  1. Re:Creation of custom CD Ripping hardware on Restricted CDs Quietly Distributed · · Score: 3

This raises the question: It is illegal under the DMCA to crack encryption no matter how trivial, but it is legal to make coppies of music for personal use. Does this mean that I would be within my rights if I were to develop a mechanism to copy and store streamed music from subscription music services such as are being developed now? - this assuming I could play the music that I hace coppied off of the streaming service...

This is why the DMCA is bad, under the "Fair Use" laws you have the right to make copies of music you have purchased for personal use. However, under the DMCA, if the music is encrypted, any attempt to break the code is illegal, even if it is for "Fair Use" purposes. Further any tool you use to break the code is also illegal even if it also has non-infringing uses, which might otherwise be protected under "Fair Use". This is the reason why it is thought the DMCA is not about copy protection, but control, greed, corruption and power.

I think you have hit on it. When one of us buys a machine with Windows pre-installed and install Linux, sure Microsoft has sold a license (good for MS), it will never have to support (also good for MS). However the down side, for MS is no future revenue, because we will not be in the MS upgrade cycle. If MS can get the Linux community to start using .NET, then we can be put on the upgrade cycle, which means continued revenue for MS. How many of us would start using the .NET version of Office XP or Internet Explorer, my guess is a great many.

Think about this, I give a couple hundred dollars a year to campaigns, mostly local and state, this usually gets me a nice form letter reply. When Michael Dell or Bill Gates gives hundreds of thousands to campaigns, you can bet they do it in person and make it very clear what needs to happen in order get another huge contribution. As for an aristrocracy, isn't that what we have now ? Both the Senate and Congress are full of very wealthy encumbents who are backed by other wealthy people such as Michael Dell and Bill Gates, and belong to a Royal Family (the Republicans and Democrates) this pretty much constitutes an aristrocracy in my book.

It is very easy to put the hardware together. A Celeron/Duron in the 600Mhz area, motherboard (with integrated sound/video), 128 MB RAM, a DvD drive, 20 GB Hard Drive, wireless keyboard/mouse, speakers and a TV tuner card with s-video out. If you shop hard you can assemble this for $500-$600. Both Windows and Linux has software which allows you to record off of the TV Card, but if you want to be able to watch TV and record something else, you will need to purchase two TV cards. At that point all you need is someone to write a program which will download the TV listings from TVGuide.com, search the listing for the shows you want and setup a scheduler program to record the show.

Of course it might be worth it to wait and see if any other companies decide to start making TiVO like devices to sell as hardware only, no service at all, but will cost more like $500 rather than TiVO's $300, in order to make money on the hardware. I am a happy TiVO subscriber, but I'd still buy one of these hardware only boxes if someone would put one out.

Does linux's bash scripts, frex, are an extreme and unneccessary security risk?

The answer is no, bash scripts are not a security risk. It is all about security model, the Unix security model does not lend itself to this type of exploit, while the non existant security model of Win95/98/ME and the barely exceptable security model of WinNT/2K does lend itself to this type of problem.

I do agree the problem is with users, they should not be opening attachments from unknown sources, but the fact of the matter is, they do and Microsoft should know this and take steps to prevent these scripts from doing stupid things.

You may have noticed that VIM exploit you pointed to only runs code at the users security level, not as root. You should also note, there is a fix for it. While with Windows, this has been a well known problem for a couple of years now, MS has even tried to fix it a couple of times, but still, up until even a couple of weeks ago, I am still recieving VB virus's in my email.

In my opinion there are three reasons why virus's are a bigger problem in Windows then any other platform.

    1. More Windows boxes then any other.

    2. Windows virus's are easier to write.

    3. All the programers who could write Linux virus's are too busy writing Windows virus's

You also just pointed out Win2K's greatest weakness as well. The problem with you being able to script the OS is so can anyone else simply by embeding a VB Macro Virus into an email or a Word document. I point to the Melissa and "I Love You" VB Macro Virus's which were nearly unstoppable last year, as examples of what is to come. I do not consider the ability to "Script the OS" to be an advantage, I consider it an extreme and uneccessary security risk.
