    Hmm, funny, the article only lists specifics of apple's case, however, wherever you go this is referred to as a countersuit.

    Kind of hard to countersue simultaneously, however, as Apple appears to have been expecting this, they had thier briefs ready to go, thus the same day filing.

    So, unless you think the legal system works like Magic: the Gathering and you can tap two blue lawyers to simultaneous counteract a legal suit, I think I will follow the articles referring to it as a countersuit as opposed to your ill informed flaming.

    You obviously do not understand a term called "Corporate strategy".

    Of course Creative is still making stuff. Only an idiot would assume they are not. They, however as a company, decided to sue apple to either 1) quash competition and make more money, or the more likely 2) have apple pay them a settlement and negotiate a juicy licensing deal.

    This strategy has obviously backfired, as apple had aces in hand, and now will just cost both companies money instead of one profiting at the other's expense.

    My comment was in the light of they should have just stuck to thier product as a profit source instead of this ill advised legal misadventure.

    So, Creative tried to play the patent bully game with Apple, and Apple turned the ship and broadsided them.

    Serves them right. Get back to making products and selling them to make a profit.

    I see the op's point though. How hard is it to say "Hmm, interesting, I am not quite sure what is going on there, I will look into it".

    I do this at my support job, and the users love me. Even if thier machine is hosed and needs replaces and the new one will take three days to arrive, they are happy because I put effort into it, did my best to fix it, and kept them apprised of the situation in terms they could understand.

    Too many IT people got called up by New Horizons, got a paper MCSE with no real experience behind it, and think that they are the 3l337 haxx0r. They treat the users like they are an inconvenience, and spew bullshit, or worse, accurate techno jargon that the user does not understand, and ultimately, the issue does not get fixed. I hate these people, as they my MY life hell, because they set the expectation in the users that they will be belittled and blown off, adding to thier frustration level when they call me.

    There have been dozens of calls over the years for drivers to be open sourced!

    And they ship millions of units per year. So while every few years a few thousand people may clamor for them to change thier business models and practices (which is expensive to thier eyes), millions more happily use thier products without a problem.

    What do you think thier course of action would be here? They could lose every Linux customer they have, and it would probably not adversely affect thier bottom line too much.

    The irony is, around Halloween, I went ot Best Buy to pick up I don't even remember what now, and the entire Geek Squad dept were dressed as pirates.

    It is not too hard. Everything on thier network goes through routers and switches. If they put sniffers in each of those to flag suspicious communication and capture the data as it passes through in real time for review later, your only limitation is storage space, and the gumint has lots of that.

    I am a gamer. I use a PC currently, and a really old iBook. I have decided that as soon as the Intel Powermacs are out, since I can dual boot Windows on them, I am getting one.

    So yes, some of us are going to switch.

    I agree here, I still have a revision A G3 300 iBook that is a little beat up on the outside, but still carries on like a troope despite being disassembled, dropped, shuffled and generally abused.

    No dead pixels either!

    I am saving up now to get a Macbook as a replacement, although I am sure by the time I have the money, they will have replaced the iBooks with an Intel model.

    And therein lies the problem.

    Such practices have no place in the election process of a free society. If the government truly valued our electoral system, these boxes would be totally transparent with documentation freely available, and any third party would be able to run verification tests on them.

    Actually, all the data I have seen on the Diebold machines is that they can be compromised in a matter of minutes.

    So let me get this straight.

    Election commissioner notices an irregularity in the memory of some voting machines, from whom the owner of the manufacturing company has very clear partisan leanings.

    Election commissioner calls in a third party to run testing on the machines.

    Now, I do not see a problem with third parties running audits on the machines used to count my votes. In fact, I want as MANY third parties running tests on thes to insure thier accuracy, as the fate of myself, my family, mmy state, and my country will be affected by what this machine spits out.

    However, here we have third party verification being spun by Diebold as being a VERY BAD THING.

    Whatever happened to transparency in government and in democratic processes? Is it not one of the core values of America?
