Yes, you are mis-understanding it. The plaintiff is objecting to Google offering it's name for sale. Adwords works by offering word up for bid. Google gives the words to the advertiser. You (The advertiser) put in Handbags, and adwords kicks out "Purse, Doonie, Louis Vitton, Wallet..etc etc." This is what Louis Vitton won on. This has nothing to do with advertisers' rights, or passing off as, or competitive comparison. Once you understand that you'll see why they won. Google is using the trademark of Louis Vitton to make money.

Imagine the stores creating an Isle named Coke. The store advertises the isle as coke, plasters it all over the entrance to the isle. Then offers the isle up for sale. That's what's at issue here, the fact that Google offered up the trademarked name Louis Vitton for sale to the highest bidder.

  9. Real Reason on Google Ruled a Trademark Infringer · · Score: 1

I believe what is at issue is this: Google offered the words "Louis Vitton" for sale. It's not about the ads that were shown, It's not about searching, it was the fact that Google put up for bid the trademarked name "Louis Vitton". Since we are all fond of analogies, imagine if you will the telephone book offering for sale real estate in the yellow pages under a section called "Coke" and a section called "Wal Mart".

  16. Time and Attendance on Computerized Time Clocks Susceptible to 'Manager Attack' · · Score: 5, Interesting

I sell and maintain Time and Attendance systems for my customers. Our software audits punches in a real simple manner. If the punch comes in from the clock it shows up on the employee time card in black. if it is edited or changed it changes to red. It's impossible to cheat the system. If you cheat there's an audit trail. This is how it's supposed to be done.

Now what i do see a problem with is rounding. A lot of places like to round punches in a very unfair manner. If you're 15 minutes early it rounds forward, and if you stay 15 minutes late it rounds back. This is VERY common, however illegal.

The law states that whatever rounding rules you apply at the start of the day must be the same rule you apply at the end of the day, so if your employer uses these techniques to cheat you, do something about it.

So tomorrow i release a coffee maker and I call it CAMEL Coffee Maker. Then a little later i come out with coffee filters that double up as tobacco filters(ok stretching, but who knows).. do you not think that camel cigarretts should be able to come after me?

The fact is you can't trademark a common word with unless it's used in an uncommon setting like APPLE MUSIC. Name an apple from a tree that's called Music.. hmmm seems to me Apple Records was the first to correlate Apples to Music.... funny how that works.
