    True, I doubt they (NetPD_whatever) actucally downloaded the files content, (3MBS X 333,000) = a hole hell-of-alot bandwidth. They probably just did sometime lame like

    There won't really be any real way of tell who REALLY had Metallica mp3s, without downloading.

    But %90 of the users that they "Metallica" in a mp3's name, %80 of the time it is probably going to be an Metallica mp3, this still is a high number.

    they got your username (and ip?) and that is it. Say they don't have your ip address and force napaster to give up there logs on that date (assuming they don't rotate logs every week or so) and they manage to get your IP. Ok, so they got your ip and roughly the time you where trading metallica mp3.

    With that IP, they would find how it was registored to (more than likely your isp), then they would go to the registors of that ip (more than likely your isp) and court order them to give up the logs files on that date for dial-in connection (assuming your on a dial up), or what ip is staticly assigned that.

    If your ip is staticly assigned by your isp, your pretty screwed, but if it is dynamically assigned like for a dial up connection (cable modem??, dsl??) they would need the log files. Most smaller isp rotate their auth-log/radius log files alot (every week for some) because 1) they are small and can't afford disk space 2) they really don't give a crap what their users do

    Or, say they magically get past all this crap and do get your ip and that leads back to the username on the isp, with that username the isp (under court order) finds your billing information and it traces back to your name, simple huh?

    Ok, so they know have to get a search warrant for your house/apartment, plan a raid, then arrest you/ or take your computer equipment to look over.

    Now lets think about this, how long is this going to take? It has been 1-2 weeks since they go this user names, it will probably take a couple weeks PER USER to get a warrant for the isp, then it might take 1-3 days for the isp to produce the log files (assuming they wheren't flushed at this point) and then it will take 1-14 days to get a search warrant for your house. Ok, now rinse and repeat for 330,541 more users. If you are at the VERY bottom of this list, it might take YEARS to get you arrested (assuming the isp still has the logs, and you still have the mp3's on hard disk)

    Metallica isn't going to arrest 300, 000 + of it's users. This is being used as "Look Mr. Court, they ARE trading meticall mp3s on Napster, look big piles of paper, it is proof"

    How can I mask my IP number when going online (through IRC, web, napster, etc.)? And I mean really anonymous--no logs to be revealed under court order.

    I sometimes use a socks{4|5} anonymous server. They are really hard to find, but they do mask your IP under anything you can find a client for (irc,telnet,ftp,etc.), a lot of the anonymous socks servers get abused alot so they don't stay around for an extended period of time, ussually have to find a new one every week or so.

    They do mask your IP well (it appears to be coming from the socks server), but under a court order they might be able to get your IP from the "anonymous" socks server. It isn't full proof, but it can help you in some sisuations.

    there is huge listing out there of anonymous and free socks avaiable on the Internet, also there is free shell accounts. These both appear to "mask" your IP, but the server that you are bouncing from can grab your IP if they really wanted to (some have a no-log-ip policy, some don't), also make sure the shell/socks proxy you are "bouncing" off allows this, some sites "forget" to secure them probably and they get posted on this list, then 100 script kiddies start trading p0rn though them and it ends up in a big mess...

    He has not provided details beyond the fact that NetPD's software "works like 5,000 humans sitting in a room doing Web searches" to identify thousands of user names very quickly. He insists that to say more would enable Napster and other MP3 programs to block the software.

    Oh my God he is using software to brain wash people into doing web searches, any army of mindless droids, he must be stopped. We already know he has 5000 mindless slaves, how many more before before we step in? He must be stoped know.

    Seriously, though, I think the RIAA should sue Iomega for creating the zip disk and Al Gore for creating the Internet, both which are used to trade .mp3 files. In fact IMHO they should take it a step further and sue ALL cpu manufactors (Intel, AMD, etc), because you can't convert or play .mp3 without some type of CPU. It should be illegal to own a computer or have an Internet connection (or even a phone line) because these can and will be used to trade .mp3 files and rip off the music industry.

    The Information Age can wait dammit, the Musical Revoluation (which oddly enough is also the name of a boardway musical) must come first.

    Seriously, mix it up a bit, come up with some word, NO ONE could dispute.

    How do you spell pronouce "Hack" or "Hacker" in say latin? Let's use that, or if that sucks, what is hacker backwards in german?

    It is a lost cause to fight for the word "hacker", it could mean a ton of things

    Come on, lets get somthing new. What is (("hacker" in binary) x (3.16 in binary), multiped by 42) then converted back to ascii and translated to russian? We use that word, and put it under the GPL.

    a couple quick notes, first Microsoft is releasing a patch to all it's customers called "IHATEYOU" as the subject like, and the anti-virii fix is called "Microsoft_hates_all_it's_users.vbs", double click to install the fix.

    Second, this is what will be an everyday thing if Microsoft relases more information on it's API. This is a total lack of security on Microsofts part, they never should have relased any documenation on visual basic.

    I don't mean to sound contrite, but is this really surprising to anyone? Didn't anybody learn anything from 1929?

    Sorry I wasn't alive then. What was it like?

    The way I was taught to invest has been learned though listening to drunks at a bar, which now that I think about it, someone that drinks heavily from a major finicial lost probably doesn't give good advice on the stock market...

    Anyways, what I have always been told, is that you should invest for the long term, not none of these, dump a couple bucks in VALinux IPO and bail out early. (sure it works, but...). If you invest for the long haul, sure there is going to be up's & down's, but after 10 yeras, there will be a whole lot more up's than anything else. Invest in strong companies that will be here in ten years. A rule of thumb I was told was "Ask yourself, is this company going to be around in 100 years? Are they going to pull a profit every year (not matter how little of a profit)?"

    Look at GM, Coke-a-Cola, IBM, these are all strong companies, sure they aren't sexy start ups, sure they don't pull a billion dollars a day, but they will be there, and they will make money though the years. Tech companies can do this, but it wouldn't be as sexy now would it?

    damit I think they riped me off, when I opened my Althon box all I found was a fried egg and 2 strips of bacon. It actucally worked out well because I was hungry and the egg was sunny side up, Mmmm my favorite. Oddly even though, the bacon did clock in at 700Mhz without over heating, but now my dog is sniffing at my computer case...

    I should of notice when grease was driping from the bottom of the box, and another thing, how the hell can you have a good breakfast without hot grits? What are these people thinking.

    I know a lot of people already posted this (or are going to), but you will see a lot of perl around in the CGI camp. It does have some good qualities (not saying you can't find these in other launages, but...)

    It can process text really well and quickly, this is very usefully in CGI program.

    It is portable, quick change it from one platform to another without a lot of modifaction

    A glue launage, glue an html front end to a DB back end, glue a mail server with an html form, etc...

    Supported, the perl community is activlly supporting and developing new feartures into this

    Some disadvantages though, is that the launage isn't to clean, some times it is very hard to maintain code, even 15 minutes after you wrote it! You can maintain the code, but you have to activelly think about this BEFORE you even start chuncking out code.

    CGI programing is more or less like any other programming, you just need more in the way of

    text processing
    portable
    interact easliy with other things (databases, sockets, etc)

    IMHO perl does all these things really well. The only bad thing I have found using perl, is that a really big project can get really mess if you don't think ahead and make sure everything is written down on a white board first. If you are working on a large project using perl, please do your self a favor and sit down and write down the program "flow" before you start just randomly typing code, it will say you a lot of greif.

    It's clear that Linux will introduce changes into the pricing equation,

    Linux is cost effective as hell and making everyone look bad, including us!

    especially in the SMB market.

    and Linux sure is kicking Microsoft's ass, anyone that can stand to MS is one tough mofu. When Microsoft is out cold and we kick them? Can we stand behind Linux and mouth Microsoft and have Linux protect us from getting hurt?

    The details remain to be seen.

    SCO is committed to its resellers and recognizes that they are being challenged to adapt to some of the new terms of this marketplace.

    Good point, but if you don't like McDonalds you can work at Subway, Steak & Shake, etc. It is true though, when I was working at McDonalds, it wasn't because they respected my freedom, but rather, I really need to pay rent (at least that is what my landlord was saying at the time). True most places will strip you of all rights when you walk into the door.

    The laws (freedom of speech, freedom of relgion, freedom of press) are for the US goverment. Sorry if I don't include forgien countries, but I don't know there laws there. The laws are in place so that the (usa) goverment can't screw you on basic freedoms, they aren't there to protect companies, citizens or others from taking these rights away, they are just there so the person has a right that the goverment can't take away.

    Almost any private place is going to take away you rights. If go into church and pass out, let's say "satan is sexy" bumper stickers, the church will (more than likely) ask you to leave. You scream "Hey man, I have the right to do this". Yes you do have a right to do this, from the goverment, the FBI isn't going to step in an drag you away, the CIA isn't going to sniper you, the goverment really doesn't care what you views are (at least that is what they say). The people that ask you to leave, aren't enforcing the goverment laws on you, but "their own laws", not the goverments.

    If you refuse the leave, they may call the man (ie. police officers) and have you arrested for tresspassing and distrubing the peace, but they aren't arresting you on your views. They are arresting to protecting others (the churchs) right to freedom of speech/reglion

    If you build your own church and start up a club that preaches "GNU/Linux Rocks" you are allowed to do that, and the goverment won't do anything. You could then make up your own rules, "This is the house of GNU/Linux, thou shalt not bring in closed source software" then when someone brings in a Windows98 you can though them out onto the street and yell "Don't bring that shit in here bitch, we ain't down with that". But that would be YOU inforcing your "own laws", it won't be the goverment.

    But back to your orginal comments, when most people work at McDonalds it is because they HAVE to work there, not because they have a choice. In theorgy, they way it is supose to work, is that the person should be able to go work anywhere where they have the skill to work at. Anyone should be able to do what they want when the "grow up" (atleast that is what my parents told me (I think they may have lied)).

    The thing is, if someone doesn't want to work at McDonalds, in theogry mind you (which means it doesn't work in the real world) they could get goverment grants/finacal aid/loans/scholerships to go to trade school/college/etc to gain more knowlegde, expeirnce, education, training to get the better job. This sometimes works, this is how it is supose to work. It does take time, but if they need to be able to train for a better job and be able to pay rent at the same time, there are options.

    Just for the record, I am not knocking anyone that works at McDonalds, I used to work there. They are a respectable company and am not trying to FUD them, just using them as an example.

    Even if you do have a better job, you company will still take away your freedom. Say you work as CEO of AOL (forgot his name). If that CEO of AOL came out and said AOL sucks, and used his own money to fund an AOL sucks rally, do you think the investors/stock holders/border of members respect his "Freedom of speech"?? The goverment would respect his freedom of speech, but not his company, his company would throw him out on the street (exactly the same as if he worked any other job). I think almost all jobs would fire you for something like that.

    The only really job where you have complete freedom (under the goverment that is) would be a freelance job, or a job where you own the company. For example, before Andover/VA bought slashdot, I bet CmdrTaco could say "Slashdot sucks" and not get fired since he owned the company (unless he wanted to fire himself in some weird world). There are very few jobs that offer complete and utter freedom most of them are freelance/self run|owned companies/drug dealers/pimps. For the rest of us, we must do what the man says if we want to pay rent, even if that includes giving up personal freedoms.

    On a side note, this is extremely difficult to say after just having watched Brave Heart. I bet if I had a sword the "man" wouldn't be on my back as much.

    The think you forget, is when you want into a workplace, you lose some of your freedoms. It is a private company and they don't force these "laws" on you, they give you are choice, "play by our laws, or leave/get fired"

    For example, we all have the moral and legal right of "Freedom of Speech", but if you take a job at McDonalds, when you are clocked in your "Freedom of Speech" goes by-by. You can not say "So what the fuck do you want on this shitty ass BigMac dicksmack" to the customer. Sure, this is prefectly legal and lawfull (in the US), but McDonalds (private company) will fire you.

    If you want to be able to say "fuck" and tell the world McDonalds BigMacs are "shitty", you will have to do it on your own time. The fact is, you are working at McDonalds on your own Free will, and they hired you on their own Free will. At any time either you, or them may terminate the employement agreement. (unless you sign a contact)

    Most companies do monitor, on our phone system they warn the customers and employees that the lines are tapped, I mean montior for employee spying, I mean employee montioring and training purposes. They aren't forcing me to work here, and they aren't montioring without my permission. If I did not agree to this, I would have to either 1) quite 2) not agree to it (which would probably lead to me getting fire)

    I think an employeer has the right to monitor, but the company HAS to notify the employees for this before hand and tell them what they can and can't do with the system (ie. no p0rn in email or hot grits in pants during business hours, expect for on fridays)

    Say you complete shutdown napster, they give you a big lump of money, and all napster software automagically disappears of the face of the planet, what then? People will still trade mp3 files, there is web/ftp/irc/zmodem/zip disk/cd-r's/nfs/samba/email all of which can and have been used to trade mp3 files.

    The Internet/networks/computer have been build to share and transfer data, it doesn't matter if the data is mp3/p0rn/top secert govement documents, the data can get transfered even if Metallica, the goverment, a pack of wolves doesn't want there data transfered, it will be, if it is good enough to be transfered.

    I know people that have been trading Metallica bootleg rare mp3s for years, before napster and they will continue to trade these file, even if Metallica can legally bitch slap napster enough to stop production.

    Kill napster doesn't slove the problem, does Metallica understand this?

    There is a really quite simple fix for this, it comes down to basic security that should be praticed at all times. For example, this worm (among others) spreads it's disease though the use of the address book in outlook express.

    This address book contants email addresses that the person enjoys send/receiving email with. You could say, the address contains a list of "freinds" to the user. The best way to fix being "labeled" as a "freind" is to use words like "I hate you" and "get away from me", spitting, cursing and talking bad about the pope also are some basic security measures you can take to avoid being put into this "address book" which will be used to send virii/worms to.

    Also since this is spread though the use of outlook express, which is an email program. Email programs are used to communicate between to users or person. I can only conclude that communication between humans, in any form is a major security risk and should be stoped.

    The two basic security prinicpals we learned here, is

    1) communication between humans is bad and should not be allowed

    2) be a complete jerk so that even if rule one is broken, you will still have a "fail safe" method in which people will avoid communicatioins with you.

    Really though this isn't to bad, they help fund the development of an Open Source/Free Software project and they should get some menation, either in the README file or when it comes into play (which just happens to be at boot time). I have D. Becker (the Ethernet guy) in my kernel message, and I see nothing wrong with that, he wrote a lot of drivers (and some I use at boot time) and should get credit for that. If a company gives a crap load of money to pay programmers to develop OpenSource/Free software, then they should get some menation from it.

    This right now isn't that bad. But my question is HOW far can this been taken? If overdone this could be a bad thing. Having everyone from Kool-Aid to Hot Grits, Inc. posting into your kernel message can be a bad thing. (Not that I am against Kool-Aid or Hot Grits or anything, actucally that Kool-Aid bowl of punch makes me uncomfortable)

    And it is techinally possiable to do a huge ass Frame Buffer Ad, but is this what we really want?

    The thing I like about Free (as in speech software) is that the only things included are for techinal reasons. Everything that is built into vim is there for a techinal reason, and I like that. What I hate is no-techinal stuff in programs, like if one day I load up vim and it asks me for a serial number, screw that, that is no reason to have a serial number there (even if it was commerical software) because it serves no techinal purpose. Also if I loaded up vim to edit a system file and it poped an svga full color ad in my face that I had to watch for 30 seconds before it let me admin my machine, I would be seriously pissed.

    If a company supports free software develop, they do deverse credit, props and a shout out from their homeboys. As long as they do it someone reasonable, it is cool. When they start doing Full screen ads though, that could cause some problems.

    More than likely, I still don't see you point. Ok lets assume Word97 is the greatest word processer of all time, say it has the prefect user interface. Ok, now on the back end, rip, tear and pull out that property format. Ok, so you just have the front end now right? Ok when it tries to save the file, have it push everything out into html instead of Word97 DTD. Ok, so you have an HTML file pushed out, but the user doesn't know it is an html document, pretty neat huh?

    Ok, so html is a little bloated, lets use a freely avaiable compress program to compress that sucker. Have it save to disk in html, compress it, without the user even knowing about it.

    Then what do we have here, Bob has a file called `Resume.gz`, smaller than a word document, more portable then a word document (you can find gzip on almost any machine) but looks exactly like a word document and the user doesn't even know he is save out into an html format. What is the disadtanages here? It makes the admin life more easier, when Bob say "Oh dam on a Mac/OpenVMS/Unix/DOS I need to find a Word97 machine" his freind can say "Wait Bob, dont' be silly you old gus, this machine can read you document, the days of property DTDs are gone my freind"

    Why not even html 4.0 for a standard DTD? Seriously how much stuff do we REALLY need shoved into our bloated word processers/documents any ways? HTML 4.0 can do Tables, images, highlights, points, etc, etc. Seriously, give me a standard Word97, Star Office, Applix, Word Perfect documents and tell me that something in them can't be done in staight html. Give me any document and I bet I could convert it into staight HTML and have it look exactly like the $250 office suite.

    How much useless crap do we REALLY need in documents? Seriously, a paper typed on a $15 type writer from ebay and a $200 Microsoft office suite, tell me, can you really tell the differance between them. We need to write paper, and have these papers look professinal and that is it, and you are telling me this can't be done in staight HTML?

    Hell, HTML is everywhere, take your document edit in Hot Dog Pro and view it in Netscape under Windows. On a Unix machine? Use vi, bluefish and Netscape or kfm as the viewer. Got a mac, uh, I know for a fact there is Mac HTML editing software, just don't know it's name at the momement. See where this is going?

    Create your documents, upload you documents to a web server, or put them on a floppy disk and I guarnette that everyone on any decent platform will be able to not only view, but edit these documents.

    Does anyone else remember the KISS theorgy in "intro to CS". Keep It Simple Stupid. Everyone can make good use of staight HTML and it looks dam good, what is the problem?

    If you want to test this out, the next time you have to write a document (school paper, resume, etc) do it in staight HTML. The open up your favorite graphical browser and click on "print", hand in the paper, does the other person notice? If no, this is a good idea, if yes, this idea sucks.

    Seriously name one fearture in Word97, Star Office, Word Prefect that couldn't been done in a nice GUI html editor? Just name one, one example.

    When I had to start writing papers, my freind told me "No you can't write documents in vi, here use this". I load up Word95, after it takes fifteen minutes to load and grins the hard disk the entire time (lack of memory, swaping a lot) it basically gave me the funcation to put "Bullets" and "underline". Yea, why the hell can't I do that in vi and html, print it in Netscape and it will look the exact same, the differance though

    1) the document is protable
    2) the document can be uploaded to the web without any modifactions
    3) I can use any standard ASCII or html editor on any platform to edit it
    4) the document size is smaller
    5) I have html bragging rights
    6) the document looks just as good as any non-portable property document
    7) I don't have to pay $200-500 for a word processer

    I have thought about this for a long time and haven't really seen any advantages in using a word processer over html. You may debat, "the are %100 easier to use", you could make a GUI html editor just as easy to use, just 'hide' all the tages from the user and have all the same buttons. Just most (or some) html editor don't have spell checkers, etc. But how hard would it really be to build these into a GUI HTML editor? Very simple.

    I don't mean to be flaming here, but I honestly don't see any adtanages over other word processers (hell you could use these as the front end and just have it "spit" out html in the background when the user it not looking)

    It sounds so simple, please enlighten me if I am wrong here.

Make sure you address the issuses and get your point across without any cruse words or name calling. This is a chnace to really talk to Metallica and not though some pr, media induced, marketing and legal BS. It is a chance to address Metallica as real human beings and a chance to see their point of view better. Make sure you understand exactly where they are comeing from before slashdotting them with a hunderd posts of "Hot Grits!"

    For Linux to get mainstream we must get rid of the radicals and focus on the quality of the results.

    1) I don't think GNU/Linux would be where it is today without the radicals that helped develop/code/test/push/hack/smash the system. do you think all the kernel hackers out there are "non-radical normal people"? The more a person belives in something, the more a person cares about something, the better job he is going to do.

    2) The quality of the results will increase in ALL software once it is Free (as in speech).

    No Beowulf cluster is going to crack this, so stop thinking it could: distributed.net is managing a problem of order 10^20.

    Who says it has to come to a solution in our life time? It would be cool for the next few generations to see on the news in 3000 (assuming they didn't all did from the Y3K problem or the 2038 problem) to hear

    "This week the dischess project completed and unrealved the prefect chess game today. The final computation was completed by a home PC with only a merger TY CPU running at 2500 THZ and a only 32TB of main memory, it is good to see slow machine still capable of running something productive."

    I am not saying that it is practical today to start this type of project, it should be started, even if they know we won't see the results before we die, it would still be cool. Plus if you get a bunch of engineers, CS and grandmasters in a room with a massive cluster, something Good has to come out of it, even if they don't find the prefect chess game.

    Go back to the PD11 era and tell the brightest CS that computers would be able to generate 3 hour fully CGI 3D movies in the matter of 6months-1year.

    Very True. I went on vaction to Texas one year and purchased a copy of Microsoft Windows 98 and when I got home (NY) to install it, it didn't work. The reason? I can only conclude this peice of software didn't work because it was made by and for Texas and not NY. Software is that smart and ajusts it's self depending on your location (example, how does it know what time it is when you first install it!!!). Buy local software for your computer and save your self some trouble. The next day, I went to the local computer store and picked up Red Hat Linux 6.2(NY version), install it on my computer without any problems.

    Judging from the facts at hand, the only differant was that one was a Texas version and the other was a NY version. Buy from your local state.
