by journalists and photographers, reporters (and their entire organizations) being tapped and harassed if they don't convey the right message. Politicians have always had their favorite media contacts, but the ever-receding notion that they work for us is resulting in newly toxic levels of entitlement-itis and a sort of vaguely imperial bearing. That some elected officials have flirted with that from day one of the republic is not news, but the founders anticipated that and built in checks and balances. And some of those have been sorely tested, of late.
It will be interesting to see how the Attkisson suit plays out.

I live in Frederick Co. and these news outfits should really dig more deeply. There's a whole lot more to Kirby Delauter than just this one outburst. He's part of a group of disaffected commissioners angry at not getting his way when the county government moved from home rule to charter form.
As I recall, Kirby has also: ...and more.. way way more..
1. Ignored an Ethics commission ruling that barred his construction company from doing work for the county.
2. Violated MD's Open Meetings law (possibly on more than one occasion).
3. Voted for 25yr contracts for developers to give them land development rights without the developers putting any money into adequate roads, schools, etc.
His recent anger was sparked in part because in the previous form of county government, 3 top level republicans managed to have a solidified voting block for whatever they wanted. One of those 3 (Blaine Young) was voted out in the past election. Just prior to Blaine's departure Blaine resigned from his spot on the planning commission and then was placed back onto the planning commission by vote of the commissioners. This was thought to be something that couldn't be stopped; however, the MD AG stated that Blaine had not resigned his position as commissioner (only his position on the planning commission) as as such he couldn't be placed back onto the commission as he was ineligible. Since Blaine had close to 1M in developer dollars to (probably) pay back in favors, it's likely this angered the republican constituency very much.
When the form of government moved to the charter form, it was assumed by the republicans that Shreve would take the president spot but the democrats did something the republicans appeared to not expect, they voted for a much more moderate republican to be president of the county commissioners.
Angered by this slight to his long-time republican cohort (Shreve), Delauter has been rather angry of late.
Shreve and Delauter blame the FNP (Frederick News Post) for having a very liberal bias that cost Blaine his position and Shreve the presidency of the commission. As such, the outburst was primed to happen.
So yeah, welcome to our local politics. If our local sheriff weren't such an utter useless waste of skin then perhaps we'd get an investigation into possible wrongdoing with regards to violations of law but "Chuckles" is a worthless bag of skin that feels much more at home teaching his deputies how to choke to death mentally impaired people.
(That's a whole different story... another one in which it appears the prosecutor only provided evidence to a grand jury (evidence provided by the sheriff's office about sheriff's deputies) that was likely to exonerate deputies instead of any that was inculpatory as well.)
I like living here.. but in a lot of ways this county sucks. If I wasn't painfully aware that no place is perfect, I'd sell my house and move.

I actively spread the word in the last election that they should by no means vote for Kirby Delauter. The only thing he cares about is the size of his bank account.
He's proved himself a hot head over the last 4 years he was a county commissioner, and has in no way changed since we changed to a charter government and he was elected as a county councilman.

Many public officials probably sympathize with the duds rant because reporters often get it wrong or only report a sensational part of a statement or meeting and thereby cause people to believe something different than reality. Censoring the press is not an answer however. Thankfully, it isn't even an option. The only 'cure' for poor and sensationalized reporting is a well-informed electorate who checks things out before believing what they read. Sadly, there is a lot of room for improvement in this area. Kirby needs to go back to civics class to inform himself of his duties, responsibilities, and obligations. Its kind of scary to think an elected politician actually believes that the press can't quote him or use his name. No, it's real scary!
