Just to add a little to what you said, Although this is technically true when viewed from the RFC specifics, spam software is perfectly capable of running within an SMTP server instance, where the message would be parsed further for more info on cc/bcc, etc.
But unfortunately that wont stop spammers. Spammers can send one message at a time to each recipient on their list. And what would distiguish them from a legit mailing list?

I doubt this will mean a reduction in price for any product. They price at market value and cut costs by outsourcing hoping to get a higher profit margin. This is what Carly means when she says "compete". Large companies are slaves to wallstreet where profit margins are watched by the hawks. When other large companies start to outsource and cut their bottom line while still pulling in the same profits their companies start to become more profitable for investors and hence more "competetive".

He could get around this by setting up an anonymous emailer on a server somewhere but in the end even that could be tracked down using very unsophisticated means that the FBI is certainly capable of (read: if you can sniff at the upstream ISP you basically have the keys to the city.)
But most likely they needed to "witness" the email being sent for legal reasons and prove beyond a reasonable doubt that the sender is the suspect; headers could be forged by the accuser and they probably needed to verify the accusation for later prosecution. If they are smart that is. Any Joe can create or modify a text file and make a false accusation.
