New devices and software may have bugs which affect performance. Patches may be required for correct performance when exposed to unexpected conditions.

Is security software supposed to be automagically immune to human error? Or is this another "Coders aren't employing secure coding practices" piece I've been reading for well over 3 years. "Validate your inputs" "check loops exit under all circumstances" etc etc. Woo. Insightful this ain't.

Pah, that's nothing. I have an app which tells me what the weather is outside! It even picks up where I am and tells me the local weather! I need never leave the house again! Unfortunately, there is no Vitamin D producing app, so my nails are fairly brittle. I might sue Apple over this.

On a side note, I had the idea last night of disposing with curtains completely and having all of my windows coated with e-Ink style technology to make them as opaque or translucent as I required. I wonder if anybody does this already.

EDIT*: It's called Smart Glass. I like the idea. I would want it to turn black instead of frosted, though. Cool for film watching. Sorry, this is very off-topic.

    * I opened a new tab and searched while the preview rendered.

The jury decides matters of fact, the Judge matters of law.

The jury has the responsibility to decide, firstly, if the facts of the case as presented by the prosecution and defense councils are in fact a breach of the law, as explained by the Judge. That is their primary role.

Their second (and mostly neglected) role is to hear the law explained to them, and decide if it is just. These 12 people, for however long the case goes on for, are the most powerful people in the courtroom, as they can stir up a world of shit if they think the law is either unjust, or being applied unjustly.

Most jurours wouldn't dream of going against the "will of the court" however most don't know they're immune from punishment for not following its direction. Unfortunately, however, almost no judge offers juries the notion of "jury nullification" as an option (they won't research it themselves) and instruct them to return "guilty" or "not guilty" as verdicts. Mostly because there is very little "new law" discussed in Crown court, and if it is it's typically appealed trough the Appeal, Supreme, and Lords.

IANAL, but I have been on jury duty, and know quite a few legal advisors, barristers, solicitors and magistrates. This is UK-applicable info, but I have a feeling the rules are similar in the US. Seeing as we colonised you.

Again, it's the system. If MS hadn't contested them and they had been found to be infringing at a later date, MS would lose the patents. If the patents are invalid, they're invalid, if they stand, then they have the option of licensing them out.

You know how if someone sells you a rock that keeps away tigers, and you never get to test it because you never go near tigers? I have a patent on that rock. If someone else makes a rock which does the same thing, I have to challenge their anti-big- cat-rock claim, or I lose the right to be the only person making a rock which stops you getting eaten when walking around safari parks.

I wish everyone was this honest, without exception. At least then you could give honest opinions and accept what you were told at face value.

Off topic, but my g/f asks me if she looks good in clothes, and accepts my answer. She got dead upset the first time I told her "yes, your ass does look fat in that dress." However after I explained that it was the fault of the dress, and that if she'd spend a little more than half a second considering the implication of my statement, she'd see that her ass isn't fat, as I'd have said so earlier and more frequently.

We've been together 8 years, before you say that it's doomed to fail. Honesty works in relationships.

Back on topic: Yeah, I'm an asshole too. At least I'm honest about it.
