The problem is lack of recall at a federal level.

In the real 9 to 5 world of the working class, if you fuck up your boss has the privilege of firing you.

You or I couldn't have created mickey as a ripoff of oswald and gotten away with it.

    Disney, however, could.

2 lines vs 100K I think qualifies as fair use.

    Simple.

Any rescue of MU's content would allow it to revive itself once the federal trial is over.

It's in the mafiaa's interest for MU to die.

The FBI as a political subdivision of the US government probably has sovereign immunity.

Lovelier still is when the site hosting your stuff gets gunshy and uses admin fiat to ban you anyway without even giving you a chance to submit a counternotice.

Why are they not being prosecuted for perjury?

I think it's perjury to falsely claim the right to act on behalf of the copyright holder on a DMCA notice.

    Wouldn't this be a 4th amendment issue instead of a 5th amendment?

If you are compelled to hand over the password it's pretty much the same as handing over physical keys.

    Indeed

In theory we already have the 4th amendment to cover what basically amounts to an electronic search.

    Here's an idea.

You know how counter-notices are required to be under penalty of perjury? How about requiring the original complaints to do likewise?

I think getting disbarred and locked up for 5 years is a nice incentive not to file a false notice.
