Furthermore, it's going to become less effective as webhosts are moving to having a DNS entry in their domain point to someone else's ad server. I think ads.nytimes.com was serving up ads for a while but it was resolving to a doubleclick.net IP address. In short, it's not an effective solution and it breaks lots of sites. It *should* be hidden.

People gave copyright to the FSF. They generally do good things with the money they get. I've donated to them.

This was a ruling for a summary judgement. A summary judgement in favor of Napster would have thrown the case out completely. In order to prevail on a summary judgement, Napster needs to show, as a matter of law, that they qualify for the ISP exemption. If there are issues of fact which need to be determined before they can be ruled to qualify for the ISP exemption, they don't qualify for a summary judgement.

They can present these issues of fact and still claim the ISP exemption at trial. This isn't a "win" for the RIAA as it has been portrayed. It is the absence of a loss.

The strong statement in your title is not supported by the body of your post.

The GPL is not meaningless without the FSF. Any organization could serve as the clearinghouse for copyright assignment for an Open SOurce project. I'm still not convinced that one is necessary.

A Class Action suit by those who contributed code to the Kernel could be formed with Linus as the lead complaintant. The problem of perhaps not being able to identify the individuals is thereby avoided. Anyone claiming to be in the group could demonstrate it by providing copies of the patches they provided.

In the case that someone contributed code that they didn't have the authority to contribute, the FSF would be in just as much trouble as the Linux Kernel group. But, frankly, this is not a real problem. The code in question could be pulled out and replaced with functionally equivalent and non-infringing code fairly quickly. Furthermore, the complaint would have to disclose exactly what code was infringing.

  13. Netpliance needs an honest business model on Meeting with Netpliance · · Score: 2

There is nothing wrong with a business model that uses contractual revenues in the future to subsidize an up front outlay. This is commonly done in cell phone contracts. In that case, there is legal language that you sign. The contract has cancellation fees and cancellation is rigorously defined.

Netpliance did not choose this model. They chose to simplify the up front purchase without requiring agreement to a contract. They didn't want to scare away customers who aren't sure if they really want to make this kind of committment. They chose to sell through outlets (i.e. Circuit City) that were not able to handle prcessing a contract.

Companies should expect that their customers will act in their economic self-interest. If you need to compel behavior to protect your business model, you need to put it in a contract and not resort to shady tactics like charging people for services that they did not authorize or retroactively changing your terms of service. Netpliance can't have it both ways: wanting not to scare away people who are afraid of a committment and enforcing a committment that people have not made.

Their business model is broken as designed. It is based on a fundamental contempt for their customer. They do not deserve our resepect. If they need to compel behavior after the sale, they need to execute a properly drafted contract.

Why would you want a different OS/API on every device?

The long startup times on Linux desktop systems are due to two things: probing for hardware and runniong the Sys V init scripts. In a closed box, you don't need to probe for hardware. You also don't need to design a Linux system to require either filesystem checks or lengthy startup scripts. They could load a pre-initialized Linux kernel into memory (or, better yet, into execute-in-place mappable memory) practically instantly.
