This post is ridiculous. The advancement here isn't a better submarine. It's using ballast to raise this submersible and then having it glide forward as it descends again. It's not something you'd use for stringing cable (surface vessels are quite capable) or rescuing people trapped underwater (existing submarines are better).

You are way off target.Coke giving away free samples is in no way the same thing as what the MS anti-trust suit was about. The rub came in when MS was, in their own words, "cutting off the air supply" of Netscape by giving away a product with their OS that made it impossible for Netscape to sell its browser.

There were many other facets. Resellers (PC manufacturers) faced all kinds of pricing hijinks if they installed competing products (Netscape, Linux, etc.) on their hardware. Since these hardware vendors are hugely dependent on the pricing whims of MS for the OS installed on the majority of the computers they sold, they were disinclined to sell boxes with other OS because they would receive pricing retribution from Microsoft. If you were / are a company trying to create an alternative OS, it was very difficult finding hardware vendors to partner with.

As for your claim about the IBM/Oracle/Sun "co-opting the political / legal system", you are full of crap. As with anyone who has been wronged, they are free to file lawsuits against criminals. Microsoft was found GUILTY in a US court of abusing its monopoly. Sounds like Netscape, Sun, et. al. weren't completely talking out of their asses. We gotta do what they say or your CD won't be carried in 32,000 stores across the country."

That case was not the same as what I'm talking about. HP (or any other inkjet company) has not tried to sue the companies selling inkjet refill kits. The Lexmark case is about how a laserprinter toner cartridge manufacturer (SCC) reverse-engineered the circuitry on the Lexmark toner carts and sold their own compatible toner carts. It would be the same if I were talking about HP suing people who are selling HP compatible inkjet cartridges.

Inkjet refill kits circumvent the built-in obsolesence of the inkjet cartridges. it's a hardware hack that allows the user to use the firmware of the carts beyond its intended use of x volume of ink.

Hopefully someone will come up with a similar hack for those disposable DVDs that recently hit the market. When they are opened, Oxygen begins a chemical reaction that limits their usage to a few days. Perhaps a device could be constructed that would open the packages while submerged in a clear liquid such as epoxy. This liquid would bond to the entire surface of the disc such that when it is removed, it blocks the reaction with oxygen and allows the discs to be played for much longer.

I appreciate you describing the perspective of the DMCA on this. I doubt, however, that the Ritz camera people will bother taking anyone to court over this because the hacking is of a physical nature. There is little precedent for the DMCA to be used on physical hacks.

A good opportunity would be for HP to prosecute the people who make inkjet refill kits. HP sells their printers at a loss and intends to make money from the cartrdiges. They put proprietary electronics unnecessarily on the carts so competing vendors can't fabricate compatible cartridges. Nothing stops the user (owner) from puncturing the cart and injecting fresh ink into it. This is pretty similar to making your own cable to connect to one of these cameras and downloading the pictures yourself.

I would say, though, that the people behind a concept like this are not the tech-savvy individuals who would even consider that the product might be hacked which destroys their 'give away the razor, sell the blades' business model. Eventually, the MBA textbooks will be updated with case studies of the eyeOpener, CueCat, and the Ritz Disposable Digital camera. Future marketers will know that they have to ensure that their free razor blades can't be used without their proprietary blades. One thing I haven't seen a lot of discussion of is why MS hasn't stepped forward to do anything about popups and spam before this. Enjoying their monopoly in the OS arena, they've established a browser monopoly and have no competitive pressure to improve their browser. IE users have been subjected to torturous popup ads for a few years now. If you examine any of the MSN marketing materials (intentional alliteration), you'll see that they tout popup blocking as one of the advantages to their service.

If the company would improve its browser, they would have one less 'feature' in their MSN service.

Clear example of monopoly exploitation in one product (browser) to gain an advantage in another area (ISP service). Sure, every other ISP is offering pop-up blocking, but let's see how they implement this service patch. Wouldn't it be interesting if it sort of half-works, but is 100% effective for MSN users?
