    As far as I know, the courts view more recent acts of Congress as the more recent expression of democracy. If the United States Code is internally inconsistent, then the judge will tend interpret the law so as to follow those sections enacted later more closely than those sections enacted earlier. The Digital Millennium Copyright Act, which may make click-wrap EULAs binding, was enacted more than a century after the Sherman Antitrust Act.

    I am not a lawyer, but I watch a lot of "Law & Order".

    Under standard copyright law, you cannot derive from or create an aggregate work from my code without my permission. This means no linking, period.

    Under section 117 of standard copyright law, the owner of a copy can derive from a computer program to a limited extent:

    Notwithstanding the provisions of section 106, it is not an infringement for the owner of a copy of a computer program to make or authorize the making of another copy or adaptation of that computer program provided:
    (1) that such a new copy or adaptation is created as an essential step in the utilization of the computer program in conjunction with a machine and that it is used in no other manner, or
    (2) that such new copy or adaptation is for archival purposes only and that all archival copies are destroyed in the event that continued possession of the computer program should cease to be rightful.

    You can't breach a EULA as they are not binding contracts.

    According to one interpretation, the EULA has been a binding contract since the DMCA was enacted in October 1998. (See how installers may qualify as copy-protection.)

    To make a binding contract, both sides must give something up. You give up the right to reverse engineer the software, sue Apple, run the OS on non-Mac hardware, etc., and Apple gives you "the authority of the copyright owner" under 17 USC 1201 to run the installer that decrypts the computer programs that make up Mac OS X.

    So don't agree to the license agreement and figure out how to install OS X anyways.

    The installer that displays the EULA can be thought of a device that effectively controls access to the copyrighted Mac OS X computer program and is therefore eligible for protection under 17 USC 1201, enacted as part of the DMCA. And if the DMCA is inconsistent with existing first sale and backup laws, the DMCA takes precedence because it was enacted later.

    I thought FireWire and Serial Attached SCSI were implementations of SCSI over a serial link, and Serial ATA was a subset of Serial Attached SCSI.

    Yes there is. The CDs still cost $15 to $20 because they're only 10-20 years old, which is brand-new in comparison with other copyrighted works. Expect a price drop around ninety-five years or so.

    Twenty-five cents per download is also absurd. Federal regulators have set the statutory licensing rate for the musical work alone (independent of any sound recording thereof) at eight cents per copy, to increase in step with the Consumer Price Index, payable to the songwriter's publisher (which generally splits it 50-50 with the songwriter). This would leave little or nothing for the record label and the service provider.

    One hack to run Win32 apps on the Xbox console is Wine.

    Another is running Microsoft Windows within VMware or the old version of Plex86 (back when it was a VMware replacement and not a clone of User Mode Linux).

    Grab the windows version if you want.

    The Windows version of Qt 1. is incompatible with GPL libraries, and 2. requires Microsoft Visual Studio, which costs over $1,100. If I had that kind of money, I'd buy me a new PC to run Linux on instead of buying MSVC.

    I define a *n?x operating system as any operating system that conforms in spirit to the Single UNIX Specification. I define a UNIX operating system as any *n?x operating system that carries the Open Group's UNIX brand. I define a *n?x GUI as any GUI which is designed to run on a *n?x operating system and which has a reasonably complete free implementation. (X desktops qualify, and the Mac GUI will qualify once gnustep matures to the point where porting Cocoa apps becomes trivial.)

    Is there an extension for NTLM authentication on a desktop platform other than Windows? Mozilla 1.4a for Windows has NTLM, but AFAIK it just tunnels through Windows's own NTLM support and won't work on BSD (FreeBSD, Mac OS X) or GNU (Mandrake, Debian) systems.
